Our Los Angeles Injury Attorney Answers Your Questions

“I was involved in a car accident and I can’t afford to see a Doctor. What can I do?”

If you’ve been involved in an accident, and you have no health insurance or can’t afford to see a doctor, you have options. There are doctors who are willing to see you on a lien, meaning that you will not pay up front from your pocket, however those doctors are willing to wait and get paid at the end of your case. The caveat here is you have to be represented by an attorney so that that doctor feels confident that they will get paid at the end of the accident.

In our case, when we represent a client who doesn’t have money or health insurance to see a doctor, we help find them doctors who are willing to work on a lien. That way, our clients get an opportunity in order to have the best medical care, heal through this tough process, and allow us to continue to fight the insurance companies and do what’s right for them.

“If I was injured in an accident, who will pay for my loss of earnings?”

If you’ve been involved in an accident and you’ve been injured to the point where you lose time from work, or what we call “los off earnings,” you have the right to claim for the insurance company of the other party to compensate you for your loss of earnings.

Loss of earnings, however, have to be proved: you have to be able to prove to the insurance company the exact time and the reason why you were out of work for as long as you were. That usually is accompanied by a physician who actually takes you off work because you are not physically able to work. Again, those are things that you should not be handling by yourself.   It’s well to be represented by an attorney so that your attorney can get the right documentation on behalf of you and your claim and represent that for you to the insurance company.

“I was involved in a car accident. When do I know if I need an attorney?”

If you’ve been involved in an accident and the only damages that you suffered was damages to your vehicle, you don’t necessarily need an attorney. You can deal with the insurance company on your own. However, if you’ve been injured, an injury doesn’t mean broken bones or blood. If you have any pain to your body that is consistent with injuries, then you have the right and you should be represented by an attorney immediately.

Clients who call our office immediately after an accident have the advantage of not making a mistake by talking to the insurance company themselves. What we provide for those clients is the protection of dealing with every aspect of the case for them and we help them walk through the medical portion of the case.

So if you’ve been involved in an accident, don’t forget—you should call an attorney immediately. Do not let the insurance company take advantage of you.

“If I am in a car accident, why is it important for me to take pictures of the other person’s car?”

If you’re involved in a car accident, pictures are a very important part of the evidence that we use in order to represent our clients during that accident. Taking pictures of the other person’s car is sometimes even more important than taking pictures of your own car.

What we face often is insurance companies saying that our client’s car does not have enough damage, so for that reason, they could not have been injured. But those clients who actually have taken pictures of the other party’s car and help us prove that just because their car didn’t have a lot of damage, doesn’t mean that the other car didn’t have a lot of damage; and pictures of the other car, which often has more damage, actually helps us prove the point that you did have an accident, you were injured, and that you should be compensated.

“I was in a car accident, but I don’t feel any pain, is it still important I go see a doctor?”

If you’ve been involved in an accident, and you don’t feel any pain, then I would discourage you from going to the doctor. However, nobody knows your body better than yourself. There’s an unfortunate myth that an injury is only broken bones or blood. However, having seen so many personal injuries occur during accidents, I can tell you that more than 90% of real injuries are hidden within your body.

So if after an accident you don’t feel a lot of pain, then I would recommend that you really watch yourself, and the moment you feel any kind of pain or discomfort, remember that you have rights in order to visit a doctor and make sure that you get a clean bill of health, rather than just giving up your rights and not doing anything about it. We’re here to help you if you have any questions.

“I got into an accident without any insurance. What do I do now?”

When you’re involved in a car accident, and you’re driving without insurance, your rights will be limited. In a normal car accident, you have the right in order to get pain and suffering along with your out-of-pocket expenses and your medical expenses paid. If you’re involved in an accident, and you don’t have car insurance, you lose out on the right to get pain and suffering for what you’re going through.

However, you still do have the right to get your medical expenses paid, and any out-of pocket or future expenses that you may incur because of this accident. For that reason, we always encourage anyone to buy insurance and to not drive without insurance. Without insurance, you actually get hurt a lot more than you may think.

“After an accident, why shouldn’t I just try to handle the situation all on my own?”

This is a commonly asked question after an accident, and I always like to tell people that you have the right to either hire our office to help you after an accident, or try to handle the case by yourself. The biggest mistake often people make when they don’t know the laws is that they have conversations with insurance companies and they give information to them that insurance companies don’t have a right in order to know.

Insurance companies will use that information and the fact that you don’t have knowledge of the law in order to hurt you and your case and to avoid paying you what you are entitled to be paid after an accident. If you’re injured, the best thing to do is in order to hire an expert in order to handle your case. That’s what we do for our clients, and we would be happy in order to help you in your time of need.
