Windsor Personal Injury Attorney
Sonoma County
If you were hurt in a Windsor crash in the last few days, the people who will shape your claim are already at work: a Sheriff’s deputy in a Windsor Police uniform or a Highway Patrol officer from Rohnert Park, an emergency physician, and an insurance adjuster who would like your statement soon. This page, written for anyone considering a Windsor personal injury attorney, follows that first stretch in order, from the scene through the first month, with the Windsor agencies and records that apply at each step.
Windsor itself is not a high-crash town. Its 38 traffic victims in 2023 put it 80th of 93 peers in the state’s Group D table, a list headed by the worst, and the composite placed Windsor 86th (OTS 2023). Those counts exclude Highway 101, which passes through this town of 25,864 (Census 2025 estimate) and is patrolled by the CHP. Whatever the town totals, the early days after your own collision matter just as much here as anywhere.
The scene and the days right after
At the curb or on the shoulder
Windsor voters chose in 1992 to contract out policing, and since the first agreement took effect in 1993 the Sonoma County Sheriff’s Office has staffed the town’s police (Sonoma Sheriff). The deputies who arrive at a collision on Old Redwood Highway, the historic route paved through town in 1915 (Wikipedia), wear Windsor Police patches and work from the station at 9291 Old Redwood Highway, Building 300. If the wreck happened in the 101 lanes, expect instead a Highway Patrol officer from the Santa Rosa Area, whose office on LaBath Avenue in Rohnert Park covers the larger share of the county (CHP).
- If the car still moves, pull it out of the travel lane, switch on the flashers and dial 911.
- Confirm whether this is a Windsor station case or a Highway Patrol one, and save that officer’s name and number together.
- Use your phone on everything: both cars, the paint on the road, any speed humps or other calming devices nearby, and what each driver could see.
- Take phone numbers from bystanders, neighbors on the block and anyone who stopped.
- Talk about fault as little as you can, and not at all with the other motorist’s insurance company.
Hours 1 to 24
Soft-tissue injuries and concussions often feel minor on the shoulder of the road and much worse the following morning, and adjusters treat a gap before the first doctor’s visit as proof the injury was small. Same-day care, whether urgent care or an emergency department, protects both your health and the record.
Serious trauma from a Windsor collision can mean a trip south on 101 to Providence Santa Rosa Memorial Hospital, since that hospital is the one Level II center shared by four North Bay counties (Providence).
Tip: Put the discharge paperwork, prescriptions and referral slips from that first visit in one envelope. On a Windsor claim, the first-day chart is the document an adjuster studies hardest.
Days 2 and 3
The report request goes to whoever wrote it, the Windsor station for town streets or the Santa Rosa Area for the freeway; ask when it will be ready, since reports are not released instantly.
This is also when the other insurer tends to call. A recorded statement is optional, and offhand remarks about how fast you were going or how well you feel have a way of resurfacing in the adjuster’s valuation. Notify your own carrier as your policy requires, stick to the facts, and if the other driver had no insurance or drove away, ask about your uninsured motorist benefits.
The rest of the first month
Week 1
- Ask shops and homes along the route, including any near the Town Green, to hold their camera video before it loops over
- Revisit the spot in daylight and again at the crash hour if darkness or glare played a part
- Note signs, signals and calming devices at the location; Windsor runs its own neighborhood traffic-management and calming program (Wikipedia)
- Start a short daily note on pain, sleep, missed shifts and things you have had to stop doing
- Keep the damaged car, or detailed photos of it, until it can be inspected
What the county plan shows: Sonoma County’s 2022 Vision Zero Action Plan put no Windsor street on its High Injury Network, though it does name Windsor among the seven jurisdictions that had developed or were developing their own Local Road Safety Plan, and Windsor residents sent in 126 survey responses, the third-largest group in the county (SCTA).
For a Windsor claim that means the proof usually has to come from the collision itself rather than from a published list of hazards, and the town’s road safety plan, once adopted, is the first document we would check if road design may have contributed.
Month 1 and later
| If the party at fault is | The clock | Authority |
|---|---|---|
| Town Hall, the SMART rail district, a county bus or Sonoma County road crews | Six months, with the claim presented in writing | Gov. Code §911.2 |
| A careless motorist, a downtown shop with a slick floor, an apartment owner | Two years before the right to sue lapses | CCP §335.1 |
Trains have stopped at the Windsor SMART station since May 31, 2025 (Wikipedia), so the six-month row now covers anyone hurt boarding, riding or crossing the tracks in town, as well as passengers on the public Sonoma County Transit buses.
Even a driver who shares some blame keeps a claim in California; a jury that finds you one-fifth responsible trims the award by that fifth (CACI 405). Windsor cases that cannot be settled go to the Sonoma County Superior Court (court locations), and since its posted locations do not say where unlimited civil matters are heard, the courtroom is something we pin down when the complaint is filed.
Fire evacuations and air-show weekends
On October 26, 2019, as the Kincade Fire spread, the Sheriff ordered all of Windsor, and all of Healdsburg, to evacuate, part of an order that moved about 50,000 people across the county that day (KQED; Lake County News). Collisions in evacuation traffic are judged by the ordinary rules of fault. Fire losses are a separate matter: where negligence sparked a blaze, families who lost homes or suffered burns or smoke injuries may hold claims against whoever was responsible, as described on our wildfire page.
Air-show weekends: Charles M. Schulz–Sonoma County Airport lies just south of town, and its air show, the North Bay’s largest, brings more than 25,000 visitors a year (Wikipedia). If an out-of-town driver hits you that weekend, the license, plate and insurance card you photograph at the scene may be the only way to find that driver again.

Windsor Police, SMART and freeway questions
Does the Sheriff’s contract change anything about my Windsor Police report?
Not in a way that affects your claim. Under the town’s contract, Sheriff’s personnel serve as Windsor Police, and their report is the official record of a crash on Windsor streets.
A truck hit me on the 101 just south of town. Who has that report?
The Highway Patrol’s Santa Rosa Area office, which works freeway collisions across most of Sonoma County, not the Windsor station.
I fell stepping off a SMART train at the Windsor platform. Is two years my deadline?
No. The rail district is a public entity, so a written claim has to reach SMART within half a year of the fall, well before any lawsuit.
Windsor ranks 80th for crashes. Does that hurt my claim’s value?
It should not. A favorable ranking for Windsor says nothing about how your collision happened or how badly you were hurt.
Nothing in this Windsor timeline is legal advice; it is a general guide to local agencies and state law.
