West Hollywood Personal Injury Attorney

Los Angeles County

Sixty injury crashes struck West Hollywood between 9 p.m. and 3 a.m. during 2023, the highest late-night total among the 93 California cities the state compares it with, and the first fact a West Hollywood personal injury attorney notices in the data. The city also ranked first for victims of drinking drivers aged 21 to 34, and second for both pedestrians and motorcyclists hurt or killed (OTS 2023). If you were hurt on Santa Monica Boulevard, the Sunset Strip or a side street in between, this page explains what those numbers mean for your claim and corrects the assumptions that most often cost injured people money. Seven myths about West Hollywood injury claims follow, each answered with state law and City Hall’s own crash study.

At a glance — West Hollywood

  • Patrolled under contract by the Sheriff’s West Hollywood Station
  • 4th of 93 comparable cities on the state’s combined crash score (2023)
  • 11 priority intersections named in the city’s Vision Zero plan
  • Free PickUp shuttle on Friday and Saturday nights

How West Hollywood’s numbers compare

With an estimated 34,231 people (Census 2025 estimate), WeHo scored 91 on Walk Score, at a density near 18,900 people per square mile in 2020 (Wikipedia). The Sunset Strip’s clubs, among them the Whisky a Go Go, the Roxy and the Viper Room, draw late-night crowds on top of that. The state’s 2023 rankings:

OTS measure, 2023West HollywoodRank of 93
Nighttime injury crashes, 9 p.m. to 3 a.m.601
Victims when a driver who had been drinking was 21 to 34311
Pedestrians killed or injured372
Motorcyclists killed or injured302
All people killed or injured3463
Hit-and-run injury crashes373
Alcohol-involved victims464
Speed-related injury crashes348
Bicyclists killed or injured1614

First place in this table is the worst place to be, and West Hollywood’s combined score, 4th of 93, puts it among the four most crash-burdened cities of its size. The Sheriff’s 84 DUI arrests are left out of the table on purpose, because the state sorts arrests in the opposite direction, so a 58th-place arrest figure describes policing activity, not road danger.

Inside the Target Vision Zero plan

The city council committed to eliminating traffic deaths in February 2021, and the plan meant to get there, Target Vision Zero, was approved on December 18, 2023 (City of West Hollywood). The plan’s review of state crash records for 2017 through 2021 found:

  • 3,140 reported collisions, including 78 with severe injuries and 4 that were fatal
  • 40% of the deadly and serious crashes involved someone walking, 24% a motorcyclist and 10% a bike or scooter rider, together 74%
  • 93% of those crashes happened at intersections

The plan names 11 priority locations, and Santa Monica Boulevard holds seven of them:

LocationPlace on the city’s list
Santa Monica Blvd and La Brea Ave1st
Sunset Blvd and Sherbourne Dr5th
N. Doheny Dr and Phyllis Ave9th
Robertson Blvd and Rangely Ave10th
Santa Monica Blvd at Crescent Heights, West Knoll, La Cienega, Robertson, N. Hayworth and OgdenAlso listed

A safety project at La Cienega Boulevard and Rosewood Avenue was listed as upcoming.

The city’s highest speed limit is 35 mph, on Santa Monica west of Holloway, Sunset, Fountain, Fairfax, Melrose, Crescent Heights and La Brea. A 2023 speed survey recommended lowering limits on Fairfax and parts of Fountain, and reductions were scheduled for a council vote on January 21, 2025.

Seven beliefs that do not hold up

“The Sheriff’s report settles fault”

The fact: West Hollywood has no city police force; its traffic investigations are done by the Los Angeles County Sheriff’s West Hollywood Station (Wikipedia). The report is important evidence, and it can contain mistakes.

A deputy who arrives after the fact on Santa Monica Boulevard may rely on the account of whoever was still standing, and an insurer, a judge or a jury can reach a different conclusion once hotel video and witnesses are in hand.

“Hit-and-run victims are out of luck”

The fact: Only two comparable cities exceeded West Hollywood’s 37 hit-and-run injury crashes in 2023. A pedestrian struck on La Cienega by a car that disappears can usually turn to the UM coverage on their own car insurance, or a relative’s in the same household, even though no car of theirs was involved.

Tip: Report a hit-and-run to the Sheriff’s Department promptly. The UM adjuster will want the West Hollywood Station’s incident number before paying.

“A drunk driver’s case takes care of itself”

The fact: Intoxication makes fault easier to prove, but it does nothing to raise the driver’s policy limits, and damages still have to be documented. California law also allows punitive damages where a defendant acted with malice, which courts have applied to some drunk-driving cases (Civil Code §3294). With 46 alcohol-involved victims in 2023, the fourth-highest count in the group, these claims are common here, and each still depends on records.

“Jaywalkers get nothing”

The fact: California uses pure comparative fault. Someone who stepped off the curb mid-block on Santa Monica Boulevard and is assigned part of the blame keeps the rest of the claim (CACI 405). That matters in a city where pedestrians made up 40% of fatal and severe-injury crashes in the city’s own study, and where the Walk Score is 91.

“Motorcyclists always get blamed”

The fact: California law permits lane splitting (Vehicle Code §21658.1), so an insurer cannot treat it as automatic fault.

Thirty motorcyclists were killed or injured in West Hollywood in 2023, second-highest in the group, and riders made up 24% of serious crashes in the city’s study. A rider cut off by a turning car on Sunset faces specific insurer arguments, which our motorcycle accident page takes up.

“City Hall is off the hook”

The fact: A public entity can be liable when a dangerous condition of its property contributes to an injury. West Hollywood’s own Vision Zero plan ranks intersections by risk, and such a ranking can become evidence that a hazard was known. The catch is timing: West Hollywood must receive a written claim within six months (Government Code 911.2), long before most injured people have finished treatment.

“An Uber crash is just a car crash”

The fact: A rideshare car pulling up outside the Roxy or the Viper Room may fall under any of three layers of insurance:

  • only the driver’s own coverage, when the app was closed
  • the company’s lower-limit coverage, if the app was open but no ride had been accepted
  • the company’s larger policy, once a trip was accepted or a passenger was aboard

Sorting out which applied at that minute is often the first legal question; our rideshare accident page explains the tiers.

West Hollywood questions

I was hurt on Halloween or during Pride. Does the crowd change my claim?

The basic rules are the same, but large events such as the October 31 Halloween Carnaval and WeHo Pride can bring street closures and temporary barriers. When a barricade on Santa Monica Boulevard or a closed lane on Sunset helped cause the injury, the question of who set it up decides whether a government claim is needed.

Does the PickUp shuttle count as public transit if I was hurt on it?

The city has run the free PickUp shuttle on Friday and Saturday nights since 2013 (Wikipedia). Injuries involving a city-operated or city-contracted vehicle can involve a government claim, so treat the six-month deadline as applying until a lawyer confirms otherwise.

Why didn’t the Highway Patrol come to my crash?

West Hollywood has no state freeway inside its borders, and the collisions on its boulevards are generally handled by Sheriff’s deputies from the city’s contract station.

The driver was cutting through from Laurel Canyon. Is that relevant?

It can. Laurel Canyon Boulevard is a popular cut-through, and a driver unfamiliar with the city’s dense intersections may be speeding or distracted. Phone records and navigation data can sometimes show what the driver was doing.

Early steps after a Strip collision

Watch out: Video from businesses on the Strip and along Santa Monica Boulevard is often overwritten within days. A written preservation request sent quickly is the best way to keep it.

  1. Let paramedics or an emergency doctor examine you that night; for major trauma, the state’s EMSA designations include Cedars-Sinai Medical Center at Level I.
  2. Photograph or save the incident number the West Hollywood Station deputy gives you, because the report request depends on it.
  3. Photograph the intersection, signals and crosswalk markings, and note the bars, hotels and shops nearby, since many have cameras.
  4. If you left a club or restaurant shortly before the crash, write down where you were and when; receipts and rideshare records can confirm a timeline.
  5. When the at-fault driver’s insurer phones, decline to be recorded until you have legal advice.

Two years, six months and a district rule

Who you are pursuing after a WeHo crashHow long the law generally allows
The City of West Hollywood, the County, or the PickUp shuttle’s operatorSix months, under the government claims statute
The motorist from a Fountain or Melrose collisionFile in court by the two-year mark (CCP 335.1)

Damage to a car or motorcycle alone has three years, and a child’s injury claim runs on a different clock, so have a lawyer confirm any deadline that matters to you.

The courthouse for a West Hollywood lawsuit should be confirmed, not guessed. Under a 2024 general order of the Los Angeles Superior Court, the incident’s location generally picks the judicial district (LASC General Order); the Strip, the Norma Triangle and the east side each get checked against the court’s locator.

Our firm’s work in West Hollywood

Call Jacob represents residents, workers and visitors injured in West Hollywood, from the Norma Triangle and West Hollywood West to the hotels and clubs of the Sunset Strip. When we handle a West Hollywood case, we request the West Hollywood Station’s report, send preservation letters to businesses facing the intersection, and check whether the location appears among the 11 priority sites in the city’s Vision Zero plan.

Because the city’s data is dominated by people on foot and on motorcycles, much of our work here involves pedestrian accidents, motorcycle crashes and late-night collisions with drunk or fleeing drivers. Our West Hollywood files also include car accidents, bicycle and e-scooter injuries, rideshare passengers, people hurt in falls at bars and restaurants on Santa Monica Boulevard, dog bites and wrongful death. If you need a West Hollywood car accident attorney after a crash on Fountain or La Brea, the same steps apply.

We represent nightlife workers, residents and visitors hurt in West Hollywood, and each starts with a free consultation; once we are hired, you pay nothing unless we win. Reach the firm at (888) 952-2952, or send the details through the case evaluator, and we will come to your apartment in West Hollywood North, your workplace or your hospital room.
