Wasco Personal Injury Attorney

Kern County

Wasco grew up where State Route 43 crosses State Route 46, and those two highways still carry most of the town’s serious traffic. When the city studied five years of collisions for its Local Road Safety Plan, most of the locations near the top of its list sat on one of them. If you were hurt here and are looking for a Wasco personal injury attorney, this page lists the offices that will hold your records, the corridors the city has already flagged, and the deadlines that apply.

Which agency writes up the collision

Among the stakeholders who helped prepare Wasco’s 2022 safety plan was the Sheriff’s Wasco Substation, which is the law enforcement presence the plan identifies for the town (Wasco LRSP). A collision on 7th Street, F Street or Central Avenue is the kind of crash a deputy from that substation would write up.

SR-43 and SR-46 are handled differently. The CHP’s Buttonwillow Area lists SR-43 and SR-46 within its western Kern territory, though its page never mentions Wasco itself (CHP). So a broadside where the highways meet, or a rear-end on the Paso Robles Highway, may produce a CHP report instead of a Sheriff’s report. Before you leave the scene, write down which agency’s officer you spoke with. Weeks later, that single detail decides which office you ask for the report.

Corridors the city has already flagged

From 2015 through 2019, Wasco recorded 765 collisions inside city limits, a count that includes SR-43 and SR-46. About 81% damaged only property. The rest are the cases that come to a law office: 100 crashes with a complaint of pain, 31 with a visible injury, and 14 in which someone was killed or seriously hurt, 5 of them fatal (Wasco LRSP).

57%: the share of Wasco’s killed-or-seriously-injured crashes, 2015 to 2019, in which a vehicle struck someone walking. Rear-ends, the next most common type, were 14%.

LocationFinding in the plan
SR-46 (Paso Robles Hwy), Magnolia to GriffithHighest corridor score in town: 8 collisions, 6 rear-ends, 4 after dark
F Street at 7th StreetHighest intersection score: two of its three collisions killed or badly hurt someone, one of them walking
SR-46 at Palm, Central and E StreetNext three spots on the intersection list
SR-46 at SR-4310 collisions, 8 broadsides, more than any other listed intersection
SR-43 at Kimberlina Road7 collisions, 3 after dark
SR-43 at Prospect and at FilburnBoth on the high-injury intersection list
7th Street, Western to G; Palm Avenue north of SR-46Corridors with one fatal or severe crash each

Public comment: When the city asked residents for input, the Magnolia-to-Griffith stretch of SR-46 drew more comments than any other road, and speeding was the complaint heard most often.

Rear-ends along SR-46, half of that corridor’s collisions after dark, usually turn on following distance, braking and lighting, and the vehicles’ own data can matter. The eight broadsides where SR-43 meets SR-46 point instead to a driver entering at the wrong moment, so signal phase, sight lines and anyone who watched it happen become the evidence. If you believe the layout of that junction, rather than only a careless driver, helped cause your crash, remember that Caltrans and the State, not the City of Wasco, answer for a state highway.

Pedestrians and the fault question

The plan’s most common violation in serious crashes was a pedestrian violation, at 21%, ahead of DUI, unsafe speed and improper turning at 14% apiece. Families sometimes read that number and assume a claim is hopeless. It is not. The violation code is an officer’s judgment about the main cause, written at the scene. A Kern County jury can divide blame between a driver and the person he hit, and an injured walker keeps whatever portion of the damages the jury puts on the driver (CACI 405). A driver who was speeding toward F Street and 7th Street, or impaired, cannot shift the whole loss onto the person walking. How crosswalk rules and a driver’s duty to watch for people on foot fit together is covered on our pedestrian accident page.

Two children hurt in Wasco in 2023 were pedestrians under 15. Can a child be blamed?

Not by the adult standard. Courts judge a child by what is reasonable for a child of that age and experience, and a minor’s deadline to sue is extended. Those two young pedestrians were enough to put Wasco 12th of 93 on that OTS measure (1 is worst) (OTS).

My relative was hit crossing SR-46. Is that a case against the State?

Usually the claim is against the motorist, paid through his liability policy. The State becomes a second defendant only when something about the highway, such as lighting or crossing design, made it unreasonably dangerous, and that claim has a six-month presentation deadline (Gov. Code §911.2).

Young drinking drivers and fleeing motorists

On the broadest OTS measure Wasco looks ordinary: 43 people killed or injured in 2023 left it 67th, in the safer half of its group. Three narrower lines tell a different story:

  • Drinking drivers 21–34: 10 victims, 7th
  • Hit-and-run injury crashes: 9, 16th
  • Alcohol-involved victims: 12, 28th

A young drinking driver may have been served at a bar or a party, and the facts of that evening deserve a look, although California limits when a server can be held responsible. A driver who flees leaves you with your own uninsured motorist coverage, which is why the Sheriff or CHP report should be made the same day and the insurer notified promptly.

Treatment in Bakersfield

Someone pulled from a broadside at the SR-43 junction will not find a trauma center in Wasco. A badly injured rider or driver from the Paso Robles Highway may well be taken to Bakersfield; Kern Medical is the sole Kern County entry for adult Level II trauma on the state’s August 2025 roster (EMSA). The emergency notes, scans and operative reports from that admission become the medical spine of the case, so request Kern Medical’s full chart and the ambulance company’s run report rather than a discharge summary.

What to have ready for a lawyer

  • The officer’s card, so we know whether the Sheriff or the CHP has the report
  • Whether the crash was at F and 7th, the SR-43 junction or another listed spot
  • Kern Medical papers and the name of the ambulance service that carried you
  • Your own insurance card and declarations, for the UM and UIM numbers
  • Missed shifts in the fields, the oil patch or the prison, with pay stubs

Two years, six months and $35,000

Suing the motorist, a grower whose truck was involved or a store on 7th Street is governed by the two-year statute of limitations (CCP §335.1). A claim that SR-43, SR-46 or a city street was itself unsafe runs on a much shorter clock: six months to present a written claim to the State or to the City of Wasco. Property damage to a pickup carries a three-year limit, which tempts some people to wait; the bodily injury side of the same crash cannot.

Kern’s court posts a simple dividing line on its civil page: above $35,000 in damages, the complaint belongs at the Metropolitan Justice Building, and that is where a serious Wasco injury case is generally filed (Kern Superior Court). The court’s location list also includes Shafter and Delano for other civil matters.

Do I have to travel to Bakersfield for my case?

Not often. Most of a case happens by phone, mail and records requests, and many claims resolve with the insurer before any lawsuit is filed. If a lawsuit is needed, hearings and any trial would be at the Truxtun Avenue courthouse, and your lawyer attends most of them without you.

Does my own policy cover a hit-and-run on Palm Avenue?

When the other driver is never identified, the uninsured motorist portion of your own auto policy is usually what pays, and that is no rare situation in a town that logged nine injury hit-and-runs in a single year. Report yours to the Sheriff or CHP the same day, keep any photos of the other car, and tell your own insurer in writing.

A truck hit me near the SR-43 junction while I was working. Is that workers’ comp?

It can be both. Workers’ compensation covers medical care and part of your wages regardless of fault, while a separate claim against the truck driver and the company that employs him can recover the losses comp does not pay, such as pain and suffering.

Farmworkers, prison staff and other Wasco clients

About 26,525 people lived in Wasco in 2025, by the Census Bureau’s estimate (Census), and the safety plan found that 85.6% of working residents drive to their jobs alone. Those jobs are spread out: rose growing (in 2007 about 55% of U.S.-grown roses came from in or around Wasco), oil fields along SR-46 to the west, and Wasco State Prison (Wikipedia).

Call Jacob represents residents, farmworkers, prison employees and through travelers injured on SR-43, SR-46 and Wasco’s own streets. Our first two tasks on a Wasco case are practical ones: identify whether the substation or the Buttonwillow CHP office has the report, and see where the location falls on the plan’s high-injury list. If the case involves a state highway, we prepare the six-month claim against the State well before the deadline.

Since people on foot account for more than half of the town’s worst crashes, pedestrian claims head the list of Wasco matters we handle. We also take SR-46 rear-ends and car and auto accident broadsides at the SR-43 junction, big-rig and farm-vehicle collisions, motorcycle and bicycle crashes, store falls, dog bites and wrongful death claims.

There is no fee to have a Wasco car accident lawyer review what happened on Palm Avenue or SR-46. Our fee is contingent. If you are still admitted at Kern Medical, we can meet you there or at your home once you are discharged. Call (888) 952-2952 or try the evaluator. En español: calljacob.com/es.
