In 2023 the state compared 62 mid-size California cities on speed-related crashes, and only one did worse than San Buenaventura. The city ranked second-worst for speed, fourth-worst for total people killed or injured (657) and fifth-worst for injured bicyclists (OTS). Few residents would expect those numbers in a beach city of 108,061 (CA Dept. of Finance), and that gap between perception and reality is where claim myths start. What drivers often assume

• “Ventura police will have my freeway crash report.” Not for US 101, SR 33 or SR 126. CHP officers based at 4656 Valentine Road take those reports, and their territory is very large: about 175 miles of freeway and 542 miles of county road across 1,843 square miles (CHP). Crashes on Main Street, Telegraph Road or Thompson Boulevard are handled by the Ventura Police Department, so confirm which agency responded before you request a report.
• “A rear-end crash is so clear that the insurer will simply pay.” Fault may be obvious, but the value of the injury is not. The adjuster will question whether your neck or back pain came from the crash, whether you waited too long to get treatment and whether your medical history explains the symptoms. Treatment records that begin in the first few days answer those questions.
• “The other driver’s policy limit is the most I can recover.” Since January 2025, a California driver may legally carry as little as $30,000 per injured person (Vehicle Code §16056), roughly the cost of a short trauma admission at the county hospital on Hillmont Avenue. The underinsured motorist coverage on your own auto policy can add to that amount, so review your policy before you sign any release.

The CHP describes US 101 as a critical corridor for commuters and commercial traffic between Northern and Southern California. One location on it appears in the city’s pedestrian data: the northbound ramps at Victoria Avenue had two pedestrian collisions from 2015 to 2019, one of them fatal (Ventura ATP).

What cyclists are often told

The city’s Active Transportation Plan counted 267 collisions involving bicycles from 2015 through 2019, in which two cyclists were killed, one a young person and one a senior. Those crashes were concentrated Downtown and along Telegraph Road, Telephone Road, Victoria Avenue and East Main Street (Ventura ATP). South Victoria Avenue at Thille Street and at Telegraph Road each had four bicycle collisions in that period, as did South Mills Road at East Main Street.

• “I wasn’t wearing a helmet, so I have no claim.” The helmet requirement in §21212 stops at a rider’s eighteenth birthday (California Legislative Information). An adult riding a standard bicycle along the Promenade without a helmet breaks no law. An insurer may still argue that a helmet would have reduced a head injury, but it cannot argue that the lack of one caused the crash.
• “The driver who opened the door didn’t hit me; I hit the door.” Vehicle Code §22517 prohibits opening a car door into traffic unless it is reasonably safe to do so (California Legislative Information). A dooring on East Main Street is the responsibility of the person who opened the door, and that person’s auto policy generally covers it.
• “There’s a bike lane, so the city must be responsible.” A painted lane on Telegraph Road is not a guarantee of safety. To hold City Hall responsible, you would have to show that something physical on Telegraph, such as broken asphalt, a faulty signal or a poorly designed merge, helped bring you down, and your written claim must reach the city clerk within six months (Gov. Code §911.2).

What pedestrians and their families assume

Pedestrian crashes in Ventura are concentrated in the western part of the city: the Westside, Downtown and Midtown. From 2015 through 2019 there were 227 collisions involving pedestrians, including 11 deaths and 32 collisions with severe injuries, and 73% happened at intersections (Ventura ATP).

• “I was crossing outside a crosswalk, so the crash was my fault.” A pedestrian outside a crosswalk must yield to vehicles, but Vehicle Code §21954 still requires every driver to use due care for pedestrians on the road (California Legislative Information). Fault is shared; it does not fall entirely on the person walking.
• “My mother is 78, so they will say she should have been more careful.” Ventura ranked ninth-worst of 62 cities for pedestrians 65 and older in 2023. Age is not negligence. A driver who turns into a crosswalk without looking is responsible, however slowly the person in it was walking.

What parents assume about children on bikes

Thirteen bicyclists under 15 were killed or injured in Ventura in 2023, the third-worst figure in the group. That is one reason the city’s plan includes Safe Routes to School action plans (City of Ventura).

• “A child who darted out is automatically at fault.” Jurors are instructed to judge a child by the standard of other children of similar age and maturity, not by the standard of a licensed adult. A fifth-grader riding out of a Midtown driveway is held to a fifth-grader’s standard, while the driver on that street is held to a driver’s.
• “We’ll deal with it when he turns 18.” Under CCP §352, a child’s own case against a motorist can usually wait for adulthood. Everything else keeps moving: the six-month claim against a school district or the city, the doorbell camera that records over itself within a week, and the classmate who saw the crash and later moves away.

From the Valentine Road report to Hillmont Avenue

Trains, the fair and the Thomas Fire

I was hurt on a Metrolink or Amtrak train at the station. Who is responsible?

Ventura is the western end of Metrolink’s Ventura County Line at the Ventura–East station in Montalvo, and Amtrak’s Pacific Surfliner stops downtown (Wikipedia). Metrolink is operated by a regional joint powers authority, so an injury on board or on its platform is a claim against a public entity and is subject to the six-month notice rule. Amtrak, a federally chartered corporation, handles claims under its own procedures.

My crash happened during the County Fair. Does that change anything?

The Ventura County Fairgrounds, beside the beach and the Amtrak station, hosts the annual fair and large events such as X Games California 2023. Large crowds mean more witnesses and more cameras, so collect names quickly.

Does wildfire smoke or damage affect road claims here?

Is a case here handled differently than one in Los Angeles?

The law is the same statewide, so nothing changes at the county line. The practical details do: one Hall of Justice instead of a dozen district courthouses, one county trauma hospital on Hillmont Avenue, and a CHP office whose territory runs from the Rincon to the Conejo Grade. Knowing those details shortens the path to the records.

Why does the intersection data stop in 2019?

The city’s most detailed public breakdown of crashes by intersection is the Active Transportation Plan’s 2021 existing-conditions report, which analyzed SWITRS data from January 2015 through December 2019. It also cited an earlier state comparison: in 2018 Ventura ranked 11th of 59 comparable cities for pedestrian collisions, at 4.11 per 10,000 residents (Ventura ATP). The newer OTS rankings at the top of this page extend the picture through 2023.
