Upland Personal Injury Attorney
San Bernardino County

In 2023, officers linked 94 Upland crashes that injured or killed someone to excessive speed. Only four of the 103 comparable cities in the state’s Group C recorded more, and Upland also ranked fifth for the total number of people injured, 577 (OTS). For a city of 79,446 (Census), that is a heavy toll, and speed affects everything that follows: harder impacts, longer hospital stays and more disputes about who was going how fast. The plan below covers the first 72 hours after a crash on Upland roads and the decisions an Upland personal injury attorney would want made correctly from the start.
- The first ten minutes on Foothill or Euclid
- Which agency responds
- Where the ambulance may go
- Saving the car, the video and the pay stubs
- Day 30 and the three clocks
The first ten minutes on Foothill or Euclid
Foothill Boulevard carries State Route 66, the former U.S. Route 66, and Euclid Avenue carries State Route 83 south toward Ontario and Chino. The two meet in the center of town at the Madonna of the Trail statue (Wikipedia). A crash on either road leaves fast through traffic moving past the scene, so the first ten minutes are about safety and a few quick records:
- If the car can be driven, move it out of the travel lanes; if it cannot, turn on the hazard lights and keep your seat belt on.
- When you call 911, name the cross street; Foothill and Euclid each run for miles, and “on Foothill” alone does not tell a dispatcher much.
- Photograph where the vehicles came to rest, any gouges in the pavement, the debris and the posted speed limit sign nearest the crash.
- Note any business with a camera facing the road, from gas stations to banks.
Which agency responds
| If the collision was on… | The responding agency is… | What that means afterward |
|---|---|---|
| Foothill, Euclid or a neighborhood street | Upland Police Department | City officers write the collision report and collect witness names |
| The 210 across the north end or the 10 along the Ontario line | CHP Rancho Cucamonga Area, 9530 Pittsburgh Avenue | Highway Patrol diagrams, often with commercial-vehicle details |
| The switchbacks climbing toward the ski area above town | Also the Highway Patrol | The same CHP office patrols the foothill areas outside city limits (CHP) |
A claim based on a road defect adds another party. Because Foothill and Euclid are state routes, one early task is to confirm whether the city or Caltrans maintains the exact stretch where you crashed. Whichever of the two owns that pavement is the agency your claim must be addressed to, generally within six months (Government Code §911.2).
I was riding my motorcycle down from Mount Baldy. Who takes the report?
Highway Patrol officers from the Pittsburgh Avenue office, because the canyon road above San Antonio Heights is outside city limits. Within city limits, OTS counted 26 injured riders in 2023, an 18th-of-103 placement. A descent from Mount Baldy, whose summit is roughly 9.5 miles north of town (CHP), raises questions about brake fade, gravel and blind curves, which our motorcycle accident page discusses.
Where the ambulance may go
San Antonio Regional Hospital is Upland’s hospital and one of its largest employers, with roughly 2,000 staff (Wikipedia). Under the state’s trauma list, the most critically injured Upland patients may be taken in either of two directions: a few minutes west, across the county line, to Pomona Valley Hospital Medical Center (Level II), or east along the 10 to Arrowhead Regional in Colton or the university hospital in Loma Linda, both Level I (EMSA).
That choice affects the paperwork. A hospital in Pomona, Colton or Loma Linda keeps its records in its own system, and bills arrive from separate physician groups. Pomona Valley is also in a different county, so its billing office, its ambulance provider and any follow-up clinic may all have Los Angeles County addresses, while your police report comes from San Bernardino County. Keep a running list of every facility and provider from the first night, because each may later assert a medical lien against any settlement.
Tip: High-speed crashes often cause injuries that do not appear for a day, including internal bleeding and concussions. If you were released from the emergency room and feel worse the next morning, go back and say so. A second visit is evidence, not a sign of weakness.
The other driver says I was speeding on Foothill. What now?
Do not debate it with the adjuster. Speed is measured, not guessed: event data recorders, video time stamps and the depth of crush damage all bear on it. Suppose a jury finds you were going 50 in the 40 mph zone on Foothill. Those ten extra miles an hour would trim the award by whatever percentage the jury assigns to them; they would not erase the claim (CACI 405).
I think the other driver had been drinking. How common is that here?
Common enough to place Upland near the top of the state’s tables (OTS). The state counted 65 Upland victims of alcohol-involved crashes, 12th of 103. More than half of them, 34, were hurt by drinking drivers aged 21 to 34 (8th), and another 7 by drinkers under 21 (10th). Between 9 p.m. and 3 a.m., the city had 55 injury crashes, the ninth-highest total in its group. A drunk-driving arrest supports your claim and, in serious cases, a request for punitive damages.
Saving the car, the video and the pay stubs
- Ask each business along the route to keep its camera footage, and write down whom you spoke with
- Keep the car from being scrapped until its event data recorder has been downloaded
- Write the Upland PD or CHP case number on the back of the tow receipt
- Photograph bruising and seat-belt marks each day
- Report the crash to your own carrier, and ask whether your policy includes med-pay and UM benefits
- If you commute on the San Bernardino Line from Upland’s Metrolink station (Wikipedia) and missed work, keep the pay stubs that show your lost wages
Two categories were comparatively low in 2023: 22 hit-and-run crashes (50th) and 15 injured pedestrians (69th of 103). The dominant pattern is vehicles colliding at speed, which is why the car itself is often the best witness. Our car accident page explains what an event data download can show.
Can an Upland car accident lawyer take over the adjuster’s calls this week?
Yes. When a fracture or head injury is involved, having a lawyer handle those calls avoids a recorded interview you may later regret. Nothing in California law requires you to give the at-fault driver’s insurer a recorded account of a Euclid Avenue collision.
The freeways at the edges of town
The 210 Foothill Freeway crosses Upland’s northern neighborhoods, and Interstate 10 runs along the boundary with Ontario (Wikipedia). Officers from Pittsburgh Avenue, not Upland PD, write those reports. OTS’s city rankings count crashes on surface streets, so freeway collisions are not included, and the number of people injured within Upland’s borders is therefore higher than 577.
Air traffic adds a smaller consideration. Cable Airport, described as the world’s largest family-owned public-use general aviation airport, is in the city, and Ontario International Airport is next door (Wikipedia). An Uber, Lyft or shuttle trip to Ontario along Euclid can bring a commercial policy into the claim, typically with more coverage than the driver’s personal insurance.
Day 30 and the three clocks
A month after the crash, the claim begins to take shape: medical bills, lost wages and a sense of how long recovery will take. Three deadlines continue to run in the background:
| Deadline | Status at day 30 | Rule |
|---|---|---|
| Form SR-1, due within ten days | Should already have been mailed; confirm that yours was sent | DMV |
| Six-month government claim | About one-sixth of the time has passed, if Caltrans or the city shares blame for a faded lane line or a failed signal | Government Code §911.2 |
| Two-year lawsuit deadline | Ample time remains to sue a speeding driver, but evidence does not wait | CCP §335.1 |
West Valley cases such as Upland’s generally go to the Rancho Cucamonga District courthouse at 8303 Haven Avenue (San Bernardino Superior Court), and we verify that assignment when the complaint is prepared.
Handing the rest to Call Jacob
The Law Offices of Jacob Emrani (Call Jacob) takes over wherever the plan above runs short of time or energy. As your auto accident attorney in Upland, we request the Upland PD or CHP report, send preservation letters to businesses on Foothill or Euclid, gather records from San Antonio Regional, Pomona Valley or the Level I centers, and handle all contact with the insurance adjuster. Reviewing a Foothill or Euclid collision with us costs nothing, and under our contingency agreement you pay nothing unless we win. When a client cannot travel, a member of our staff will come to a home near the Metrolink station or in the foothills. Our number is (888) 952-2952. A patient still at San Antonio Regional may find it easier to type the details into our case evaluator, and Spanish-speaking families can turn to calljacob.com/es.
We represent Upland drivers injured in speed-related crashes on Foothill Boulevard and Euclid Avenue, motorcyclists hurt coming down from Mount Baldy, and cyclists and pedestrians struck near the Metrolink station. We also handle truck collisions on the 10 and the 210, rideshare crashes involving Ontario International Airport traffic, and wrongful death claims when a family loses someone on those roads. What we bring to an Upland case is knowledge of the local details: which stretch of a state route the city or Caltrans maintains, which crashes are handled by the Pittsburgh Avenue CHP office, and which records office in Pomona or Loma Linda holds the chart.
