Union City Personal Injury Attorney
Alameda County
In 2023, pedestrians accounted for 27 of the 124 people the state counted as killed or injured in Union City traffic, more than one in five. That pedestrian figure, up from 15 a year earlier, placed Union City 14th of 103 comparable California cities, even though its overall casualty total ranked 90th (OTS 2023). Because walking is where the risk concentrates here, this page traces a single pedestrian claim through each Union City office, hospital and courtroom it would touch, and shows where a Union City personal injury attorney steps in along the way.
Hypothetical example: On a weekday morning, a 66-year-old retiree walking to the Union City BART station is hit by a turning SUV in the marked crosswalk on Decoto Road. Her hip is fractured. She, the SUV and the morning are invented for illustration; every street, agency, statistic and deadline below is real.
From that crosswalk, her case moves along this path:
- On Decoto Road, the first hour
- Washington Hospital and the weeks of recovery
- Gathering proof, including the City’s own crash counts
- The insurance company’s first call
- A six-month claim, if the crosswalk or signal was part of the cause
- Resolution, by agreement or in the Hayward courthouse
On Decoto Road
Union City Police officers come to the crosswalk. Their report will record the SUV driver’s version, the markings, the lighting, the signal if anyone saw it, and the names of people waiting at the bus stop. Freeway ramps are a different jurisdiction: on I-880 or SR-84, the report would come from the Highway Patrol’s Hayward Area, based at 2434 Whipple Road (CHP Area 345).
The location in the example is deliberate. A 2022 presentation on the city’s Local Roadway Safety Plan pointed to a pedestrian-collision cluster on Decoto near the BART station (LRSP presentation). In real life, on October 29, 2025, a 55-year-old man crossing Decoto Road at Royal Ann Drive was struck and killed at 6:26 a.m.; it was Union City’s fourth deadly crash of the year (CBS News Bay Area).
Tip: Family members who arrive later can ask the officer for a business card; the case number printed on it is what Union City Police records staff need when the finished report is requested.
Washington Hospital and the weeks of recovery
In the example: Surgeons repair the hip the next day. After several nights on the orthopedic floor she goes home to a walker and a therapy schedule.
Washington Hospital in Fremont, where the paramedics bring her, appears on the state’s trauma list at Level II for adults. Paramedics heading north instead would have brought her to Castro Valley’s Eden Medical Center, also Level II (EMSA).
For an older adult, a broken hip typically follows exactly that sequence. The operative report, the physical therapy notes and the itemized bills will each become exhibits in her claim. Medicare, or any health plan that pays those bills, can later assert a lien against her settlement, so her lawyer tracks every payment from the start rather than discovering the lien at the end.
Her age is not incidental: five of Union City’s 2023 pedestrian victims were 65 or older, a count that put the city 16th of 103.
Gathering proof, including the City’s own crash counts
Most of the evidence in a crosswalk case either gets preserved or disappears within the first fortnight. Her lawyer photographs the crosswalk paint and signal heads, contacts the people from the bus stop, and asks every nearby camera owner to save the morning’s video. Union City Transit has operated its own buses since 1974, and AC Transit and the Dumbarton Express run through the city as well (Union City). A bus pulling away from the stop might have recorded the turn, and transit footage is kept only for a limited period.
Then there are the City’s own numbers. The 2022 presentation listed these as the corridors with the most collisions from 2017 through 2022:
| Corridor | Count | KSI |
|---|---|---|
| Alvarado-Niles | 260 | 7 |
| Whipple | 129 | 5 |
| Decoto | 124 | 5 |
| Mission (SR-238) | 117 | — |
| Dyer | 111 | — |
| Union City Blvd | 106 | — |
The KSI column is the subset of those collisions that ended in a death or a serious injury. These counts come from the planning-stage slides; the City adopted its final plan in August 2023. The slides also ranked Alvarado-Niles at Decoto as the city’s top intersection and flagged a second pedestrian cluster around James Logan High School. For those hot spots the adopted plan recommends leading pedestrian intervals, upgraded crosswalks and a pedestrian hybrid beacon (LRSP, 2023).
Recent deaths line up with that list. A pedestrian was killed at Alvarado-Niles Road and Almaden Boulevard in February 2025, and in July 2026 a pedestrian struck at Whipple Road and Central Avenue died at the hospital (Union City PD; Nixle).
The SUV owner’s insurance company
In the example: An adjuster from the SUV owner’s carrier phones her daughter and asks to record the retiree’s account while she is still on pain medication. The family declines and gives the adjuster the attorney’s number.
Liability is the simpler half: a driver turning through a marked crosswalk must yield to the person in it. Damages take longer to measure. They include the surgery and therapy bills, any income she lost, her pain and suffering, and the independence she gave up while she could not drive or climb stairs. If the SUV carried only California’s minimum limits, the underinsured motorist coverage on her own household auto policy can add to what she recovers, and that coverage usually protects a policyholder hurt on foot.
When the street itself is to blame
In the example: Her lawyer’s photographs show crosswalk paint worn nearly away at the corner where she was hit.
When paint has worn away, or a parked truck routinely blocks a turning driver’s view, the public owner of the street may share responsibility, and the law allows six months from the injury to deliver a written claim to that agency (Gov. Code §911.2). In Union City, which agency depends on the street:
- Decoto, Alvarado-Niles, Whipple, Dyer and most neighborhood streets: the City of Union City
- Mission Boulevard (SR-238): Caltrans
- the BART station grounds, a Union City Transit bus or an AC Transit coach: that transit operator
A corridor’s place near the top of the City’s collision list will not, on its own, prove negligence. It does help show the City was on notice of where crashes were piling up, a point that carries weight in a dangerous-condition case.
Resolution, by agreement or in the Hayward courthouse
In the example: She finishes rehabilitation about a year after the crash. Only then can her lawyer put a full value on the claim.
Only at that point does bargaining with the SUV’s insurer begin in earnest. Without a fair offer, her lawyer has until the second anniversary of that morning, two years, to file a lawsuit against the SUV’s driver (CCP §335.1).
A Union City lawsuit would generally go to the Hayward Hall of Justice on Amador Street. The court consolidated southern-county civil filing there in 2011, when it closed the Fremont civil clerk’s office (Alameda Superior Court). If the SUV’s insurer argues that she stepped off the curb too quickly, a jury can assign her a share of fault, and her award shrinks by that share; it is not eliminated.
Where our firm comes in
The Law Offices of Jacob Emrani represents people hurt on Union City streets: pedestrians on Decoto and Alvarado-Niles, riders on Union City Transit and AC Transit, cyclists, and drivers caught in collisions on Whipple Road and Mission Boulevard. In a Union City case like the one above, we handle each step described on this page:
- ordering the collision report from Union City Police or the CHP Hayward Area
- sending preservation letters to Union City Transit, AC Transit or BART
- assembling the Washington Hospital or Eden Medical Center records and tracking any lien
- presenting a claim to the City, Caltrans or BART before the six months run out
- negotiating with the insurer, and filing in Hayward if negotiation fails
Clients come to us after pedestrian accidents, car and auto accident claims, hit-and-run crashes, bus accidents, bicycle and motorcycle collisions, falls on poorly maintained property, and the loss of a family member. Clients who cannot travel are visited where they are, at Washington Hospital, at Eden or at home.
We do not charge for a first conversation with a Union City car accident attorney, and we are paid only if your claim produces a recovery. Call (888) 952-2952, or start the online case evaluation with the street and date of your crash (en español).
Questions
My mother was hit crossing Alvarado-Niles Road near Logan High. Was this a known problem spot?
The 2022 safety plan presentation flagged a pedestrian-collision cluster near James Logan High School and placed the Alvarado-Niles and Decoto intersection first on its intersection list.
How long until my claim is resolved?
Expect months, and often more than a year. The schedule is driven by medical recovery, because the claim cannot be valued honestly until doctors can describe the lasting effects.
A driver hit me on Dyer Street and kept going. Is there anyone to pay?
There can be. Union City logged 15 hit-and-run injury crashes in 2023, compared with 11 in 2022, and when the driver is never found, the injured person’s own uninsured motorist coverage is often what pays, provided the police were told promptly.
My crash happened at one of the railroad crossings. Who is responsible?
That turns on whether a motorist, the railroad or the crossing gates and signals were at fault. Freight and Amtrak trains cross streets on both the east and west sides of Union City, and railroad evidence has to be requested quickly.
Will I have to testify at the Hall of Justice?
Probably not. Testimony in Hayward happens only if a case goes all the way to trial, and the great majority of injury claims end before that.
The Decoto Road retiree is fictional, and the rest of this page is a general guide rather than legal advice for your situation.
