Tustin Personal Injury Attorney

Just northwest of Tustin’s city limits, the I-5, SR-22 and SR-57 meet at the interchange Orange County drivers call the Orange Crush. By the Highway Patrol’s count, roughly 540,000 vehicles move through it daily (CHP Santa Ana). Between the overflow from that interchange and the I-5 and SR-55 running through town, a single Tustin collision can leave records with a police department, a CHP office, an adult or pediatric trauma program and the county court. Below is each of those offices, with a note on what a Tustin personal injury attorney asks it for.

Where Tustin falls among 103 similar cities

The state’s traffic-safety office measures Tustin against 102 peer cities, numbering the worst performer 1 (OTS 2023).

CategoryCountRank of 103
Pedestrians3125
Cyclists under 15523
All casualties31750
Night crashes2850
Hit-and-run2056
Speed-related3468
Motorcyclists1177
DUI arrests12150
Alcohol-involved casualties2958

Freeway speed is not what sets Tustin apart; the two highest-ranked rows involve people outside cars. Thirty-one pedestrians and five children on bicycles point to school routes and busy retail driveways, which tells an investigator where to look first for witnesses and video.

For scale, 77,843 people lived in Tustin as of the Census Bureau’s July 2025 estimate (Census), while OTS estimated 835,310 vehicle miles driven on Tustin roads each day, a measure of how much traffic passes through the city.

On alcohol, Tustin sits in the safer half of its group, ranking 58th for its 29 alcohol-involved casualties and 57th for the 12 people hurt by drinkers aged 21 to 34. The city’s 121 DUI arrests placed it exactly in the middle of the group. In the cases where alcohol does play a part, we gather the police arrest report, the blood test and any bar receipts for the civil claim, which can succeed whether or not the criminal case ends in a conviction.

Area 675 works out of 2031 E. Santa Clara Ave. in Santa Ana and patrols the I-5, I-405, SR-55, SR-22 and SR-91. That list explains a common confusion: a crash on a Tustin off-ramp may be a city case or a CHP case depending on exactly where the vehicles came to rest. Check the agency name printed next to the report number before you request a copy.

UCI and CHOC

Two Level I programs sit in the neighboring city of Orange (trauma center list):

  • UC Irvine Medical Center treats adults with the most serious injuries.
  • Children’s Hospital of Orange County (CHOC) holds the pediatric Level I designation, which matters given the young-cyclist figures above.

Request the complete chart from whichever hospital treated you, including the imaging reports and the triage note written on arrival. Adjusters compare every later complaint with those first-day entries.

Rail and bus agencies

Tustin has a Metrolink station, and OCTA operates the bus routes through town (Wikipedia). Because both are public agencies, the Government Claims Act applies, with its six-month deadline for presenting a written claim to the operator (Gov. Code §911.2). A bus collision also produces onboard camera footage and operator records that a crash between private cars never has; our bus accident page describes how those are obtained.

Superior Court

The county’s civil division sorts cases at $35,000: a Tustin injury claim at or below that line is “limited,” and anything above it is “unlimited” (OC Superior Court). Tustin cases go to the same county court, headquartered in a Santa Ana complex at number 700 (court locations). We confirm which courtroom will hear a particular injury case when the complaint is prepared.

Three places where Tustin injuries often happen

Tustin Legacy. Redevelopment of the former Marine Corps Air Station continues to bring new streets, new homes and active construction sites. When a lane shifts overnight or a temporary signal replaces a permanent one, the question is whether the contractor followed its traffic-control plan. The base’s giant wooden hangars remain the neighborhood’s landmark, though the north hangar burned in 2023.

The District and The Market Place. Both regional shopping centers feed Jamboree Road and the arterials around it. Exits from their parking fields cross sidewalks and bike lanes, so a shopper struck on foot can have claims involving both the driver and the property owner; our premises liability page covers the second kind.

School hours. Tustin Unified employs 2,491 people, more than any other employer in the city. The start and end of the school day send children walking and biking into commuter traffic twice a day, which is consistent with the city’s high rank for cyclists under 15.

Watch out: A Tustin Legacy work zone can look entirely different a few weeks later. On the day of the crash, photograph the cones, detour signs, lane markings and the contractor’s name on nearby equipment.

A two-week request list

  • Case number and issuing office (city police versus Area 675)
  • Phone photos of skid marks, debris and your visible injuries before the bruising fades
  • Contact details for any crossing guard or parent who saw a school-zone crash
  • Discharge papers and imaging from UCI, CHOC or your own doctor
  • Letters asking District or Market Place tenants to preserve camera files
  • The coverage summary from your own auto carrier, showing your UM/UIM limits
  • A six-month calendar reminder if OCTA, Metrolink or a city street defect is involved

If the driver who hit you left the scene, as happened in 20 Tustin injury crashes in 2023, add one more item: prompt written notice to your own insurer under the uninsured motorist section of your policy, together with the police report showing that another vehicle was involved. That coverage follows the insured person, so a car owner struck while jogging on Jamboree can still rely on it.

Tustin claims under California law

Someone hurt by a private motorist on Jamboree or in Old Town has two years to sue (CCP §335.1), and three years if only the car was damaged. Comparative fault is “pure” in California: a jogger found 20% at fault for stepping out near The Market Place keeps the other 80% of her damages (CACI 405). A minor’s deadline is calculated on its own schedule, which matters given the young-cyclist figures above.

Recoverable losses cover treatment already paid for, paychecks you missed, pain and suffering, and care you will still need. If Kaiser, an employer health plan or Medi-Cal paid the UCI bill, expect a lien, and expect it to be negotiated before any settlement is distributed.

Orange Crush, school and parking-lot questions

Is the Orange Crush interchange inside Tustin?

No. It lies just outside the city to the northwest, but its backups extend onto the I-5 and SR-55 through Tustin, and crashes on those freeways are normally handled by Area 675.

Our daughter was hit while riding her bike to school. Does a child get more time to file?

Often, yes, for her own claim: a minor’s deadlines are calculated differently from an adult’s. The exception is a claim against Tustin Unified or the City, for example over a district vehicle or a crossing’s design, which must still be presented within six months.

Who pays if a Tustin Legacy lane shift confused the driver who hit me?

The driver is still responsible for driving carefully, but a contractor or approving agency that failed to put required signs or barriers in place may share fault.

Is a minor parking-lot collision at The District worth a call to an auto accident attorney in Tustin?

If you have fully recovered and fault is clear, perhaps not. Ongoing treatment, an uninsured driver or a public agency as a defendant are signs that a free consultation is worthwhile.

Putting the directory to work for Tustin clients

Call Jacob represents Tustin families, Tustin Legacy commuters and shoppers hurt at The District, and we deal with the Tustin Police Department, Area 675, OCTA or the Orange County court as each case requires. Our Tustin cases include pedestrian and child-cyclist injuries near Tustin Unified schools, freeway crashes on the 5 and 55, work-zone collisions in Tustin Legacy, falls in retail parking lots, dog bites and wrongful death claims.

The Law Offices of Jacob Emrani (Call Jacob) puts the list above into practice: we obtain the Tustin police or Area 675 report, send video preservation letters before cameras record over the footage, collect the UCI or CHOC records and file any OCTA or city claim within six months. Adjusters then call our office instead of your phone, and nobody tapes your account of the crash while you are still on pain medication.

Sitting down with us costs nothing, and no fee is owed unless we win your case. If driving is difficult right now, we can meet at your kitchen table in Tustin Ranch, Tustin Meadows or Old Town. Spanish: calljacob.com/es.

Our intake line, (888) 952-2952, takes calls about every kind of case, from a freeway merge that calls for a Tustin car accident lawyer to a dog bite or fall that needs an Orange County personal injury attorney. The online case evaluator collects the same information in writing. For crash-specific reading, the car accident guide explains freeway-merge claims, and the bicycle accident guide explains right-hook and dooring cases.
