Tehachapi Personal Injury Attorney
Kern County
Of the 408 collisions Tehachapi’s engineers studied on city streets for 2015 through 2019, more than a third (34.7%) were blamed first on unsafe speed, and that share climbed to 38.5% among the crashes that left someone dead or badly hurt (Tehachapi LRSP). That one figure runs through most of the questions people bring to a Tehachapi personal injury attorney, from a rear-end collision downtown to a big-rig crash on the pass. Each answer below comes from the 2022 Local Road Safety Plan, OTS data for 2023, or the agencies that serve this mountain city of 11,852 (Census 2025 estimate).
- Where on Tehachapi Boulevard and Tucker Road do crashes cluster?
- Why does the safety plan keep returning to speed?
- Whose officer writes the report on the mountain?
- What makes a crash on the pass different?
- How far is it to Kern Medical or Lancaster?
- What filing rules apply between Mojave and Bakersfield?
Where on Tehachapi Boulevard and Tucker Road do crashes cluster?
On two roads. Tehachapi Boulevard, from Tucker Road to Tehachapi Willow Springs Road, recorded 89 collisions in the five study years, mostly rear-ends (30%) and sideswipes (22%), with unsafe speed the leading cause at 26%. Half of those crashes occurred in the three-quarter mile of downtown between Mill Street and Snyder Avenue, and every bicycle and pedestrian crash on the boulevard happened in that stretch.
Tucker Road, from Tehachapi Boulevard to Highline Road, recorded 76 collisions, including a pedestrian fatality in its commercial section. Its northern end, between Tehachapi Boulevard and Valley Boulevard, is Caltrans right-of-way, which matters if the road itself is part of the claim.
| Location | Plan finding, 2015–2019 |
|---|---|
| Tucker Rd at Valley Blvd | 1st among intersections by crash frequency |
| Tucker Rd at Conway Ave | 1st by severity-weighted score |
| Tucker Rd at Tehachapi Blvd | Among the top three intersections |
| Tehachapi Blvd at Curry St | 3rd or 4th; Curry St had 16 collisions, 44% broadsides |
| Valley Blvd, Sierra Vista Dr to Dennison Rd | 58 collisions; 37% rear-ends, 22% broadsides |
Collisions also jumped from 89 in 2018 to 134 in 2019, the last year studied.
I was hit while riding in the Tehachapi Gran Fondo. Who is responsible?
Usually the driver who hit you, as on any other day. The September event sends riders on routes of up to about 100 miles, and the event’s waiver generally does not protect a negligent motorist. Gran Fondo entrants and everyday riders on Highline or Valley Boulevard will find more detail on our bicycle accident page.
Why does the safety plan keep returning to speed?
Because it leads the record twice. Besides leading all crash causes, unsafe speed accounted for the largest share of serious ones, ahead of right-of-way violations (23.1%) and signal or sign violations (15.4%). Teen drivers aged 15 to 19 were the at-fault party in 18.7% of collisions, the largest of any age group.
OTS compared Tehachapi with 102 other Group E cities for 2023, and its rows point in the same direction even though the numbers are small (OTS 2023):
- 30th for nighttime injury crashes, with 4 between 9 p.m. and 3 a.m.
- 15th in two rows that each held one victim: a crash with an under-21 drinking driver and a child pedestrian under 15
- 56th for speed-related injury crashes (3)
- 68th for total victims (19), and 49th overall
In those rankings 1st is worst. Arrests run the opposite way: Tehachapi’s 19 DUI arrests sit 44th on a list headed by the city with the fewest, so they describe enforcement. For a claim, the speed findings matter in a practical way: when the insurer argues about fault in a downtown rear-end crash, the city’s own data showing how often speed causes collisions on Tehachapi Boulevard supports a closer look at the other driver’s speed, through vehicle data, video and skid evidence.
My teenager caused a crash on Tucker Road. Is our insurance responsible?
Generally your auto policy covers a household driver, and in California a parent who signed a minor’s license application can also be responsible up to set limits.
Whose officer writes the report on the mountain?
Tehachapi revived its own police department in November 2006, and its officers handle collisions on Tehachapi Boulevard, Tucker Road and the rest of the city grid (Wikipedia). Highway 58 and the roads outside the city, including those in Golden Hills, Bear Valley Springs and Stallion Springs, fall to the CHP’s Mojave Area office at 1313 Highway 58 in Mojave, which lists Tehachapi among the communities it serves (CHP).
Does it matter that I live in Bear Valley Springs and not in the city?
It changes who wrote the report, usually the CHP rather than the Tehachapi police, but not your rights against the driver.
What makes a crash on the pass different?
Highway 58 crosses the Tehachapi Pass at about 3,970 feet. The area averages 15 to 20 inches of snow a winter and is windy year-round as air funnels through the pass (Wikipedia). It is also a freight route. On February 22 and 23, 2023, a jackknifed big rig and a car that spun out crossed the median in Tehachapi; the highway was closed for about 17 hours, and two people from a big rig were hospitalized in Tehachapi with severe injuries (KMPH).
Watch out: Snow on the pass is not a defense in itself. A trucker who keeps highway speed into snow or crosswinds on the pass can still be negligent, and California’s rule is to drive at a speed that is safe for conditions. Carriers often blame the storm, so the CHP report, weather data and the truck’s electronic records become central.
Who can be named after a jackknife on Highway 58?
A jackknife on 58 can bring in the trucker, the motor carrier, a freight broker and a shipper if the load shifted, each possibly with its own insurer; our truck accident page sets out who can be named.
How far is it to Kern Medical or Lancaster?
EMSA’s designation list includes no trauma center on the mountain. Both choices mean a long drive: west-northwest about 35 miles to Kern Medical in Bakersfield, or southeast toward the Antelope Valley Medical Center in Lancaster, each a Level II designee (EMSA). A patient can also be moved from one hospital to another, so gather records from every facility and the transport between them.
What filing rules apply between Mojave and Bakersfield?
- Two years before a negligence complaint over a Tucker Road or Valley Boulevard collision is generally time-barred (CCP §335.1)
- Six months for a written government claim if the road is part of the problem, whether a downtown signal owned by the city or the Caltrans-held north end of Tucker Road (Government Code §911.2)
- Comparative fault: a driver judged partly responsible for a downtown rear-end collision loses only that percentage of the award (CACI 405)
Mojave, on State Highway 58 Business, is the closest place the court lists for civil matters. For injuries serious enough to be worth more than $35,000, though, the court points filers over the mountain to Bakersfield’s Metropolitan Justice Building on Truxtun Avenue, where Tehachapi injury lawsuits are generally heard (Kern Superior Court).
I take the Kern Transit 100 from the Park and Ride. What if I’m hurt on the bus?
Because Kern Transit is a government operator, a passenger hurt on Route 100 files a written claim with it first, and the six-month clock starts on the day of the injury. Route 100 and the Amtrak Thruway bus stop at the Park and Ride at 335 W. Tehachapi Boulevard.
Our clients on the mountain and in town
We represent Tehachapi residents, people living in Golden Hills, Bear Valley Springs and Stallion Springs, commuters, wind-farm and prison employees, and travelers on Highway 58. On a Tehachapi case we obtain the Tehachapi Police or CHP Mojave report, compare the location with the city’s ranked roads, and, on a Highway 58 truck crash, send preservation demands for the carrier’s driver logs and electronic data.
The city’s data points first to rear-end and broadside car accident claims on Tehachapi Boulevard and Tucker Road. Beyond those, The Law Offices of Jacob Emrani represents people hurt by big rigs on the 58 grade, cyclists and pedestrians struck between Mill Street and Snyder Avenue, riders thrown from motorcycles, Route 100 bus passengers and families bringing wrongful death claims. We can meet you at home or in the hospital in Bakersfield or Lancaster. No charge applies to that visit; the firm is paid a percentage only when it recovers money. From Golden Hills, Stallion Springs or downtown, dial (888) 952-2952. Those who prefer writing can use the case evaluator, and the Spanish-language version of our site is calljacob.com/es.
