South El Monte Personal Injury Attorney
Los Angeles County
South El Monte at a glance
- 18,963 people in 2.8 square miles
- 207,860 vehicle miles a day
- 11th of 103 cities for injured cyclists
- Policing by contract with the Sheriff
Caltrans estimates that 207,860 miles are driven on South El Monte’s streets every day, a heavy load for a city the Census Bureau puts at 18,963 people (Census V2025), and in 2023 that traffic left 92 people killed or injured on those streets. Many of the victims were not in cars. If a crash on Rosemead Boulevard, Santa Anita Avenue or the 60 has left you hurt and you are weighing whether to call a South El Monte personal injury attorney, here is what happens in the first three days and what to do at each point.
How South El Monte compares
Each row below sets South El Monte beside the 102 other cities in its state population group, and 1 would be the worst of the 103. The CHP keeps the Pomona Freeway’s numbers separately (OTS).
| 2023 measure | Count | Rank |
|---|---|---|
| Bicyclists killed or injured | 11 | 11 |
| Pedestrians killed or injured | 9 | 16 |
| Pedestrians aged 65 and over | 2 | 16 |
| Nighttime crashes, 9 p.m. to 3 a.m. | 10 | 17 |
| All victims killed or injured | 92 | 25 |
| Hit-and-run injury crashes | 7 | 25 |
| Motorcyclists killed or injured | 7 | 30 |
| Speed-related crashes | 4 | 75 |
The pattern is clear enough. Speeding and alcohol rank low here, with 4 speed-related crashes and 3 alcohol-involved victims, while people on bicycles, people on foot, crashes after dark and drivers who leave the scene all rank in the top quarter. The DUI figure works in reverse: 29 arrests put South El Monte 40th, where 1 would mean the fewest.
From the crash to day three
At the scene
Call 911; a Sheriff’s patrol car from Temple Station will come, since the city buys its police services from the County (LASD). On the Pomona Freeway the CHP takes the call instead.
If you can stand and move safely:
- Photograph the cars, the lane you were in and any skid or scrape marks on Rosemead or Santa Anita.
- A driver speeding away still leaves clues: the color and shape of the car, the first letters of the plate, which way it turned.
- Ask the businesses along the block, before the end of the day if you can, whether their cameras face the street.
The first evening
Greater El Monte Community Hospital is the 24-hour emergency room in town (AHMC). It does not hold a trauma designation. Paramedics take the most serious injuries to a designated center, and two serve this part of the San Gabriel Valley (EMSA):
| Trauma center | Level |
|---|---|
| LA General | Level I |
| Huntington Memorial, Pasadena | Level II |
If you declined the ambulance and went home, go to the Santa Anita Avenue emergency room or your own doctor that night or the next morning if anything hurts. Neck, back and head injuries commonly announce themselves late.
When the insurer calls
The insurer for the other driver calls, often before Temple Station has released its report. Give the adjuster your name and your lawyer’s name if you have one, and decline a recorded statement until your doctors know what is wrong.
If the driver fled, day two is too late for one step. Read the next section.
Pulling the records together
By now you should have the Temple Station incident number, the names of any witnesses, your discharge papers and photographs of your injuries as they look this week. Put them in one place. They are the foundation of every later conversation with an insurer.
Hit-and-run crashes on Rosemead Boulevard
Seven times in 2023, someone caused an injury crash on South El Monte streets and drove off (OTS). That count of 7 ranked 25th of 103. The problem is not new. In January 2015 a pedestrian was killed by a driver who did not stop in the 2600 block of Rosemead Boulevard, and Temple Station traffic investigators took the case (CBS Los Angeles, 2015). Five months later, in June 2015, a bicyclist died on Rosemead after being struck by two hit-and-run drivers while being passed (NBC Los Angeles, 2015). Both crashes are more than ten years old; they are mentioned here because the pattern they describe still appears in the state’s numbers.
Watch out: If deputies never identify the driver, there is nobody to sue, and payment comes instead from the uninsured motorist part of your own auto policy. California’s statute conditions hit-and-run coverage on a report to law enforcement within 24 hours (Ins. Code §11580.2). Here that means calling Temple Station, or the CHP if the crash was on the Pomona Freeway, the same day.
That coverage applies to pedestrians and cyclists as well as drivers, as long as the household has an auto policy that includes it. Our bicycle accident page covers what happens to a claim when a passing driver clips a cyclist, the situation on Rosemead in 2015.
Questions about South El Monte crashes
The driver who hit me on Rosemead never stopped. Can I still recover anything?
Often yes, through your own uninsured motorist coverage, provided the crash was reported to Temple Station or the CHP within 24 hours. Should deputies later find the driver, a claim can also be made against that driver’s own liability policy.
Is Greater El Monte Community Hospital a trauma center?
No. It has a 24-hour emergency department on Santa Anita Avenue, but the designated trauma centers for the area are Los Angeles General Medical Center and Huntington Memorial in Pasadena.
Why are so many cyclists hurt here?
The state’s data does not give a reason, only the count: 11 bicyclists killed or injured in 2023, 11th of 103 similar cities. Heavy through-traffic on small streets is one plausible factor, and each crash still has to be proved on its own facts.
My mother was hit crossing the street. Does her age matter?
It matters for her medical care and for the value of the claim, not for her right to bring one. Two of the city’s 2023 pedestrian victims were 65 or older, a figure that ranked 16th of 103.
Which courthouse does a Rosemead Boulevard crash go to?
Generally one in the court’s East District, whose courthouses include the one on Valley Boulevard in El Monte. The specific courthouse is confirmed when the case is filed.
The calendar after the first week
| Point | Event | Local detail |
|---|---|---|
| Week 1 | Follow-up visits, first property damage estimate | Keep the Greater El Monte or trauma-center discharge papers |
| Month 1 | Physical therapy, missed paychecks add up | Lost wages are proven with employer records |
| Month 6 | Claim to a public agency due | Metro buses and city crosswalks both bring this deadline in (Gov. Code §911.2) |
| Year 2 | Lawsuit filed or rights lost | CCP §335.1 |
| Year 3 | Vehicle claim ends | Car only, not injuries |
Children have different timing rules. If you were partly to blame, for instance crossing Santa Anita outside a crosswalk at night, California still lets you recover the share of your losses caused by the driver (CACI 405).
The East District courthouses
Injury lawsuits from crashes in South El Monte are generally filed in the Los Angeles Superior Court’s East District, the part of the court that covers this corner of the county. The district’s El Monte Courthouse is at 11234 East Valley Boulevard, and the county’s service locator lists South El Monte within the jurisdiction of El Monte, Pomona and West Covina courthouses (LA County locator). That follows from General Order 2024-GEN-003-00, under which the location of the injury, not anyone’s home address, sets the district (LASC). Because the county lists three courthouses for the city, the specific one is checked against the court’s filing locator when the complaint is prepared.
How we handle South El Monte cases
Call Jacob represents people hurt on South El Monte streets, and most of what the state’s numbers show here falls into a few kinds of cases: pedestrians and cyclists struck on Rosemead Boulevard and Santa Anita Avenue, people hit at night, victims of drivers who fled, and drivers and passengers in car accidents on the 60. Riders hurt on motorcycles, people injured by a commercial truck or on a bus, shoppers who slip on a wet floor, children bitten by a neighbor’s dog and families pursuing wrongful death claims are also part of our South El Monte work.
What we do first
On a South El Monte file, the first things we request are the Temple Station report and any camera footage from Rosemead or Santa Anita businesses, because footage is often overwritten within days. When the other driver disappeared, we open the uninsured motorist claim with your own insurer and keep it moving while deputies look for the driver. If a pedestrian was hurt where a crossing or signal was poorly designed, we look at whether a government claim belongs in the case before the six-month deadline passes.
