Solvang Personal Injury Attorney

Santa Barbara County

Solvang is a town of 5,944 residents (Census 2025 estimate) that receives roughly 1.5 million visitors a year (Solvang overview). Anyone looking for a Solvang personal injury attorney should know that the people hurt here are a mix of residents, day-trippers and wine-country drivers, and each group ends up with a different kind of claim. This page sorts the risks by who you were on State Route 246, which runs through town as Mission Drive.

Visitors, drivers and riders on SR-246

Visitors walking downtown

People who park and walk the Danish-style blocks around Mission Drive are surrounded by drivers reading signs and hunting for a space. Many of them are visiting from out of the area, and their claims still run through Santa Barbara County, where the injury happened. A driver on Mission Drive who says a tourist darted out between parked cars still owed a duty to watch a shopping street at walking speed, and our pedestrian accident page explains how a jury weighs those two accounts. A fall on a wet bakery floor or a broken step outside a shop is a premises claim instead, and it turns on whether the owner knew or should have known about the hazard.

Crossing and turning on the highway

State Route 246 connects Solvang to Buellton and US-101 to the west and to Santa Ynez and SR-154 to the east. The CHP describes its Buellton Area as mostly rural two-lane highway, and SR-246 is one of the four routes it focuses on (CHP Buellton Area). On Sept. 5, 2025, a Tesla crossing SR-246 at Domingos Road, between Buellton and Solvang, was struck by a westbound F-150; the Tesla’s passenger was killed and its driver was arrested on suspicion of DUI (Santa Barbara Independent).

Watch out: Two people have died on SR-246 just outside Solvang in crashes covered by local news, one at Domingos Road and one near Casino Drive. Because both were outside city limits on a state highway, neither death is part of the city’s OTS figures below.

After an afternoon of wine tasting

Whatever happens to the Domingos Road driver in criminal court, anyone hurt in a crash like it must pursue compensation separately, through a civil claim. That civil claim is paid first by the at-fault driver’s liability policy and then, when a valley crash causes losses larger than that policy, by the injured person’s own underinsured motorist coverage.

Night travelers

East of town, on SR-246 west of Casino Drive near Santa Ynez, a 69-year-old Solvang man in dark clothing was killed crossing the highway around midnight when a westbound pickup struck him at about 40 mph. Alcohol was not a factor, and video from the Chumash Casino helped the CHP reconstruct what happened (KSBY); the station’s report does not give a date.

Tip: The casino video helped because it still existed when investigators asked for it. Hotel and tasting-room cameras along Mission Drive deserve a written preservation letter within days.

Breeze passengers and pass riders

Two smaller groups round out the picture:

  • Breeze Bus riders. The route links Lompoc, Buellton, Solvang and Santa Maria (Lompoc overview). If you were hurt on board, find out early who operates it, because a public operator is entitled to a written claim within six months.
  • Motorcyclists on SR-154. Riders heading over San Marcos Pass share that grade with Santa Barbara commuters, and the CHP Buellton Area names the pass road as one of its focus highways.

Solvang in the OTS small-city table

In the 2023 OTS rankings, Solvang is measured against 74 small California cities, and in each crash category the city with the most victims or crashes is ranked first.

2023 measureCountRank of 74
Composite ranking—19
People killed or injured1132
Pedestrians under 1513
Crashes from 9 p.m. to 3 a.m.215
Hit-and-run injury crashes116
Drinking drivers aged 21 to 34117
Alcohol-involved victims225
Pedestrians, all ages125

One injured child pedestrian put Solvang third on that line, which reflects how few crashes a town of six thousand records rather than a trend. The same report lists 25 DUI arrests in Solvang, and because arrest counts are ranked with the fewest arrests first, Solvang’s place at 51st of 74 means about two-thirds of comparable towns arrested fewer impaired drivers.

Sheriff, CHP and the valley’s trauma centers

Three agencies cover a crash in and around Solvang (Solvang overview; CHP):

ResponderBase and territoryRecords you will want
Santa Barbara County Sheriff’s OfficeSubstation in town; city streetsThe collision report for most crashes on Mission Drive inside city limits
CHP Buellton Area166 Industrial Way, BuelltonThe report for SR-246 toward Buellton and Santa Ynez, and for SR-154
Santa Barbara County FireCountywide; has served Solvang since April 2007Run records showing response time and what crews found

From Mission Drive, the trip to Santa Barbara Cottage Hospital, a Level I adult and Level II pediatric trauma center, crosses San Marcos Pass on SR-154; the alternative is Marian Regional, a Level II center reached by heading north on US-101 to Santa Maria (EMSA). Ask whichever hospital treated you for the emergency department chart and the ambulance record from the ride out of the valley; the first complaints of neck or head pain written there are the hardest for an insurer to dispute. For the first day:

  • Before leaving Mission Drive, find out which agency is writing up the crash and copy down its report number.
  • Photograph the crosswalk lines, the parked cars and each shop window with a camera facing the spot where you were hit.
  • If you are driving home to another county, get checked at an urgent care or emergency room before you leave the valley, not after.
  • When the other driver’s insurer calls and asks to record your account of the Solvang crash, tell the adjuster you will respond later.

Deadlines in Santa Barbara County

  • Two years from the injury to file a lawsuit against a driver who hit you on Mission Drive or a shop owner whose floor you fell on (CCP §335.1); damage to your car has three years, and a child’s deadline is calculated differently.
  • Six months if the harm traces to a public body, such as the City of Solvang for its sidewalks, the State for SR-246, or the operator of a public bus (Gov. Code §911.2).
  • Comparative fault splits the loss when both sides erred: if a jury finds that a tasting-room guest crossing SR-246 mid-block shares the blame with a speeding pickup driver, the guest’s award shrinks by that share instead of disappearing (CACI 405).

Lawsuits arising in Solvang go to the Santa Barbara County Superior Court, whose forms list Solvang among its North County cities (form SC-2069). Which clerk’s office takes a particular case is confirmed when it is filed.

Answers for out-of-town families

I’m back home in another state. Do I have to return to Solvang for my case?

Rarely. California law governs a crash on Mission Drive wherever you now live, and routine steps happen by phone and mail; a trip back is usually needed only for a deposition or trial.

The deputy and the CHP both came. Whose report do I need?

That depends on where the crash happened: city streets generally go to the Sheriff’s substation, and SR-246 outside town goes to the CHP Buellton Area on Industrial Way.

My driver had been wine tasting and I was the passenger. Who pays?

The insurer for the car you were riding in is usually first in line, followed by your own underinsured motorist coverage if that policy runs out.

I tripped on a broken sidewalk downtown. Is there a deadline?

Yes. A broken downtown sidewalk is usually public property, and a written claim describing the fall has to reach the City of Solvang within six months, far sooner than the two years allowed against a shop owner.

Our firm, The Law Offices of Jacob Emrani (Call Jacob), takes on Solvang cases for the people who live along Mission Drive, for families who came for a day of shopping and tasting, and for drivers hurt on SR-246 between Buellton and Santa Ynez. When we handle a Solvang case, we request the Sheriff’s or CHP Buellton Area report first, send preservation letters to Mission Drive businesses whose cameras face the scene, and calendar any six-month claim against a public agency. Solvang’s 2023 crash table and the two SR-246 deaths point first to car accidents and people struck on foot. Alongside those, we represent cyclists and motorcyclists on the valley highways, pickup and truck collisions like the one at Domingos Road, Breeze Bus injuries, falls inside local shops, dog bites, and wrongful death claims.

If you have already gone home after your Solvang visit, we can meet you there or talk by phone. Speaking with a Solvang car accident attorney at Call Jacob is free, and the contingency fee is owed only if we recover money for you.
