Seaside Personal Injury Attorney

Monterey County

Seaside in brief

  • 31,636 residents as of July 2025 (Census)
  • Home to CSU Monterey Bay and the Monterey College of Law
  • Two report-taking agencies: Seaside police on Fremont, Broadway and Del Monte; the CHP on the Highway 1 freeway
  • One of three Monterey County cities TAMC lists with its own adopted or in-progress Vision Zero plan

Sixteen of the 108 people hurt or killed on Seaside streets in 2023 were on foot, and that pedestrian count sat 10th worst among 93 peer cities in the state’s annual comparison (OTS 2023). A Seaside personal injury attorney reads those numbers for what they say about a claim: people on foot, drivers who flee, and crashes after dark are where this former Fort Ord city stands out, and each of those patterns calls for particular evidence.

How Seaside ranked in 2023

In the OTS tables, Seaside competes in Group D against 92 other cities, and a 1 beside any category would mean the worst showing of that whole group. Seaside’s composite placement was 29th, yet its pedestrian, hit-and-run and late-night figures all landed well inside the top fifth of the group.

2023 categoryCountRank
Pedestrians1610
Hit-and-run crashes1514
Nighttime crashes1516
All victims10833
Bicyclists834
Speed crashes1536
Alcohol victims1437
Motorcyclists462

OTS leaves crashes on CHP-patrolled state highways out of its city tables, so a collision on the Highway 1 freeway along Seaside’s western border is missing from every row above. One year in a city of this size also swings widely on a few crashes, so the table shows tendencies rather than predictions about any single block.

Reading the three standout rows

Sixteen pedestrian victims is the figure that separates Seaside from most cities its size, and the hit-and-run and late-night rows sit close behind it. Each pattern shapes the evidence a claim needs:

PatternRankWhat the claim turns on
Pedestrians10thCrosswalk location, lighting, driver attention
Hit-and-run14thWhether you carry UM coverage
9 p.m. to 3 a.m.16thHeadlights, visibility, impairment

Insurers defending a pedestrian claim ask early whether the walker was inside a marked crosswalk and whether the street was lit, and the answers come from scene photographs, the officer’s diagram and any camera aimed at the crossing. Fifteen times in 2023, a Seaside driver left someone injured and drove away; when that driver is never identified, the uninsured motorist portion of your own auto policy usually becomes the money for treatment and lost wages. The late window brought another fifteen injury crashes, and darkness thins the witness pool while bringing reflective clothing and impairment into the liability dispute.

Watch out: After a hit-and-run in Seaside, call the police from the scene if you are able, then put a short written notice to your own insurance company the same week. A delayed report is one of the first reasons an uninsured motorist claim is questioned.

Fremont, Del Monte and Broadway

Reporting from the Monterey County Weekly gave Fremont Boulevard 72 collisions in 2022, the highest of any Seaside street, against 44 on Del Monte Boulevard (Monterey County Weekly). The paper did not identify the dataset behind those counts, so they work as a pointer toward the busiest corridors rather than an official tally. A fatal crash shows what Fremont can mean for pedestrians at night. Near the Military Avenue intersection at about 10:15 p.m. on Sept. 22, 2024, a vehicle struck and killed a pedestrian, and its driver was ejected and also died, police said (CBS News Bay Area).

Broadway Avenue is the city’s clearest example of a street already marked for repair:

  • $12.04 million in state Active Transportation Program funds was allocated to rebuild it between Fremont Boulevard and General Jim Moore Boulevard (TAMC).
  • 13.5% of Seaside’s bicycle and pedestrian collisions over roughly a decade happened inside that 1.3-mile project area, TAMC reported.
  • The redesign drops Broadway from four lanes to two, adding curb extensions, protected bike lanes and roundabouts.
  • Broadway and Yosemite Avenue together serve four of the city’s seven elementary schools, including Martin Luther King Jr. school.

At the city’s edges, Canyon Del Rey Boulevard (State Route 218) is under joint study by TAMC, Seaside, Del Rey Oaks and Caltrans between Highway 1 and Highway 68 (TAMC SR-218), and Imjin Parkway across the old Army post carries 24,000 to 39,000 vehicles on a weekday (TAMC Imjin).

Why the DUI arrest rank runs high

206 Seaside DUI stops ending in arrest during 2023 drew an OTS rank of 90, on a scale where 1 is the fewest (OTS)

That placement is easy to misread. Arrests are the one OTS category ranked in reverse, so a 90 reflects how actively Seaside officers made DUI stops, not a danger score, and it says nothing against the city’s roads. If the motorist who injured you was booked on a DUI that night, we ask for the arrest narrative, the chemical test and the criminal docket, because each one supports negligence in a civil case.

Footage, reports and photographs to save

  • Order the Seaside police report for a Fremont or Broadway crash; a freeway wreck on Highway 1 means writing to the CHP office on East Blanco Road (CHP)
  • Ask shops, gas stations and apartment managers along Fremont or Del Monte Boulevard to save their camera video before it records over
  • Photograph the crossing, the lighting and the lane striping, since Broadway construction will change what the street looks like
  • Keep discharge papers from Natividad Medical Center, the county’s sole state-listed trauma center at Level II (EMSA), or from wherever you were treated
  • Let us take the adjuster’s phone calls, so nothing you say on tape about the Fremont or Broadway crossing is used against you

Filing windows and the Aguajito Road courthouse

A negligence lawsuit over a crash on Fremont, Del Monte or any other Seaside street has to be on file within California’s two-year statute of limitations (CCP §335.1). Seaside’s own vehicles and streets carry a faster clock: when a city cruiser or public works truck hit you, or a dark streetlight or faded Broadway crosswalk helped cause the collision, the written claim is due to City Hall on Harcourt Avenue in six months (Gov. Code §911.2), and the same six months governs a State claim over Canyon Del Rey Boulevard or Highway 1.

Hypothetical example: A walker found 20% to blame for crossing Fremont mid-block still keeps 80% of the proven damages, because California divides fault by percentage under pure comparative negligence (CACI 405).

A Seaside lawsuit is heard in Monterey, not in Seaside. Local Rule 6.2(B) places the Superior Court’s civil division at 1200 Aguajito Road, where civil cases are processed and tried unless the court assigns them elsewhere (Local Rules).

Hiring us after a Seaside crash

The Law Offices of Jacob Emrani (Call Jacob) represents residents, CSUMB students and visitors hurt on Fremont Boulevard, Del Monte Boulevard, Broadway Avenue and the Fort Ord roads. When we open a Seaside case, the Seaside Police Department report is the first record we order, and we compare the crash location against the corridors TAMC has already funded or studied.

Seaside’s own numbers shape the practice here, so pedestrian accident claims and hit-and-run cases come first. We also handle these Seaside cases:

  • car accident claims from Highway 1 and Canyon Del Rey, including collisions with delivery trucks
  • cyclists on the Broadway bike lanes, and motorcyclists on Imjin Parkway
  • Uber and Lyft passengers near the CSUMB campus
  • falls on broken pavement or wet floors at Seaside businesses, and dog bites in the neighborhoods off Broadway
  • wrongful death claims for the spouse, children or parents left behind by a Fremont Boulevard crash like the September 2024 one

The first consultation is free. Reach an auto accident attorney in Seaside at (888) 952-2952, or tell us about the Fremont, Del Monte or Broadway crash through the case evaluator. Spanish-speaking families can start at calljacob.com/es, and a representative will drive to your home near Broadway or to your bedside at Natividad if travel is difficult.

Seaside questions from injured readers

Why isn’t my Highway 1 crash in the city’s OTS numbers?

OTS counts only the crashes local officers handle, and a wreck on the SR-1 freeway past Seaside High School is a Highway Patrol case written up by the Area 730 office in Salinas.

Are Seaside’s roads worse than the rest of Monterey County?

The OTS comparison is with similar-size cities statewide. For the county as a whole, TAMC’s 2026 Regional Vision Zero plan reports an average of 41 fatal and 169 severe-injury crashes a year from 2019 to 2023, with 61% of them on under 6% of road miles (TAMC regional plan). Those are regional figures, not Seaside’s own.

A driver hit our son near his Broadway Avenue school. Where do we start?

Start with a doctor and a Seaside police report. Note the exact crossing, the time and any crossing guard or parent who saw it, and ask the school for its incident notes.

Tip: Write down the names of any crossing guard or parent at the Broadway or Yosemite crossing that morning. Those witnesses scatter quickly once the school year moves on.

I study at CSU Monterey Bay but live out of state. Does that matter?

No. A claim follows the place of the crash, so a Seaside collision belongs in Monterey County regardless of your home address.

Will a first meeting with a Seaside car accident lawyer cost me money?

No. We review the Seaside police report and your bills with you free of charge, and under our contingency fee you pay nothing unless we win.
