Scotts Valley Personal Injury Attorney
Santa Cruz County
Most of the worst crashes in Scotts Valley happen on Highway 17, the mountain route that runs through town on its way from Santa Cruz, six miles south, over the Santa Cruz Mountains to San Jose, roughly 30 miles north (Wikipedia). Anyone hurt on that grade, or on the city streets that feed its ramps, may deal with two police agencies, a hospital in another county and a courthouse in Santa Cruz, all for a town of about 11,650 residents (Census). If you are looking for a Scotts Valley personal injury attorney, this guide follows the highway and its interchanges, then the agencies and deadlines that come with them.

Why the city’s totals undercount Highway 17
Judged only by its own streets, Scotts Valley looks quiet. State figures show 17 people hurt or killed on city streets in 2023, 77th among 103 similar-sized cities, and 91st once every category is blended (OTS 2023).
| Scotts Valley, 2023 | Count | Place of 103 |
|---|---|---|
| People killed or injured | 17 | 77 |
| Speed-related injury crashes | 3 | 58 |
| Bicyclists under 15 | 1 | 15 |
| All categories blended | — | 91 |
| DUI arrests (scored in reverse) | 73 | 95 |
Reading these numbers: Freeway wrecks on 17 belong to the Highway Patrol, so they mostly stay out of the city’s columns, even though OTS credits Scotts Valley with roughly 107,750 vehicle miles a day, mostly through traffic, against fewer than 12,000 residents. The arrest row is scored with 1 as the fewest, so 95th means officers made more DUI arrests than nearly every peer: a sign of enforcement, not of safe or unsafe roads.
Three stretches of Highway 17
North of Santa’s Village Road
Before sunrise on September 14, 2025, around 5:20, a Nissan ran off northbound 17 just north of Santa’s Village Road, struck a sign and a call box, and ended up stopped in the left lane. A 37-year-old San Jose motorcyclist struck the disabled car and died, the CHP’s Santa Cruz office reported (KTVU).
Several questions of fault follow from facts like those: what sent the Nissan off the road, how long it sat in a travel lane, whether its lights were on, and what a rider could see in the dark. Responsibility can be divided among more than one driver, and California’s pure comparative fault rule lets a rider’s family recover even if some blame is assigned to him (CACI 405), a point any Scotts Valley motorcycle accident attorney should press and our motorcycle accident page takes further.
North of Mount Hermon Road
Around 10 p.m. on June 4, 2021, a Toyota Tacoma overtaking a slower Camry north of Mount Hermon Road clipped it and rolled. Its 28-year-old Santa Cruz driver was thrown from the truck and killed (Pajaronian).
People in the slower car can be badly hurt in a sideswipe like that. A Highway 17 accident lawyer will usually pursue the overtaking driver’s liability policy first, and on a grade where speeds are high, their own underinsured motorist benefits are often needed to cover the gap.
The three interchanges
Scotts Valley meets the highway at three junctions (Wikipedia):
- Mount Hermon Road, with a cluster of hotels near the ramps
- Scotts Valley Drive, the city’s commercial strip
- Granite Creek Road, with its own hotel cluster
Rear-end crashes where exiting traffic backs up, ramp merges and left turns onto Scotts Valley Drive straddle a jurisdictional line, so the first question a Scotts Valley car accident attorney asks is exactly where the impact happened. A collision on the ramp is usually a Highway Patrol matter; the same kind of collision a short distance away on the surface street belongs to the city’s police.
Two agencies, one interchange
| Where | Who reports | Copies |
|---|---|---|
| Mainline 17 or a ramp | CHP Santa Cruz Area (CHP) | Ask at the Aptos office (number 10395) |
| Scotts Valley Drive, Mount Hermon Road, a neighborhood street | Scotts Valley Police Department (Wikipedia) | The department shares a building with City Hall |
| Not sure | Either one | Send us the officer’s card and the location |
Tip: Fog often rolls up from Monterey Bay, and the town sits among redwoods on the mountain’s slope (Wikipedia). Note visibility, light and pavement conditions while you remember them; insurers routinely argue that a driver should have slowed more.
Treatment over the hill
Santa Cruz County has no hospital at all on the August 2025 state roster of trauma designations, adult or pediatric. The closest adult Level I is Santa Clara Valley Medical Center in San Jose (EMSA), which is where the driver from the 2021 Mount Hermon Road crash was taken (Pajaronian). Dominican Hospital in Santa Cruz serves the area but does not carry a trauma designation (Pajaronian).
For a claim, that means medical records from two counties and, in some cases, large transport bills for the trip across the summit. We collect the full chart from every facility, not just the discharge papers.
Venue at 701 Ocean Street
Any Santa Cruz County personal injury attorney brings a Scotts Valley crash lawsuit to 701 Ocean Street in Santa Cruz (Superior Court). The time limits that matter most:
- Against the at-fault driver: usually two years from the crash (CCP §335.1); three for the car alone; a child’s clock differs.
- If a damaged guardrail, missing sign or broken pavement contributed: six months for the written government claim, to Scotts Valley for its streets or the State for 17 (Gov. Code §911.2).
Answers for Highway 17 crash victims
My crash on 17 was serious. Why does the city look so safe in the statistics?
The city figures are built mostly from crashes local police investigate. Collisions on 17 are Highway Patrol cases, so they generally stay out of the city’s columns.
The rankings also compare cities by resident population, not by the commuters who make up much of the traffic on the grade, so a quiet ranking and a dangerous highway can both be true.
My husband was flown to San Jose. Does his lawsuit move to Santa Clara County?
Usually not. Venue generally follows where the crash happened, so a collision in or near Scotts Valley is filed at 701 Ocean Street in Santa Cruz even when treatment took place in San Jose.
The other driver blames the fog. Is my claim finished?
No. An auto accident lawyer in Scotts Valley will point out that fog calls for slower driving, not a free pass. A jury weighs the conditions alongside:
- each driver’s speed compared with how far ahead the road was visible
- following distance on the grade
- whether headlights and hazard lights were on
What if the highway itself was part of the problem?
Then it becomes a government claim against whoever maintains that pavement, the State for 17 and the city for its own streets, and the half-year window for presenting it starts on the day of the crash.
Photographs of the guardrail, signs or pavement taken soon after the crash help show what the condition was that day.
Our Scotts Valley and Highway 17 practice
The Law Offices of Jacob Emrani (Call Jacob) represents Scotts Valley residents, over-the-hill commuters and visitors on their way to Henry Cowell Redwoods, Big Basin or Roaring Camp who are injured in town or on 17. When we handle a Scotts Valley case, we first confirm whether the CHP Santa Cruz Area or Scotts Valley Police wrote the report, then request records from Santa Clara Valley Medical Center or Dominican Hospital and decide whether a six-month claim is needed for the highway or a city street. Where a Highway 17 hazard such as a damaged guardrail or missing sign contributed, we pursue that claim against the State as well.
Scotts Valley families do not pay to talk with us, and our contingency fee is due only if the case succeeds. Phone (888) 952-2952 or describe the crash in our case evaluator; we can come to your home in Vine Hill or Granite Creek, or to your room in San Jose, and we offer Spanish-language pages too. The cases we take here include:
- Motorcyclists on 17 hurt by stalled, swerving or overtaking vehicles, as in the 2025 Santa’s Village Road crash
- Drivers and passengers hit by someone impaired on the way down from the summit at night (car accident claims)
- Big-rig and delivery-truck wrecks where 17 climbs toward the summit (truck accident claims)
- People hurt aboard a Santa Cruz Metro bus bound for San Jose, or in the back seat of an Uber or Lyft
- People on foot or on a bicycle struck on Scotts Valley Drive or near the Kings Village shops
- Falls at hotels near the Mount Hermon and Granite Creek ramps, dog bites, and wrongful death claims for families
Treat this as general information, not legal advice: Highway 17 crashes, fog disputes and two-county medical records vary widely from case to case.
