Santa Maria Personal Injury Attorney

Santa Barbara County

Only two cities in Santa Maria’s state peer group of 62 posted a worse overall crash record in 2023, according to the Office of Traffic Safety’s composite ranking, which placed the city 3rd (OTS 2023). Most of that harm happens on a handful of roads: Broadway, Main Street, Betteravia Road and the state highways that carry farm, commuter and freight traffic through the Santa Maria Valley. A Santa Maria personal injury attorney starts with where the crash happened, because the road decides who investigates, which records exist and who else might share responsibility.

With 111,390 people as of July 2025, Santa Maria has outgrown every other city in Santa Barbara County, Santa Barbara included (Census). The Santa Maria Police Department handles crashes on city streets, and a police sergeant has put the citywide average at about 2,000 traffic collisions a year (KEYT).

Short answers before the road guide

Broadway is a state highway. Does that change my claim?

It can. City officers write the report for a Broadway crash, yet the roadway is State Route 135, so a signal or crossing problem points toward Caltrans and starts the six-month claim clock against the state.

The driver who hit me on Betteravia drove off. What now?

Call Santa Maria Police from the Betteravia scene or as soon as you are able, then tell your own carrier, since insurers expect a hit-and-run to be reported to police promptly before they pay an uninsured motorist claim.

Who handles a crash on Highway 166 east of town?

Collisions on the road toward Cuyama belong to the Highway Patrol, and the Carlotti Drive office that covers it also holds the scene diagrams and photographs its officers took.

I was hurt in a farm labor van. Is that only workers’ compensation?

Not always. Workers’ compensation covers many work-related injuries, but if a third party, such as another driver or a separate transport company, caused the crash, a personal injury claim may also exist.

Will my case be heard in Santa Maria or Santa Barbara?

For injuries that happen in North County, the court’s local rules generally send the case to the North County clerk in Santa Maria.

Broadway, State Route 135

Broadway is the city’s spine, carrying about 20,000 vehicles a day past the shops, restaurants and offices that line it. In 2026 the Santa Barbara County Association of Governments, the city and Caltrans opened a corridor study of State Route 135 that looks at safety, congestion and a possible bus rapid transit line running about every 15 minutes between Orcutt and Santa Maria (KSBY).

Police have identified Broadway at Betteravia Road and Broadway at Donovan Road as the city’s main collision locations (KEYT). A pedestrian was killed in the 1400 block of South Broadway. Countywide, Highway 135 recorded 12 fatal collisions and 13 deaths between 2010 and 2018, according to a Santa Maria Times review of federal fatality data (Santa Maria Times).

Evidence on Broadway: Shopping centers, gas stations and restaurants line both sides of the street, and many have cameras facing the driveways and intersections. Because Broadway is a state highway, the corridor study’s public comments and Caltrans records about signal timing and crossings can also matter when the road’s design is in question.

Main Street and Highway 166 in town

Main Street carries State Route 166 through the center of Santa Maria. A police sergeant told the Santa Maria Times that many of the city’s pedestrian and bicycle collisions occur on Broadway and Main Street (Santa Maria Times). Downtown, where the two state routes cross, people on foot share the intersections with highway traffic.

Pedestrian claims on Main Street usually turn on the crossing itself: whether there was a marked crosswalk, how long the walk signal lasted, and what the driver could see. A Santa Maria pedestrian accident lawyer builds that pedestrian accident claim from the police report and from witness statements gathered before people disperse.

Betteravia Road and the 101 interchange

Betteravia Road carries shoppers, students and freeway traffic to and from the US-101 interchange. During 2021 construction near College Drive, police counted at least 24 collisions around a work zone where new medians and changed traffic patterns met school and shopping foot traffic (KEYT). The Betteravia interchange with US-101 has since been rebuilt.

In September 2024, a wrong-way driver on US-101 near Betteravia caused a crash that killed a woman, Santa Maria’s second fatal crash in under eight hours (CalCoastNews).

Work-zone crashes like those near College Drive leave a paper trail beyond the police report, and we ask for it early:

  • The contractor’s approved traffic-control plan for the Betteravia lane shifts
  • Daily logs showing where cones, barrels and signs stood on the crash date
  • Any complaints the city or Caltrans received about the new medians
  • Footage from the shopping centers facing the interchange

US-101 through the city

US-101 was the deadliest road in Santa Barbara County from 2010 to 2018, with 66 fatal collisions and 70 deaths. Five of those fatal collisions occurred on the stretch from the Santa Maria River bridge to the Thompson Road and SR-166 interchange (Santa Maria Times).

The CHP Santa Maria Area office at 1710 N. Carlotti Drive patrols about 30 miles of US-101 in the region, and its officers investigate freeway crashes (CHP). These collisions are left out of the city’s OTS figures, which cover surface streets. For a tractor-trailer collision between the river bridge and Thompson Road, our truck accident page describes the hours-of-service logs, inspection reports and dashcam footage a Santa Maria truck accident lawyer asks a carrier to preserve.

Highway 166 east toward Cuyama

Past the last subdivisions, SR-166 narrows into the two-lane route to New Cuyama, where tractors and harvest trailers share the pavement with commuters, and the Carlotti Drive CHP office is responsible for 78 miles of it. From 2010 to 2018 it was the county’s fourth-deadliest road, with 14 fatal collisions and 17 deaths, and six of those collisions involved alcohol (Santa Maria Times).

Watch out: On a two-lane rural highway, the proof of which car crossed the center line is on the asphalt: tire marks, gouges and scattered debris. Rain, traffic and Caltrans sweepers erase it within days, so same-day photographs and the CHP scene diagram matter more on SR-166 than almost anywhere else in the valley.

Highway 1, Highway 135 and farmworker transport

The CHP Santa Maria Area also covers 20 miles of SR-1 and 17 miles of SR-135 toward Orcutt and Vandenberg. A van carrying 12 farmworkers was involved in a crash on Highway 1 in Santa Maria (CHP). In an older case, a van carrying Santa Maria-area farmworkers left Foxen Canyon Road near Los Alamos and struck an oak tree, killing one passenger and injuring five (Santa Maria Times).

Field crews hurt in a labor van often have two claims running side by side: a workers’ compensation claim through the grower or labor contractor, and an injury claim against an outside driver or transport company whose negligence caused the wreck. We sort out which of those exists before anyone signs a statement for the van’s insurer.

What the 2023 state rankings add

State figures cover Santa Maria’s own streets, not the freeway, and compare it with 61 cities of similar population.

CategorySanta Maria, 2023Place, where 1st is worst
Hit-and-run injury crashes684th
Speed-related injury crashes1016th
Hurt where the drinking driver was under 21133rd
Child pedestrians under 1574th
Alcohol-involved victims7114th
Everyone killed or injured46221st

Officers made 592 DUI arrests that year, among the three highest totals in the peer group and a sign of heavy enforcement (OTS).

Tip: Sixty-eight hit-and-run injury crashes in one year means a fleeing driver is a real possibility here. Read the declarations page of your own auto policy for its uninsured motorist limit before an adjuster phones, since that limit sets what a hit-and-run victim on Broadway or Main can collect.

Where Santa Maria cases are handled

  1. Treatment. Marian Regional Medical Center in Santa Maria is the North County’s adult Level II trauma center, one of two trauma centers in the county (EMSA).
  2. Reports. Santa Maria Police for city streets, including Broadway and Main; the CHP Santa Maria Area for US-101, SR-166, SR-1 and other state highways outside the city.
  3. Public-agency claims. Injuries involving a city truck, a Santa Maria Regional Transit bus, or a Caltrans design flaw on Broadway or Main require a written claim to that agency within six months (Gov. Code §911.2).
  4. Lawsuit deadline. A suit against the private driver who hit you on Stowell, Donovan or Betteravia must be filed within two years (CCP §335.1), with separate rules for children such as the seven young pedestrians hurt in 2023.
  5. Court. The Superior Court is divided into North and South County. When an injury happens in North County, the local rules generally direct the case to the North County clerk at the Santa Maria (Cook Division) courthouse, 312-C East Cook Street (Superior Court).

Picture a jury deciding that a driver turning out of the Betteravia shopping center bore 30% of the blame: under California’s comparative fault rule that driver still collects 70% of proven medical bills, lost wages and pain and suffering (CACI 405).
