Santa Barbara Personal Injury Attorney
Santa Barbara County

In the cases a Santa Barbara personal injury attorney sees after South Coast crashes, drivers are often not the people most seriously hurt. Among 103 California cities of similar size, Santa Barbara ranked worst for people injured on bicycles (131) and fourth-worst for injured motorcycle riders (32) in the 2023 OTS rankings (OTS). Its speed ranking, by contrast, was an unremarkable 49th. The risk here has less to do with fast cars than with who shares the road with them: students on bikes, riders on San Marcos Pass, older pedestrians downtown and visitors unfamiliar with the streets. Each group faces a different kind of claim, so this guide addresses them one at a time.
With 86,422 residents in mid-2025 (Census) and roughly 718,360 vehicle miles driven on city streets each day, the city’s 2023 figures break down as follows:
| Who was hurt | 2023 total | Santa Barbara’s rank | Streets and settings involved |
|---|---|---|---|
| Bicyclists | 131 | 1 | Student routes, State Street, the waterfront |
| Bicyclists under 15 | 9 | 5 | School and neighborhood streets |
| Motorcyclists | 32 | 4 | SR-154 and the 101 approaches |
| Walkers 65 and older | 9 | 8 | Downtown crossings |
| All pedestrians | 41 | 9 | State Street, Milpas, Cabrillo Boulevard |
| Fleeing-driver injury crashes | 47 | 12 | No single hot spot identified |
| Everyone killed or injured | 492 | 14 | Citywide |
Bicycle injuries
One hundred thirty-one people on bicycles were injured or killed in Santa Barbara in 2023, more than in any of its 102 peer cities. Part of the explanation is who lives and studies here. UC Santa Barbara and Santa Barbara City College generate heavy student commuter traffic (Wikipedia), much of it by bike, and State Street, Milpas Street and Cabrillo Boulevard mix cyclists with delivery trucks, parking cars and tourists. Children are part of that figure as well: nine of the injured cyclists were under 15, which ranked fifth.
On State Street and Milpas, where storefront driveways and parallel parking line the bike route, a bicycle accident claim most often comes down to who had the right-of-way at a driveway, whether a parked driver checked before opening a door, or whether a turning car cut across the rider. Evidence disappears quickly on busy commercial streets, so these steps matter in the first week:
- Photograph the bike, the helmet and the exact location, including the lane markings and any construction signs.
- Write the SBPD case number in your phone’s notes before the officer drives away, because the report cannot be requested without it.
- Walk the block and ask each storefront with a camera to keep the footage from the time of the crash.
- Keep the damaged bike and helmet unrepaired until they have been photographed and inspected.
Motorcyclists on San Marcos Pass and the 101
A fourth-worst ranking for injured motorcyclists is striking for a coastal city. Geography is the likely reason. SR-154, the San Marcos Pass highway, meets US-101 near Upper State Street and climbs into the mountains, drawing riders onto curves where a car drifting over the center line leaves little room (CHP). The CHP’s Santa Barbara Area office, at 6465 Calle Real in Goleta, patrols SR-154 from State Street to Paradise Road, SR-150, and US-101 from the Ventura County line to Gaviota.
Tip: If your crash happened on SR-154 or the 101, your report will come from the CHP office on Calle Real, not the city police. In motorcycle accident claims, the report’s diagram and the officer’s notes on lane position are often the first point of dispute over fault.
Common questions from cyclists, riders and students
I’m a UCSB student with an Illinois insurance card. Do California rules still apply to my crash?
Yes. Where you are from and where your policy was issued do not change the governing law. A crash on Cabrillo Boulevard or the 101 is decided under California’s deadlines and fault rules.
A car door opened into me on State Street. Who is at fault?
Usually the person who opened the door. Under Vehicle Code §22517, a door may be opened on the traffic side only when it is reasonably safe, and a cyclist in the State Street bike lane is part of that traffic. Photographs of the parked car, the bike lane marking and your injuries help establish what happened.
My crash was on San Marcos Pass. Which agency has the report?
The CHP office in Goleta. Its Calle Real office covers the pass from State Street up to Paradise Road, so the report number you were given will be a CHP number.
Pedestrians downtown and along the waterfront
Forty-one pedestrians were killed or injured in 2023, ninth-worst of 103, and nine of them were 65 or older, eighth-worst. State Street is the city’s main commercial street, Milpas Street is its second most important commercial corridor, and Cabrillo Boulevard carries beach and tourist traffic along the water (Wikipedia). All three place pedestrians beside turning cars and drivers looking for parking.
Hypothetical example: A 72-year-old woman crossing Milpas Street at dusk is struck by a pickup turning left. The driver was going perhaps 10 mph, but the fall fractures her wrist and hip. Her claim depends less on speed than on the turning driver’s duty to yield, and on how promptly her orthopedic records connect the hip injury to that evening.
For an older pedestrian, a fall to the pavement after a low-speed impact can cause a broken hip or a head injury, and the record of the first medical visit carries great weight. Santa Barbara Cottage Hospital, within the city, is a Level I adult and Level II pediatric trauma center (Wikipedia), so most seriously injured pedestrians are treated close to where they were hurt.
Commuters on US-101
Housing costs lead many workers to live outside the city, and their commutes concentrate on the main routes into town, especially US-101 (Wikipedia). Rush-hour rear-end and merging collisions cause neck and back injuries that insurers routinely undervalue, and the report for a freeway crash comes from the CHP.
The 101 is also exposed to natural disasters. The Thomas Fire of 2017 and 2018 burned 281,893 acres in Santa Barbara and Ventura counties, and the 2018 Montecito debris flow closed US-101. When a crash happens in a detour, a closure or an emergency repair zone, the State’s management of traffic becomes part of the investigation.
Visitors, students and transit riders
Santa Barbara is about 100 miles from Los Angeles on US-101, which brings weekend visitors to the waterfront and downtown (Wikipedia). The city is also served by Santa Barbara Metropolitan Transit District buses, Amtrak’s Pacific Surfliner and Coast Starlight, and Santa Barbara Municipal Airport. Each brings its own claim process:
- A collision involving an MTD bus starts the public-agency deadline: the transit district must receive your written claim within six months (Gov. Code §911.2).
- Weekend visitors often arrive by rental car or take rideshares from the airport, and a crash in either can bring in a rental company’s or app company’s coverage, as our rideshare accident page explains.
- An out-of-town visitor injured here still brings a claim under California law, with the same deadlines.
When the driver does not stop
With 47 injury crashes in which the driver fled, Santa Barbara ranked 12th of 103 in that category alone. The nighttime and alcohol figures rank lower (67 victims of alcohol-involved crashes, 16th; 46 late-night injury crashes, 22nd), and the composite score of 230 ranked 20th. When a car strikes a cyclist and keeps going, compensation usually comes from the cyclist’s own auto policy. A UCSB student who owns no car may still be covered as a member of a parent’s household, so it is worth asking the family’s insurer before assuming there is no coverage.
Legal rules that apply to everyone
- Two years: the statute of limitations for an injured cyclist, motorcyclist or pedestrian suing a private driver (CCP §335.1).
- Six months when the claim is against a public agency: the city for a street defect, MTD for a bus or Caltrans for a 101 closure.
- Comparative fault: if a jury decides a rider on SR-154 was 20% to blame, the award drops by 20%, not to zero (CACI 405).
- Children under 18 injured on bikes near school have extra time to file their own lawsuits, but not to present the six-month government claim.
If a case does go to court, it stays in town: Santa Barbara Superior Court operates the Anacapa and Figueroa division buildings downtown (Santa Barbara Superior Court), and the clerk assigns an unlimited civil injury case to one of them at filing.
Our first steps in a Santa Barbara case
Call Jacob represents UCSB and City College students, 101 commuters and waterfront visitors injured in Santa Barbara, from cyclists struck by opening doors on State Street to motorcyclists hurt on San Marcos Pass. We handle the claim against MTD or the city when a bus or a street defect is involved, and we bring wrongful death claims for families after fatal crashes on the South Coast. Our cases here also include pedestrian injuries on Milpas Street and Cabrillo Boulevard, hit-and-run collisions and rideshare crashes involving visitors.
A doored cyclist on State Street, a rider sideswiped on the pass and a retiree struck on Milpas each need different first steps, and the Law Offices of Jacob Emrani (Call Jacob) takes care of them: the Santa Barbara Police or CHP Calle Real report, preservation letters to merchants and hotels along the waterfront, the Cottage Hospital chart and every conversation with the insurer. There is no fee unless we recover compensation for you. A broken collarbone or a hip repair can keep you off a bike and out of a car for weeks, so a representative can come to your home on the Mesa, the Riviera or the Eastside. For a free consultation, call (888) 952-2952 or describe the crash in our online case evaluator; Spanish-speaking families can begin at calljacob.com/es.
