Sand City Personal Injury Attorney

Monterey County

Sand City has about 323 residents (Census), and on most days they are far outnumbered by the people who come to shop. The city is mainly a business community built around a number of large retail stores (Wikipedia), so someone hurt here is likely to be a shopper, an employee or a visitor rather than a resident. This page lists the offices and records that matter after an injury in Sand City, and what a Sand City personal injury attorney does with each one.

The department is small enough that the responding officer’s name is worth writing down; when you request the report, it will come from Pendergrass Way. Sand City officers also work with Monterey Police Department’s Multi-Disciplinary Outreach Team, which includes Montage Health, on outreach to unsheltered people who spend time in the city (Sand City Police).

The Seaside mailing address

Because Sand City and Seaside share ZIP code 93955, a receipt, a store’s letterhead or an insurer’s form may describe a Sand City location as “Seaside” (Wikipedia). That label decides nothing. What matters is where the city line actually falls, since it determines which police department holds the report and which City receives any government claim. Ask for the report from the department that sent the officer, and if you are unsure, call the Sand City dispatch number above and ask whether the location is theirs.

Sand City in brief

  • Incorporated in 1960; 81% of its 2.9 square miles is water in Monterey Bay
  • Shares the 93955 ZIP code with Seaside
  • A police department of a chief, a commander, two sergeants and seven officers
  • The state recorded no traffic deaths or injuries in the city in 2023

Injuries inside the retail centers

Large stores bring large parking lots, loading areas and crowded aisles. When a customer is hurt by a wet floor, a falling display or a broken curb, the claim is usually against the business that controls the property under premises liability law, and the evidence belongs to that business.

Falls and falling merchandise

Before you leave the store, or as soon as you are able:

  • Ask a manager to write an incident report and give you a copy or the report number
  • Photograph the floor, shelf or curb, including any warning sign or the lack of one
  • Keep the receipt; its timestamp places you there to the minute
  • Write down the names of employees who helped you
  • Ask in writing that the store keep its camera footage of the aisle or lot

Watch out: Many stores’ camera systems overwrite older footage automatically, so a prompt written request to preserve the recording is one of the most useful steps after a fall inside a Sand City store. Our slip and fall page explains how these claims are proven.

Parking lot collisions

A collision in a store’s lot is still a car accident. The other driver’s liability insurance pays for the harm, and a report from the Sand City Police Department, or at least the exchange of license, plate and insurance information, is the starting point.

The West End in August

The city’s West End, a former industrial area that is now an artists’ colony, holds the West End Celebration street fair every August (Wikipedia). Crowds on foot, temporary booths and closed streets bring their own risks: trips over cables or uneven ground, falling fixtures, and pedestrians struck by drivers unfamiliar with the detours. Who is responsible depends on who controlled the spot where you were hurt, which can be a vendor, the organizer or a property owner.

Questions shoppers and workers ask

My receipt says Seaside. Which city’s police should I contact?

Contact the department whose officer responded. If none did, the Sand City dispatch line can tell you whether the store or lot is within its city limits.

Is the store responsible because I fell there?

Not automatically. Under California law the injured shopper generally has to show three things:

  • the store knew of the hazard, or should have found it with reasonable inspection;
  • it did not fix the hazard or warn customers in time; and
  • the hazard caused the injury.

The manager’s report, your photographs and the store’s own video usually answer those questions.

Sand City had no traffic injuries in 2023. Does that hurt my claim?

No. A citywide statistic says nothing about whether a particular driver or store was careless. What happened in your aisle or your lane is what counts.

I work at one of the stores and was hurt on the job. Can I bring a claim?

Workers’ compensation usually covers on-the-job injuries. If someone other than your employer caused the harm, such as a driver in the lot, a separate injury claim may also exist.

Highway 1 and Fremont Boulevard

State Route 1 runs along the city’s edge, and the land near its junction with Fremont Boulevard, beside Seaside High School, lies within Sand City (Wikipedia). At a boundary like that, a crash on the highway goes to the CHP Monterey Area, while one on the surface streets goes to whichever city’s police department covers that spot. Note the agency on the officer’s card before you leave.

What Call Jacob does on a Sand City case

Call Jacob represents shoppers, retail employees and West End visitors hurt in Sand City, along with the few hundred people who live here. On a store injury, we handle the preservation letter for the camera footage first and request the manager’s incident report; on a collision, we order the Sand City Police Department report from Pendergrass Way or the CHP report from Salinas.

In Sand City we handle falls in stores and parking lots, shoppers struck on foot between stores, and car accidents in the lots and on Highway 1. Delivery-truck crashes, motorcycle and bicycle injuries, rideshare collisions, dog bites and wrongful death claims are part of the same practice.

There is no charge to talk with The Law Offices of Jacob Emrani about a Sand City injury, and you pay nothing unless we win. Phone (888) 952-2952 the same day if you can, while the store’s video still exists, or describe the injury in the case evaluator.

Filing limits for store and city claims

If a Sand City police cruiser or a defect in a city-owned sidewalk caused the harm, the claim goes first to the City, in writing, inside a six-month window (Gov. Code §911.2). Shoppers suing a retailer, a landlord or another driver have two years to file (CCP §335.1), and the case would be heard in Monterey at the Aguajito Road courthouse.

Treat the phone numbers, offices and deadlines listed for Sand City as a starting point for your own questions; none of it is legal advice about your injury.
