San Leandro Personal Injury Attorney
Alameda County
About 90% of East 14th Street through San Leandro lies on Alameda County’s pedestrian high-injury network, and half of it on the bicycle network (Smart Growth America). The city itself has called the corridor dangerous and in need of improvement. As a San Leandro personal injury attorney, Call Jacob uses that street to trace a single hit-and-run claim from the curb to a resolution, stopping at each office, hospital and legal rule that would touch it.
Hypothetical example. Marco is 34 and rides his bicycle along East 14th Street to the Bay Fair BART station. One evening a driver turning right clips his rear wheel, knocks him to the pavement and keeps going. We invented Marco to illustrate the process; any resemblance to an actual cyclist’s case is coincidental.
| Stage | Marco’s task | Local player |
|---|---|---|
| Dusk on East 14th | Report and witness | San Leandro police |
| Emergency care | Fracture and concussion workup | Eden or Highland |
| Weeks one to six | Uninsured motorist notice | His auto carrier |
| Months two to six | Corridor and video evidence | City, Caltrans, AC Transit |
| Final stretch | Settlement or arbitration | Carrier and arbitrator |
Dusk on East 14th Street
San Leandro staffs its own police force, and one of its officers arrives within minutes to write up Marco’s crash. A woman waiting on a Tempo platform saw the sedan and gives the officer three letters of its plate. Tempo, AC Transit’s Line 1T, carries riders 9.5 miles along International Boulevard and East 14th Street between Uptown Oakland and San Leandro BART, and it is the agency’s busiest line, averaging 17,142 weekday boardings in February 2026 (Tempo). Crowded platforms put eyewitnesses, and sometimes cameras, beside the bike lane.
Before Marco is lifted into the ambulance:
- The officer writes down the partial plate, the sedan’s color and the side street it turned onto.
- Marco’s cycling app, still running on his phone, logs the minute he stopped moving.
- The woman from the platform leaves her number for whoever follows up.
A wreck on I-880 or I-580 would have drawn the California Highway Patrol rather than city officers, since the CHP’s Hayward Area, headquartered on Whipple Road, names those interstates among its patrol routes (CHP Area 345).
Emergency care
Marco’s collarbone is broken and he has a concussion. Paramedics leaving East 14th Street can head up the hill to Sutter Health Eden Medical Center in Castro Valley or north to Highland Hospital in Oakland; the state’s August 2025 list rates Eden at Level II and Highland at Level I for adults (EMSA).
Everything that follows depends on his chart. Emergency notes record where his helmet hit the asphalt, X-rays capture the clavicle fracture, and the concussion clinic tracks months of headaches and lost focus at his job. Missed appointments give an insurer its easiest argument, so Marco keeps them all and files every receipt. Readers whose symptoms resemble Marco’s can find more on our brain injury page.
Tip: Marco’s sister stores the cracked helmet and the bent rear wheel in her garage untouched, because the damage shows where and how hard the sedan hit him.
Weeks one to six
No one knows yet who was driving the sedan, so there is no liability insurer to call. Marco turns instead to the uninsured motorist portion of his own auto policy, which in California reaches a cyclist struck by an unidentified hit-and-run vehicle that physically made contact (Ins. Code §11580.2). He is far from the only San Leandro resident in that position: drivers fled 39 injury crashes in the city during 2023, putting it 16th among 103 similar cities on a scale where first is worst (OTS 2023).
Watch out: Carriers routinely question a hit-and-run that police never heard about. Marco’s report to San Leandro police on the night of the crash is what keeps his uninsured motorist benefit intact; his written notice to the carrier follows within days.
Should investigators later trace the sedan, the claim moves to that driver’s liability carrier, and Marco’s own coverage stays available for whatever the driver’s limits leave unpaid.
Months two to six
San Leandro’s own data supports what Marco experienced. The city’s 2022 Local Roadway Safety Plan, its first comprehensive plan of that kind and prepared by Fehr & Peers, tallied 976 injury collisions and 80 in which someone died or was severely hurt from 2014 through 2018, roughly three deaths a year (San Leandro LRSP). Its authors warn that police records undercount collisions involving walkers, cyclists and motorcyclists compared with those between drivers.
State tallies show how the walking toll has shifted over time:
| Year | Total victims | Pedestrians | Source |
|---|---|---|---|
| 2017 | 308 | 53 (12th of 106) | OTS 2017 |
| 2021 | 207 | 31 | OTS 2021 |
| 2023 | 273 (58th of 103) | 34 (17th) | OTS 2023 |
Cyclists like Marco appear in the 2023 figures too. Twenty-six riders were hurt or killed on San Leandro streets, a count that ranked 25th, and five were children younger than fifteen. Late-night collisions reached 43, and young adult drinking drivers between 21 and 34 injured 22 people, ranking 21st and 20th respectively. The composite rank was 27th.
Three facts about the street itself bear on the claim:
- Ownership. East 14th Street is State Route 185, so if a lane design or pavement defect played a part, the State of California joins the city as a possible defendant, and either one must receive a written claim within six months under Gov. Code §911.2.
- Planned changes. The East Bay Greenway will put a barrier-separated bike lane and transit boarding islands on the corridor, and the city tested a quick-build protected lane for eight weeks before Caltrans repaved.
- Rail crossings elsewhere. Eight at-grade railroad crossings on Marina Boulevard, Washington Avenue and Hesperian Boulevard are queued for upgrades through Alameda CTC’s Rail Safety Enhancement Program (CEQAnet).
The final stretch
When Marco’s doctors say his recovery has plateaued, his lawyer assembles the demand: hospital and clinic bills, the paychecks he lost, a replacement bicycle, and an account of the headaches that followed him for months. If his own carrier and he cannot agree on the value, an arbitrator, not a jury, decides an uninsured motorist dispute under section 11580.2, and that same statute gives him two years from the crash to settle, sue the uninsured driver or formally demand arbitration.
Marco’s lawyer also keeps an eye on these points:
- If police identify the sedan’s driver, Marco has two years under CCP §335.1 to sue that person in the Alameda County Superior Court, which hears civil matters in more than one building; we confirm the right courthouse for a San Leandro filing with the clerk.
- Blame can be divided: were Marco found 15% responsible for riding at dusk without a front light, California’s comparative fault rule would still award him 85% of proven damages (CACI 405).
Representing people hurt in San Leandro
The Law Offices of Jacob Emrani represents San Leandro residents, BART and Tempo riders, and commuters hurt on East 14th Street, Davis Street, Hesperian Boulevard and the I-880 and I-580 corridors. For each San Leandro client we obtain the police or CHP report, pull the trauma chart from Eden or Highland, and check the crash location against the 2022 roadway safety plan and the county’s high-injury network. The work we take on in the city includes:
- Injuries to people on foot, the pedestrian cases San Leandro’s rankings highlight
- Bicycle accidents along East 14th and the Bancroft Avenue corridor
- Hit-and-run claims
- Car accidents on I-880 and I-580
- AC Transit, BART and rail-crossing injuries
- Motorcyclists and big-rig cases
- Uber and Lyft cases
- Falls and dog bites
- Wrongful death cases
Free consultation: Marco would owe us nothing for the first meeting, and nothing at all if his claim produced no recovery, because you pay nothing unless we win. To set up that meeting at home, at Eden or near Bay Fair BART, dial (888) 952-2952, or tell us what happened through the case evaluator or in Spanish at calljacob.com/es.
Questions from San Leandro clients
I was hit on East 14th Street and the driver left. Can I still recover anything?
Usually, through the uninsured motorist benefit on your household’s auto policy, which in California extends to someone on a bike or on foot when the fleeing car actually struck them. A same-night police report protects that benefit, and if the driver is later found, their carrier pays first.
Does it matter that East 14th Street is a state highway?
Only if the road itself helped cause the crash. A design or maintenance problem on State Route 185 can bring Caltrans into the claim alongside the city, and both are public entities with a six-month notice requirement.
I was hurt getting off a Tempo bus. Who is responsible?
That turns on what went wrong. When the bus or its driver caused the fall, AC Transit is the party responsible, and as a public transit district it must receive your written claim within six months, before any lawsuit. Note these details for the claim:
- The Tempo station and direction of travel
- The bus number painted on the front or side
- The time, to match the agency’s own records
My child was hurt riding a bike near school. Are the rules different?
The evidence steps match an adult’s, but a minor’s filing deadlines are computed differently. Five San Leandro cyclists younger than fifteen were killed or injured in 2023, so we review these claims with that in mind.
Marco is a composite, and the San Leandro figures, deadlines and agency details on this page are offered as general information rather than legal advice about any particular crash.
