San Diego Personal Injury Attorney

When the City of San Diego studied ten years of fatal crashes, one pattern stood out. Intersections where a four-lane road on a transit route crosses a two-lane street made up less than 1/30th of the city’s intersections but accounted for about one quarter of fatal intersection crashes (City Systemic Safety Analysis, 2024). Findings like that make the difference between a generic answer and a useful one. The questions below are the ones people most often bring to a San Diego personal injury attorney, grouped by situation and answered with local records.

Intersections on the Fatal Fifteen and city lists

Is the intersection where I was hurt on anyone’s list?

There are two lists to check. The first comes from an advocacy group: Circulate San Diego’s 2017 “Fatal Fifteen” identified the city’s deadliest intersections, concentrated on three corridors (10News):

• El Cajon Boulevard at 46th Street, Altadena Avenue and 60th Street
• University Avenue at Alabama Street, 44th Street and College Avenue
• Mira Mesa Boulevard at Black Mountain Road, Aderman Avenue and Westview Parkway
• Imperial Avenue at 26th Street and Palm Avenue at 16th Street

The second list is official. Each year, the city’s traffic engineers review high-crash locations. The January 2026 review, based on 2024 collision data, prioritized 14 locations, including Imperial Avenue from 53rd Street to Jacinto Drive, Mission Gorge Road from Twain Avenue to Mission Gorge Place, Midway Drive from Kemper Street to Duke Street, Fairmount Avenue from Montezuma Road to Talmadge Canyon Row, Garnet Avenue at Mission Bay Drive in Pacific Beach, Otay Center Drive at Siempre Viva Road, and 8th Avenue at University Avenue (City of San Diego, 2026). The previous year’s review, using 2023 data, identified El Cajon Boulevard from 63rd Street to Choctaw Drive and at Art Street (City of San Diego, 2025).

A location’s appearance on either list does not establish that any driver was negligent. It does show that the city knew the location was dangerous, which matters if the design of the road is part of your claim.

Why do wide roads crossing narrow ones keep appearing?

The city’s report treats these crossings as a priority risk. In our view, the reasons are straightforward: additional lanes create more turning conflicts and longer crossings, and a bus stop at the corner ensures there will be people on foot. KPBS described Palm Avenue in Otay Mesa-Nestor as a high-speed, six-lane road leading toward Imperial Beach (KPBS). If you were struck at an intersection like that, your claim will depend on signal timing, sight lines and the turning driver’s speed. Under AB 413, the city now paints curbs red within 20 feet of crosswalks at priority locations, a practice known as “daylighting,” so a parked van that blocked the view may itself be evidence.

Motorcycles, bicycles and rental scooters

I ride a motorcycle. Is San Diego more dangerous than other large cities?

Compared with its peers, yes. Among California’s 15 largest cities, only three had more motorcyclists injured or killed in 2023 than San Diego’s 349, even though the city ranked 13th of 15 for total victims (4,861) (OTS 2023). Adjusters often begin with the assumption that the rider was speeding. Helmet-camera video, the other driver’s left-turn path and phone records usually carry more weight than that assumption, as our motorcycle accident page explains.

A rental scooter was involved in my crash. Who pays?

That depends on who was careless: the rider, a driver, the scooter company or whoever maintains the pavement. Shared e-scooters are limited to 15 mph citywide, and geofencing slows them to as little as 3 mph on the Mission Beach boardwalk, the Embarcadero, Little Italy’s Piazza della Famiglia and Balboa Park (City shared-mobility rules). My child was hit while riding a bicycle. What should we know?

For riders under 15, the city’s 2023 count of 37 injured or killed was the third-highest among the large cities; across all ages, 380 injured or killed bicyclists ranked it sixth. A child’s own claim generally can wait until age 18, but any settlement requires court approval, and the parents’ claim for medical bills is subject to a shorter deadline. If your child was treated at Rady Children’s, ask its records office for the emergency and trauma notes as well as the billing ledger, because a claim needs both.

Night crashes and drivers who flee

I was walking after dark. Does that hurt my case?

Not on its own. San Diego set out in 2015, under its Vision Zero pledge, to reach zero traffic deaths within a decade. Circulate San Diego’s review of the program’s first ten years found that nearly three-quarters of pedestrian deaths occur after dark and that pedestrian deaths had risen rather than fallen (Circulate San Diego). Drivers must keep a lookout at night as well. Evidence that helps you includes photographs of the street lighting that night, the color of your clothing and the driver’s speed as recorded by the vehicle’s own event data. If the driver’s insurer says you were hard to see on an unlit stretch of University Avenue, that argument goes to your percentage of fault, not to whether you may recover at all (CACI 405).

What if the driver fled and I have no name?

Call SDPD from the scene if you can; the officer’s report number is what your own insurer will ask for first. The same Circulate review found that hit-and-runs accounted for just over one-fifth of pedestrian and cyclist deaths since 2012, and OTS counted 533 injury hit-and-runs in the city in 2023. Your own UM policy can stand in for the unidentified driver, but Insurance Code §11580.2 requires that the fleeing vehicle actually touched you or your car and that police heard about the crash within 24 hours (Ins. Code §11580.2).

Visitors, the Navy and San Ysidro

The driver who hit me was a visitor in a rental car. Where do I start?

San Diego County drew an estimated 32.5 million visitors in 2024 (San Diego Tourism Authority). Insurance on a rental may come from three places: the visitor’s own auto policy, a benefit attached to the credit card used at the counter, or protection bought from the rental company. The adjuster may be across the country, but California law and California courts still govern a crash here. Before the driver leaves, photograph the first page of the rental agreement, the driver’s license and the insurance card; together they identify every policy that may pay.

A driver from the base hit me in a government vehicle. What applies?

Naval Base San Diego on 32nd Street is the largest Navy base on the West Coast, with about 26,000 military, civilian and contract personnel (Wikipedia). If the driver was on duty, the United States is the defendant, and no lawsuit is allowed until a written claim has gone to the agency that employs the driver. That claim is due within two years (28 U.S.C. §2401). An off-duty sailor in a personal pickup leaving 32nd Street is a different case, handled through the sailor’s own insurer.

My crash was near the border crossing. Does that change anything?

The San Ysidro Land Port of Entry is the busiest land border crossing in the Western Hemisphere. In 2019, the federal government counted about 70,000 northbound vehicle passengers and 20,000 pedestrians a day (GSA). A driver insured only in Mexico may carry little or no U.S. liability coverage, which makes your own UM coverage especially important.

Trauma centers, transit claims and filing deadlines

Four Level I trauma programs operate in the city: Scripps Mercy in Hillcrest (Scripps), Scripps Memorial La Jolla, UC San Diego Health’s Hillcrest Medical Center (UCSD) and Rady Children’s, the county’s only pediatric Level I center (County EMS). An injury on the Trolley or an MTS bus is handled differently. The San Diego Trolley’s four lines connect Downtown with East County, UC San Diego, the South Bay and the border (MTS), and MTS is a public agency. An injury on a Trolley car or platform, or in a collision with an MTS bus, begins with a government claim rather than an ordinary insurance claim.

• City streets: the report comes from SDPD. Freeways: CHP San Diego Area, 5902 Kearny Villa Road (CHP).
• An MTS bus or Trolley, or a city-owned vehicle: a government claim within six months (Gov. Code §911.2).
• Anyone else, such as the motorist who caused the crash: a lawsuit generally within two years (CCP §335.1).
• If suit is needed, the court’s Central Division handles it at 330 W. Broadway downtown (San Diego Superior Court).
