San Clemente Personal Injury Attorney

Among 103 California cities of similar size, none had more young cyclists hurt in 2023 than San Clemente. Seventeen riders under 15 were injured or killed that year, and the city held the same first-place position in 2022, with 16 (OTS 2023; OTS 2022). This page sets out that figure and the rest of the city’s crash data, then explains how each number bears on an injury claim. It is written for families, cyclists and drivers who are deciding whether to call a San Clemente personal injury attorney.

Comparing 2022 and 2023

OTS ranks cities within population groups, with rank 1 as the worst result, and it counts crashes on city streets, not freeway collisions handled by the CHP. San Clemente is in Group C.

What the comparison shows

Total injuries and injuries to older cyclists fell between the two years, while the youngest riders stayed at the top of the state list. Whatever improved in that period did not reach children on bicycles.

No pedestrians aged 65 or older were hurt in 2023.

Apart from bicycles, then, San Clemente’s streets compare favorably with those of most similar cities. That contrast can help a claim: an insurer cannot credibly call a child cyclist’s injury an unforeseeable event on streets where the state has identified exactly this risk two years in a row.

The 2023 Local Roadway Safety Plan

The City Council approved a Local Roadway Safety Plan on June 6, 2023; the consultant, Kimley-Horn, had begun work in April 2021. The plan reviewed collisions from 2015 to 2019 and found 7 fatal and 56 severe-injury crashes, about 4.7% of all crashes in those years (San Clemente Times).

The plan identified eight sites for improvement:

• Calle del Cerro, Avenida Pico to Avenida Vista Montana (top priority)
• Avenida Pico, I-5 to San Clemente High School, plus the I-5/Pico interchange
• Avenida Del Mar, El Camino Real to Ola Vista
• El Camino Real, Escalones to Avenida Barcelona, and its crossings at Calle Valle, Avenida Palizada and Esplanade

City staff described these as examples of locations that could be improved, not as admissions that they were hazardous, and we treat them the same way. A listing does not prove the city is liable for your crash, but it gives us a documented starting point when road design is part of the case.

How the data becomes evidence

Rankings do not prove what happened on your street, and no court will treat them as if they did. They matter in three narrower ways:

1. Foreseeability. When a crash raises a road-design question, the city’s own plan and two years of state rankings show that the risk to young riders was documented before your child was hurt.
2. Patterns. Improper turning caused a quarter of the 2015–2019 crashes in the plan’s review, and sideswipes were the most common crash type. If an adjuster calls your account of a turning crash unusual, the city’s figures show otherwise.
3. Seriousness of injury. Only 4.7% of the crashes reviewed were fatal or severe, so a serious injury stands out. We document it with imaging and the treating physicians’ notes rather than leaving it to a summary.

What statistics cannot do

The data cannot replace the evidence from your own collision: photographs, the Sheriff’s diagram, the names of witnesses and the pattern of damage to the vehicles.

E-bikes, parents and responsibility

San Clemente tightened its e-bike ordinance in August and September 2024. It now prohibits passengers, stunts and wheelies, holds parents responsible for their children’s violations and requires sellers to give buyers a copy of the rules. E-bikes were already banned from the beaches, the pier and the coastal trail (Voice of OC). The rules are in Municipal Code Chapter 10.62 (Municode), and a RIDER program allows a minor who has been cited to complete a safety course with a parent instead of paying the fine (City of San Clemente).

Two kinds of claims

The ordinance comes up in two different situations. When a driver hits a child on an e-bike, the insurer will point to any violation of the ordinance, such as carrying a friend on the rear rack. California measures a child’s conduct against what a reasonable child of the same age and experience would do, not against an adult standard (CACI 402), and any fault assigned to the child only reduces the recovery. When a minor on an e-bike injures a pedestrian on Avenida Del Mar, the family’s homeowner’s or renter’s policy is often the coverage that responds.

Watch out: A RIDER citation or a completed safety course is not an admission that your child caused a crash. Keep the paperwork, and have a lawyer review it before an adjuster asks about it.

Crashes at the end of a police pursuit

On March 30, 2026, a stolen U-Haul fleeing sheriff’s deputies at about 80 mph struck an SUV at Ola Vista and Avenida Granada, killing a 53-year-old woman and critically injuring three people (CBS Los Angeles). Families in that situation ask whether the agency that pursued the vehicle can be held responsible.

The governing statute: Vehicle Code §17004.7 gives a public agency immunity from liability for injuries caused by a fleeing driver if the agency has adopted a qualifying pursuit policy and trained its officers on it (leginfo).

Whether that immunity applies depends on the agency’s records, so filing a government claim within six months preserves the option (Gov. Code §911.2). The more reliable sources of payment are the fleeing driver, any insurance on the vehicle and your own uninsured motorist coverage.

Questions about San Clemente crashes

My 13-year-old was hurt on an e-bike. How long do we have?

The child’s own injury claim generally does not expire until two years after the child’s 18th birthday (CCP §352), but a parent’s claim for medical bills and any claim against a public agency have much shorter deadlines. Begin within weeks, not years.

A tourist rear-ended me near the Pier. Does that matter?

Drivers from out of town are fully responsible for crashes they cause here, and rear-end collisions made up 21% of crashes in the city’s five-year review. The practical concern is getting the driver’s insurance information before they leave.

Can an auto accident lawyer help if the Sheriff’s report blames me?

Yes. The report reflects an officer’s opinion, and California law keeps it out of evidence at trial (Veh. Code §20013). Physical evidence and witnesses decide fault.

Police, medical care and the courthouse

Law enforcement

San Clemente contracts with the Orange County Sheriff’s Department for police services, which operates San Clemente Police Services from 910 Calle Negocio (OCSD). Crashes on I-5, PCH and the South County toll roads are handled by the CHP Capistrano Area office in San Juan Capistrano (CHP).

Medical care

Our research found urgent care in town but no verified emergency room. Providence’s Mission Heritage Urgent Care at the Outlets treats minor injuries, and Providence Mission Hospital in Mission Viejo is the nearest state-listed trauma center, at Level II (Providence; EMSA). If a child was seen at urgent care first and later sent to Mission Viejo, both sets of records belong in the claim.

Court

If a lawsuit must be filed, it goes to the Orange County Superior Court, which lists its Santa Ana complex as the location for unlimited civil cases (OC Courts); we confirm the court assignment in each case.
