Rosemead Personal Injury Attorney
Los Angeles County
Seven of the sixteen pedestrians killed or injured on Rosemead streets in 2023 were 65 or older. No more than three of the 103 California cities in Rosemead’s population group recorded a worse figure for older pedestrians, putting the city 4th, where first marks the worst (OTS 2023). Because older walkers are the people most at risk here, Call Jacob, a Rosemead personal injury attorney, has laid out this page as the course one such claim would take, from the crosswalk to a resolution, with the local offices involved at each stage.
Rosemead’s 2023 crash figures
| Category | 2023 count | Rank of 103 |
|---|---|---|
| Pedestrians 65 and older | 7 | 4 |
| All people killed or injured | 195 | 37 |
| All pedestrians | 16 | 36 |
| Motorcyclists | 11 | 38 |
| Nighttime injury crashes | 17 | 40 |
| Hit-and-run injury crashes | 15 | 40 |
| Bicyclists | 11 | 57 |
| Alcohol-involved victims | 10 | 87 |
| Speed-related injury crashes | 5 | 101 |
Speed was rarely recorded as a factor on Rosemead streets, and alcohol figured less than in most comparable cities. The risks show up instead in who was hurt. Earlier fatal crashes on Rosemead Boulevard at Glendon Way in 2015 (CBS LA) and on Temple City Boulevard, where a motorcyclist died that March (CBS LA), are reminders of the risks on the major boulevards. Trucks are routed onto designated streets, including Garvey Avenue, San Gabriel Boulevard and Walnut Grove Avenue (truck route map).
From the crosswalk to the claim
The afternoon of the crash
Hypothetical example. Lan Tran is 71 and lives a few blocks from Valley Boulevard. One weekday afternoon a driver turning left strikes her in a marked crosswalk. She is not a real client; her case is a composite used to show how a Rosemead pedestrian claim moves forward.
Rosemead has no city police department. Patrol and traffic investigation come from the Los Angeles County Sheriff’s Department’s Temple Station in Temple City, while fire and rescue are provided by LA County Fire and ambulance transport by American Medical Response (Rosemead overview). The deputy who arrives at Lan’s crosswalk writes the collision report, so her family asks for the deputy’s name and the report number before the ambulance leaves.
Where she goes next depends on how badly she is hurt. Rosemead has no designated trauma center. The state’s list places an adult Level I center at Los Angeles General Medical Center and an adult Level II center at Huntington Memorial Hospital in Pasadena (EMSA). Paramedics decide based on her injuries.
Before the night is over, her daughter has gathered evidence no one could recreate a month later:
- She photographs the intersection and the signal from her mother’s direction of travel.
- She asks two shopkeepers who saw the turn how to reach them again.
- She notes which storefronts have cameras pointed at the street.
The first two weeks
In this example Lan has a fractured hip and a fractured wrist, and her treatment produces records at every step: the ambulance run sheet, the emergency department chart, imaging, the surgeon’s notes and the discharge plan. Her family requests each of them as they are created rather than waiting months.
Getting to follow-up appointments is a practical problem once she can no longer drive. The city’s Rosemead GO and GO+ services and Access Services paratransit are options (City of Rosemead transportation), and the cost of rides, home help and equipment such as a walker becomes part of her claim.
Watch out: Within days, an adjuster for the driver’s carrier phones Lan’s daughter, courteous and eager to record Lan’s account. The family declines and refers the call to her lawyer, because an older person on pain medication describing a crash she barely remembers is exactly the statement an insurer later uses against her.
The report and the evidence
Lan’s report is a Sheriff’s document, released through Temple Station on the Sheriff’s timetable, which can stretch to several weeks. If her crash had happened on the I-10, the report would come from the California Highway Patrol instead: the CHP’s East Los Angeles Area patrols that freeway and serves the unincorporated pockets inside Rosemead (CHP Area 535). That division is real; in October 2025 a 30-year-old man on foot was struck and killed on the eastbound 10 in Rosemead, west of Rosemead Boulevard, and the CHP reported the crash (The Eastsider).
Video is the evidence most often lost. Valley Boulevard and Garvey Avenue are lined with shopping centers, and their cameras overwrite footage on a cycle measured in days or weeks. A preservation letter sent in the first week is far more useful than a request sent after the report arrives.
Language is another piece of the evidence. In 2020, 64.0% of Rosemead residents were Asian and 31.1% Hispanic or Latino, and Vietnam and Mexico were the most common places of birth among those born abroad (Rosemead overview). Witnesses and injured people often speak Vietnamese, Cantonese, Mandarin or Spanish, and a statement taken through a qualified interpreter is more accurate and harder for an insurer to challenge.
From demand to resolution
Measuring the losses
Lan’s claim includes her medical bills, the cost of help at home, transportation and the pain, fear and loss of independence she lives with. If she were still working, lost wages would count too. Rosemead is also a place of work: Edison International’s headquarters employs 2,722 people locally and Panda Restaurant Group another 647 (Rosemead overview).
If she is on Medicare, the program will have paid many of her bills and is entitled to be repaid from any settlement. Her lawyer confirms the amount Medicare claims and negotiates it before the case closes, because an unresolved lien can delay her money for months.
Negotiating with the insurer
When treatment has stabilized, her lawyer sends the driver’s insurer a demand package containing:
- The Sheriff’s collision report and the shopkeepers’ statements
- Her daughter’s photographs and any preserved store video
- Hospital, surgical and therapy charts, with an itemized bill for each
- A description, in Lan’s words through an interpreter, of how her days have changed
A typical first response is to argue that she was partly at fault, perhaps by starting across late in the signal cycle.
California handles that argument through comparative fault. Were a jury to assign Lan one-tenth of the blame for stepping off the curb late, the rule would cut her award by that tenth and no more (CACI 405). When the turning driver carries only a minimum policy, the underinsured motorist coverage on a household auto policy, perhaps her daughter’s, may pay the difference.
Most claims resolve at this stage. Some do not.
If a lawsuit is filed
The two-year statute in CCP §335.1 runs from the afternoon of the crash, so a Rosemead pedestrian claim that has not settled by then must already be in court. If a public agency shares responsibility, such as the city for a signal or crosswalk it controls or the county for a stretch of road it maintains, a written claim must be presented within six months first (Gov. Code §911.2). Rosemead’s five-member Traffic Commission meets monthly to advise the City Council on traffic regulation (Traffic Commission), and its agendas and minutes are public records worth checking in a road-design case.
Lan’s lawsuit would be heard by the Los Angeles County Superior Court, and the court’s 2024 general order assigns injury cases by the district in which the incident happened (LASC General Order), so the Valley Boulevard crash location, not her home address, decides the courthouse; because Rosemead lies near the boundary of more than one district, we confirm the assignment with the court before filing.
How Call Jacob handles Rosemead cases
We represent Rosemead residents and families hurt on Valley Boulevard, Garvey Avenue, Rosemead Boulevard and the I-10, with particular attention to older pedestrians, whose claims the city’s data shows are unusually common here. On a Rosemead case we request the report from the Sheriff’s Temple Station or the CHP’s East Los Angeles Area, gather records from LA General, Huntington or wherever treatment took place, and arrange interpreters for clients and witnesses who are more comfortable in another language.
The Rosemead cases we handle include:
- Pedestrian accidents, especially older walkers on Valley Boulevard and Garvey Avenue
- Car accidents on the boulevards and the I-10
- Truck collisions on Rosemead’s designated truck routes
- Motorcycle and bicycle crashes, including on Temple City Boulevard
- Uber and Lyft crashes
- Falls and dog bites
- Wrongful death cases
No fee unless we win. A consultation about a Rosemead injury is free, and we can come to you at home, at Huntington or at LA General. Families can phone (888) 952-2952 or describe the crash through the case evaluator, and Spanish-speaking relatives will find help at calljacob.com/es.
Questions families ask
My grandmother was hit and the report came from Temple City. Is that right?
Yes. Rosemead has no police department of its own; deputies from the Sheriff’s Temple Station handle patrol and crash reports, so a Valley Boulevard report is a Sheriff’s record even though the station sits in the next city.
She doesn’t speak much English. Will that hurt her claim?
It should not. Statements and medical histories should be taken through a qualified interpreter, and we arrange that for clients and witnesses. Misunderstandings in an English-only statement can become a source of insurer disputes.
Medicare paid her hospital bills. Does she have to pay that back?
Medicare is generally entitled to repayment from a settlement for the bills it paid that relate to the crash. The amount is often negotiable, and resolving it is part of closing the case.
How long does a claim like this take?
It depends mainly on medical recovery. A case usually cannot be valued until treatment has stabilized, which for a hip fracture in an older adult often means many months.
General information, not legal advice: Lan is a composite, and your own crash on a Rosemead street deserves its own review.
