Left-turn crashes and shared fault

Adjusters for the oncoming driver favor this line, and it sounds like common sense. It is only half right.

What the adjuster says	“Our driver had the green. Your client turned in front of him. Case closed.”
What the law says	Vehicle Code §21801 requires a driver turning left to yield to oncoming traffic close enough to be a hazard (California Legislative Information). The oncoming driver, however, must still obey the basic speed law, and California’s pure comparative fault rule divides the loss when both drivers contributed.
What Riverside’s records show	Improper turning was the leading collision factor in the city (28.3%), and unsafe speed was second (19.2%). The two often appear together at the same intersections.

Van Buren Boulevard illustrates the point. It appears eight times on the plan’s list of the 20 most dangerous signalized intersections. At Arlington Avenue alone there were 103 crashes and 3 deaths during the five-year study, and at Jurupa Avenue there were 80 crashes and 3 deaths (Riverside LRSP). Consider a hypothetical: an oncoming pickup traveling 55 mph in a 45 zone strikes a turning sedan at Van Buren and Arlington. The sedan driver’s failure to yield and the pickup driver’s speed would both be weighed, and the evidence would determine each driver’s percentage of fault.

Proving who had the red light

What the adjuster says	“It’s your word against his. We’ll call it 50/50.”
What the law says	Fault is proven with evidence; it is not split by default. Signal timing plans, video and physical evidence at the point of impact carry more weight than conflicting memories.
What Riverside’s records show	From 2017 to 2022, crashes divided almost evenly between intersections with a traffic signal (45%) and intersections with only stop signs or no control at all (39%).

The most dangerous signalized intersection in the city is Tyler Street and Magnolia Avenue, with 147 crashes, 2 deaths and 2 serious injuries over the plan’s five years. Magnolia also has top-20 intersections at La Sierra Avenue and Pierce Street, and near UC Riverside, Iowa Avenue at West Blaine Street ranked second, with 105 crashes and one death. Intersections this busy are watched by business cameras, traffic cameras and other drivers’ dashcams, but that footage is eventually recorded over. A preservation letter sent in the first week can turn “your word against his” into video evidence.

Tip: Ask the officer whether the report lists independent witnesses. At a crowded intersection like Tyler and Magnolia, one uninvolved driver who says the light was red can outweigh both drivers’ accounts.

Container trucks on the 60 and 91

What the adjuster says	“Our insured driver has a policy. We’ll handle it like any other claim.”
What the law says	Commercial trucks are subject to federal rules on hours of service, inspections and driver qualification. Liability can extend beyond the driver to the carrier that employs him, the company that loaded the container and whoever last serviced the brakes.
What Riverside’s records show	The SR-60/I-215 interchange is severely congested and increasingly used by container trucks traveling between the Los Angeles–Long Beach ports and Inland Empire warehouses (Wikipedia). SR-91 carries more than 280,000 vehicles a day at the county line (RCTC).

Freeway crashes in Riverside are investigated by the CHP Riverside Area office at 8118 Lincoln Avenue (CHP). Driver logs and the truck’s electronic data are not kept indefinitely, so the request for them must go out early. Drunk-driving cases and restitution

What the adjuster says	“The DA is prosecuting. Restitution will take care of it.”
What the law says	A criminal case punishes the driver; restitution orders are limited and difficult to collect. Your civil claim for medical costs, lost wages and pain and suffering proceeds separately against the driver’s insurance, with its own two-year deadline (CCP §335.1).
What Riverside’s records show	Impaired driving was a factor in 31.6% of fatal and serious-injury crashes in Riverside, compared with 23.5% statewide (2016–2018 data). OTS counted 159 alcohol-involved victims in 2023, sixth-worst in the group, and 12 victims of drivers under 21 who had been drinking, fifth-worst (OTS).

Do not wait for the criminal case to end before starting the civil claim. Prosecutions take months, and the civil deadline continues to run.

The six-month rule for RTA, UC and City Hall

What the adjuster says	“There’s no rush on your end. Take your time recovering.”
What the law says	The two-year deadline applies to claims against private parties. A bus, university vehicle or city street brings in a different rule: the Riverside Transit Agency, UC or the city must have your written claim in hand within six months (Gov. Code §911.2).
What Riverside’s records show	Public vehicles and public roads are everywhere here. The Riverside Transit Agency serves about 2,500 square miles of the western county (RTA), and the University of California, a public entity, operates the campus beside Iowa Avenue.

A student struck by a university vehicle near Iowa and Blaine, a passenger hurt when an RTA bus brakes hard on Magnolia and a driver whose car is damaged by a pothole on a city street all face the six-month rule. Injuries to people on foot or bicycle

What the adjuster says	“Your client wasn’t in a car, so there’s no real vehicle damage. This is a small claim.”
What the law says	Damages are measured by the injury, not by damage to a vehicle. A pedestrian with a fractured pelvis has a larger claim than a driver with a dented bumper.
What Riverside’s records show	The plan’s five-year data include 509 pedestrian crashes, 21 of them fatal and 62 severe, and 354 cyclist crashes, with 4 deaths and 25 severe injuries. The stretch of Mission Inn Avenue from Redwood Drive to Scout Lane had 22 crashes, one death and two serious injuries, and 11 of those crashes occurred after dark.

Which trauma center’s records matter?

Riverside Community Hospital was the first hospital in the county to receive Level I designation from the local EMS agency (ABC7). East of the city, the county-run RUHS medical center is verified by the American College of Surgeons as a Level I trauma center for adults and Level II for children (RUHS). The ambulance records matter as much as the hospital chart.

The driver who hit me drove off. What now?

In 2023, drivers left the scene of 185 crashes in Riverside that injured or killed someone, which ranked the city 7th of 15 (OTS). Your own uninsured motorist coverage can apply if the car made contact with you and you reported the crash promptly.

Does a Riverside police report count for more than a CHP report?

Neither does. The Riverside Police Department reports on city streets and the CHP on freeways, and in either case the report is a starting point, not the final word on fault.
