Paso Robles Personal Injury Attorney
San Luis Obispo County
Paso Robles officers arrested 293 people for drunk or drugged driving in 2023, and no other city among the 93 in its OTS population group arrested as many (OTS 2023). That figure measures how hard officers enforce, not how severe crashes are, yet it says something about the streets of this North County wine town of 31,626 (Census 2025 estimate). For someone hurt here, the choices made between the crash and the end of the third day shape the whole claim, and a Paso Robles personal injury attorney will ask about each of them. The timeline below follows those first 72 hours and the month after.
| When | What happens in Paso Robles | Office involved |
|---|---|---|
| At the scene | Niblick, Spring or Creston crash goes to city police; US-101 or Highway 46 goes to the Highway Patrol | Paso Robles PD or CHP |
| First hours | Serious injuries go to the county’s single trauma center | Sierra Vista, San Luis Obispo |
| By day 3 | Report number, scene photos, video requests, witness names | Records unit |
| Week 1 | Adjuster calls; DUI or hit-and-run coverage questions | Insurers |
| Month 1 | Records in hand; any Caltrans or City claim drafted | Public agencies |
The scene, from Niblick Road to Highway 46
City officers investigate collisions on Paso Robles streets, including the Niblick Road, Spring Street and Creston Road corridors the city’s safety plan ranks highest. The state highways are another matter: OTS leaves crashes the CHP handled on US-101 and State Route 46 out of the city’s totals, which tells you the Highway Patrol is usually the investigating agency there. The North County CHP office is the Templeton Area on Duncan Road in Templeton, and the card handed to you at the scene confirms which agency has the file.
Ten Paso Robles injury crashes in 2023 were hit-and-runs, enough to rank the city 30th in its peer group. When the other car drives off, call it in from the scene and give the officer the color, make, damage and direction of travel; a late report gives your own uninsured motorist carrier a reason to question the claim.
Watch out: If the other driver slurred words or smelled of alcohol, say so to the officer before you leave Spring Street or Niblick Road. An arrest creates its own file, separate from the collision report, and in a city with 293 DUI arrests a year that file is often the strongest proof of fault.
Sierra Vista and early treatment
No Paso Robles hospital appears on EMSA’s trauma list, and for the whole county the state names only Level III Sierra Vista Regional Medical Center, so a badly hurt North County patient is transported to San Luis Obispo (EMSA, August 2025). A driver pulled from a Highway 46 head-on may make that trip down US-101.
People who walk away from a Niblick Road rear-end often wake up a day or two later with a stiff neck or a headache that will not lift. See a doctor then, not a week later. The adjuster handling a Paso Robles claim will compare the crash date with your first appointment, and every day between them becomes an argument that the injury was minor or came from something else.
By the third day
- Phone the Paso Robles Police Department at 805-237-6464, or the CHP office printed on your card, with the incident number and the Niblick, Spring or Creston cross street.
- Photograph the signal heads, lane markings and left-turn pockets, which the city plan identifies as the setting for many of its worst intersection crashes.
- Walk into the stores and offices facing the Niblick or Spring intersection and ask whoever manages their cameras to preserve that day’s recording.
- Keep a list of everyone who stopped to help, with phone numbers, since a Wine Fest visitor or Fair-goer may be back home in another county by the weekend.
- Hold off on body-shop repairs until the car’s damage is documented from all four corners.
The safety plan explains why the intersection matters so much. Using five years of collision data from 2015 through 2019, GHD’s Local Roadway Safety Plan, finalized for the city on May 18, 2021, ranked the worst intersections (Paso Robles LRSP):
| Intersection | 2015–19 | Pattern |
|---|---|---|
| Niblick & River | 50 | Unsafe-speed rear-ends, red-light running |
| Spring & Niblick | 46 | Rear-ends, left-turn yield failures, Caltrans ramps |
| Spring & 24th | 38 | Turning drivers clipping signal poles; left-turn conflicts |
| Creston & River | 31 | |
| Niblick & Creston | 30 |
Riverside Avenue at 13th Street (23), 24th Street at Riverside Avenue (22), Spring Street at 6th Street (20), Creston Road at Golden Hill Road (19) and Niblick Road at Rambouillet Road (17) round out the plan’s top ten. Spring Street at Niblick Road is where a Paso Robles woman died in a two-car collision on April 30, 2020 (CalCoastNews).
DUI, Highway 46 and venue questions
Does the city’s DUI arrest ranking help my case?
Not by itself. OTS ranks Paso Robles 93rd of 93 for DUI arrests because first place in that category goes to the city making the fewest, so the ranking speaks to police activity. Your case needs proof about the driver who hit you, such as the arrest report, the chemical test and witness statements.
Where the ranking does matter is in what it says about local priorities. The city’s 2021 safety plan lists impaired driving as its second emphasis area, so impaired driving is a stated local priority; if an officer suspected DUI at your crash, ask whether a separate arrest report exists and request it too.
Which agency investigates a Highway 46 collision?
Normally the Highway Patrol. If your card says Templeton Area, send the request to the Duncan Road office rather than to the Paso Robles Police Department.
Is a lawsuit filed on Park Street or Monterey Street?
The county court lists civil filings under its Civil & Family Law Branch at 1050 Monterey Street in San Luis Obispo. A Paso Robles Branch sits at 901 Park Street, but the court’s location page does not say which cases it hears (SLO Superior Court), so we verify before filing anything.
- Civil & Family Law Branch: 1050 Monterey Street, Room 220, San Luis Obispo
- Paso Robles Branch: 901 Park Street, case types not listed by the court
I was a pedestrian hit downtown. Is that common here?
Downtown and along Spring Street, nine people on foot were struck in 2023, including one child under 15, a total in the middle of the 93-city group at 43rd. Those claims tend to hinge on signal timing and how visible the crosswalk was, so photos taken at the same hour of the day help.
Can I still recover if I was partly at fault?
Yes. Under CACI 405, a jury that puts 10% of the blame for a River Road collision on you cuts the award by a tenth and leaves the rest.
Our Paso Robles practice
We represent Oak Park and east-side residents, vineyard workers who commute from Santa Maria, Cuesta College North County students, and visitors in town for wineries or the Mid-State Fair. On each Paso Robles case, we order the city police or Templeton Area report, check the crash site against GHD’s ranked intersections, and pursue the arrest file whenever the other driver was impaired.
Collisions on Niblick Road, Spring Street and Highway 46 make up most of our work as a Paso Robles car accident attorney, from car accidents at signals to head-on and truck accidents on Blood Alley. Downtown pedestrian accidents, cyclists and motorcyclists, rideshare and tour-van passengers, slip-and-fall injuries at tasting rooms and shops, dog bites, and wrongful death after a fatal DUI crash are part of it too.
A conversation with us about a Niblick Road or Highway 46 crash is free, whether it happens at your kitchen table in Oak Park or at Sierra Vista, and if we take the case, you pay nothing unless we win. Our line is (888) 952-2952. If you would rather type than talk, describe the Niblick Road or Highway 46 crash in the case evaluator; vineyard crews and their families can read about us in Spanish at calljacob.com/es.
The first week and the insurer’s call
Somewhere around day four or five, an adjuster for the other driver tends to call, friendly and quick to ask whether the conversation can be recorded. Decline politely and give the adjuster your lawyer’s name; nothing obliges you to describe your injuries before a doctor has.
Use the same week to read your own policy. Alcohol was a factor for 15 of the people hurt or killed on city streets in 2023 (OTS 2023), and two of the OTS categories point at teenage and young-adult drinkers: 2 victims of under-21 drivers, 15th of 93, and 8 of drinking drivers aged 21 to 34. If that driver fled or was drunk, there may be only a minimum policy or none at all behind them, and your UM and UIM limits then decide how much is available.
Wine country adds its own wrinkles. The California Mid-State Fair runs 12 days each July, Paso Wine Fest comes in May and harvest events fill October (Paso Robles); if a rideshare, a winery tour van or an event shuttle was part of the crash, each one has its own policy to put on notice.
Month one and the deadlines ahead
By the end of the first month, these should be requested or in hand:
- Everything Sierra Vista generated, from the trauma bay notes to the itemized hospital bill
- Records from any North County clinic, physical therapist or chiropractor seen afterward
- The arrest report and chemical test results, if a DUI was charged
- Wage statements covering harvest or Fair-season shifts you could not work
Highway 46 and public roads
Highway 46 is where the public-road question comes up most. The two-lane stretch east toward Cholame, known as “Blood Alley,” recorded 206 crashes and 17 deaths from 1994 to 1999 and 38 more deaths from 2000 to 2010; widening continues, and an interchange at the James Dean Memorial Junction with SR-41 was scheduled for 2026 (SR-46). An early-morning crash on Highway 46 near US-101 killed one person on August 5, 2025 (CalCoastNews). When road design or upkeep on the highway, a city street or the Caltrans-shared ramps at Spring and Niblick played a part, the responsible agency is owed a written government claim within six months (Gov. Code §911.2).
Against another driver, the two-year statute in CCP §335.1 generally controls, which feels distant in week four but passes quickly once treatment is under way.
Speed, the plan’s leading factor
| GHD finding, 2015–2019 | Figure |
|---|---|
| Speeding as primary factor | About 33% |
| Distraction or impairment | 20% |
| Speeding tickets a year | 574 average |
| Impaired drivers booked yearly | 176 average; 240 in 2019 |
| Injury collisions | 91 in 2015; 52 in 2019 |
| Fatal collisions | 6 |
Speeding tops the plan’s list of causes, and its citation and arrest counts show the police department pressing on both speed and impairment; the plan named DUI its second emphasis area under a goal of eliminating traffic deaths and severe injuries. The injury trend was moving the right way by 2019, but six collisions over those five years still took a life, and the plan found those speeding crashes concentrated on Niblick Road and Spring Street.
