Paradise Personal Injury Attorney

Paradise has no hospital. Adventist Health Feather River, the ridge’s hospital, closed after the 2018 Camp Fire and has no plans to reopen (Wikipedia), so anyone injured on the Skyway or Pentz Road is taken down the hill for treatment. That fact affects every injury claim in a town of 10,023 people (Census) that is still rebuilding its roads. It is also where a Paradise personal injury attorney begins: with the route, the ambulance transport and the records that follow.

State figures for a town this small vary from year to year, but they are not reassuring. In 2023 the Office of Traffic Safety counted 54 people killed or injured in Paradise, 16th of 103 small cities in its group, where 1 is worst. On foot, the town’s youngest residents fared worst: two pedestrians under 15 were hurt, a total only two other towns in the group exceeded (OTS). Because the population fell from 26,218 in 2010 to 4,764 in 2020 and has since roughly doubled, per-capita crash rates would be misleading, and we do not use them.

The main roads on the ridge

The Skyway

The Skyway is Paradise’s primary route to and from Chico. The Town’s upper Skyway project adds a center turn lane, wider shoulders where disabled vehicles can pull over, and a multi-use path that can serve as an evacuation lane (Town of Paradise). Until that work is complete, a stalled car or a truck waiting to turn left can block a lane with nowhere for following traffic to go.

Hypothetical example: A driver heading downhill at dusk rear-ends a contractor’s pickup that is slowing to turn near Wagstaff Road. The pickup belongs to a rebuilding crew, so its commercial auto policy, not only the at-fault driver’s personal coverage, may apply. The injured driver is taken to Chico, and the claim begins with that hospital’s records and the report from whichever agency responded.

Identifying that agency is less simple than it sounds. On the ridge, the responding officer may work for the Paradise Police Department or for the Highway Patrol, which keeps area offices in both Chico and Oroville (CHP). Ask the officer which office will hold the report, and write the answer down.

Pentz Road

Pentz Road runs from the Skyway to Pearson Road and is the town’s other primary route. The $26 million widening project adds a center turn lane, shoulders and a separated Class I path, and the Town states that its purpose is to improve evacuation efficiency (Town of Paradise).

Construction zones complicate questions of fault. Narrowed lanes, flaggers, temporary signs and fresh pavement edges can each contribute to a crash. When the Town ran the project, its share of responsibility must be raised in a written government claim, generally within six months (Gov. Code §911.2). Photograph the work zone as it appeared that day, because crews rearrange it often.

Clark, Pearson and Neal roads

Clark Road, part of Highway 191, connects Paradise to Oroville and was one of the main evacuation routes during the Camp Fire (Wikipedia). The Town’s 2021 evacuation-route workshop identified Pearson Road and Neal Road, along with downtown Skyway and Pentz Road, as existing evacuation routes (Town of Paradise). The Neal Road Gateway project was moving toward construction in September 2026, with public drop-in sessions held September 15 and 16 (Town of Paradise).

Rebuilding traffic uses all of these roads. By November 2023, more than 9,000 residents had returned and more than 2,500 new structures had been built, and the Town has published PG&E traffic-control plans for utility and road rehabilitation work (Wikipedia). Contractor and utility vehicles now share the ridge with returning residents. Speed was a factor in 11 of the town’s 2023 injury crashes, a figure that ranked Paradise 17th, and seven motorcyclists were among the injured (24th).

Watch out: Crashes involving construction or utility vehicles often involve a subcontractor working for a larger company. Before the vehicle leaves, write down any company name on the door or tailgate and the truck number.

Edgewood and the 2018 evacuation

The Camp Fire began on November 8, 2018. It killed 85 people, destroyed 18,804 structures and forced the evacuation of about 52,000 people. The roads out of Paradise could move only about a quarter of the population within two hours; traffic jams led people to abandon their cars and flee on foot, and most of the deaths in vehicles occurred around Edgewood, where at least seven people were trapped in their cars (Wikipedia). The fire was caused by the failure of a metal hook on PG&E’s Caribou–Palermo transmission line.

Questions from Paradise residents

A construction truck hit me on Pentz Road. Who pays?

Usually the truck owner’s commercial insurer, and possibly the general contractor or the company that set up the work zone. If the Town or another public agency ran the project, the six-month government claim must be filed first.

I was hurt in a crash while evacuating. Is that a car accident claim or a fire claim?

It can be both. A rear-end collision in a smoky line of traffic on the Skyway is the responsibility of the driver who caused it, while burns from the fire itself point toward the company or person that started the fire.

Our eight-year-old was struck while walking on a ridge road. Is that unusual in Paradise?

Two children under 15 were injured while walking in 2023, which ranked Paradise 3rd of 103 small cities. A child has additional time to bring his own lawsuit, but the parents’ claim for medical expenses and any claim against a public agency remain subject to the ordinary deadlines.

Will I have to go to Chico for court?

Only if a lawsuit is filed and a hearing requires your attendance, and most claims resolve without one. If you are needed, the trip is to Chico, which is also where many ridge residents already go for medical care.

Medical care and records from off the ridge

With Feather River Hospital closed, injured residents are treated elsewhere. Enloe Medical Center in Chico, about 10 miles away, is the regional hospital (Enloe). Every ambulance transport, emergency room visit and follow-up appointment in Chico or elsewhere produces records on which your claim will depend.

After a crash on the ridge:

1. Request the ambulance run report as well as the hospital record; the transport time is part of the account.
2. Keep receipts and a mileage log for every trip down the hill for treatment. Transportation costs are part of your damages.
3. Record missed work, including days lost to long medical trips, for your lost-wages claim.
4. Request the collision report from the agency whose officer came to the scene, whether the Paradise Police Department or the CHP.

Traffic enforcement on the ridge

The Paradise Police Department received a $40,000 OTS grant for October 2024 through September 2025 to fund DUI saturation patrols, hands-free enforcement and bicycle and pedestrian safety operations (Paradise PD). In 2023, alcohol was involved in injuries to six people in town, a ranking of 28th.

Deadlines, court and cost

A Paradise lawsuit would be heard off the ridge, at the North Butte County Courthouse, 1775 Concord Avenue in Chico (Butte Superior Court). A lawsuit against a private driver generally must be filed within two years (CCP §335.1), while a claim against the Town, the county or a public transit operator such as B-Line begins with the six-month written claim. A person who was partly at fault can still recover, reduced by his or her share of responsibility (CACI 405).
