Pacific Grove Personal Injury Attorney

Monterey County

Four of the six people struck on foot in Pacific Grove in 2023 were 65 or older. For this city of 14,659 (Census 2025), that put the older-pedestrian row at 1st of 103 in the Office of Traffic Safety’s comparison of similar-size cities, the worst result in the group and the city’s worst showing in any category (OTS 2023). For a Pacific Grove personal injury attorney, one of those crashes unfolds as a run of stages that each lead to a different local office or record, from the downtown police station to Medicare. The story below is invented, while the streets, agencies and rules in it are real.

How one Pacific Grove claim unfolds

Hypothetical example: Ruth, 74, has lived near Lovers Point for twenty years. On a Saturday afternoon in early October, the week of the Butterfly Parade, she is crossing Lighthouse Avenue downtown when a visitor in a rental car, looking for parking, turns into the crosswalk and strikes her. She is taken by ambulance from the scene with a broken hip and a head injury.

At the Lighthouse Avenue crosswalk

Because Lighthouse Avenue is a city street, a Pacific Grove police officer writes the collision report, not the Highway Patrol (Pacific Grove Police), and Ruth’s daughter leaves the scene with the incident number plus phone numbers for the bookstore clerk and café owner who watched the rental car turn.

Lighthouse Avenue is the city’s historic commercial street (Pacific Grove overview), and that helps Ruth’s family in the first week. Before anything else, they gather:

  • footage requests to the storefronts and restaurants facing the crosswalk, since most systems record over within days
  • photographs of the crosswalk striping, the parking spaces the driver was eyeing and any parade-week detour signs
  • the rental company’s name and the car’s plate, taken from the officer’s exchange form

Visitors are a steady part of the traffic. The Monarch Grove Sanctuary, Asilomar, Point Pinos Lighthouse, Lovers Point and the Marine Gardens draw people onto residential streets, and TAMC’s 2026 Regional Vision Zero plan names unfamiliar drivers and distracted sightseeing among the safety challenges of the coast (TAMC regional plan).

Emergency care and rehabilitation

With a broken hip and a blow to the head, Ruth’s care may involve Natividad Medical Center in Salinas, a Level II facility and the one Monterey County hospital on the EMSA trauma roster (EMSA). Wherever she is treated, the emergency notes, imaging, surgery report and discharge plan become the core of the claim.

For an older client, recovery is often where the case is decided. A hip fracture at 74 brings costs that a younger patient might not face, and each belongs in Ruth’s damages:

  1. a stay in a skilled nursing facility once the surgeons release her from the hospital
  2. months of physical therapy, and perhaps a walker or home modifications
  3. paid help at home for errands she used to do herself
  4. pain and suffering, and the loss of the daily walks to Lovers Point she took before the crash

Her age does not reduce what she is entitled to recover.

The insurers and Medicare

Ruth’s bodily injury claim goes first to the visiting driver’s personal auto carrier, and since the car came from a rental counter, we also pull the rental contract to see what liability coverage the driver bought with it. If the driver’s coverage is too small for the injury, Ruth’s own underinsured motorist (UIM) coverage, if she carries it on her car, can add to it, even though she was walking.

Medicare raises one more question. When Medicare has paid for hospital care or rehabilitation after an injury caused by someone else, it expects repayment from the settlement, and that medical lien has to be resolved before the money is released to Ruth.

Watch out: Expect a call from the rental driver’s adjuster while Ruth is still in rehab, asking her to describe on tape exactly where in the Lighthouse Avenue crosswalk she was; her family can politely refuse and give the adjuster her lawyer’s number.

Whether the street played a part

Ruth’s crash was in a marked crosswalk on a city street, so the question is mainly the driver’s attention. Other Pacific Grove crashes raise a public-agency question:

RoadOwner
Forest and Sunset (SR-68)Caltrans
Lighthouse and city streetsCity

State Route 68 runs into Pacific Grove as Forest Avenue and then Sunset Drive to Asilomar. TAMC, the city and Caltrans have studied that route with a $150,000 Caltrans planning grant, aiming for safer access for pedestrians, cyclists and drivers of all ages (TAMC SR-68 study). Pacific Grove is also one of the few Monterey County agencies with municipal codes or design guidelines that build in Complete Streets principles, according to TAMC. A claim that a broken curb ramp on Sunset Drive or a faded crosswalk on Lighthouse Avenue helped cause the crash runs on a separate, faster track, because Caltrans or City Hall must receive it in writing within six months (Gov. Code §911.2).

When Ruth’s claim resolves

Most claims like Ruth’s are resolved by negotiation once her treatment has stabilized and her future care can be estimated. If the rental driver’s insurer refuses a fair number, Ruth’s lawsuit has to be on file before the two-year statute of limitations runs out (CCP §335.1). Suppose the rental driver insists Ruth left the curb against the walk signal; a jury that believed him in part could knock her award down by her percentage of blame under pure comparative fault, but could not zero it out (CACI 405).

If it came to that, Ruth would not travel far: Local Rule 6.2(B) assigns civil trials to 1200 Aguajito Road, a short drive from Pacific Grove (Local Rules).

Pacific Grove’s other OTS rows

Away from the 65-and-older row, most of Pacific Grove’s 2023 placements fall in the middle or lower half of its Group E peers, with pedestrians overall the exception at 19th:

RowCountRank
Composite74
All victims3752
Pedestrians619
Bicyclists434
Speed48
Nighttime82
Hit-and-run73

Seventeen DUI arrests earned a 34th, in the one category OTS scores in reverse, so that number reflects enforcement and not risk.

Event days add their own risk. Besides the Butterfly Parade in early October, the city holds the Good Old Days festival with a parade in mid-April and a pet parade on the last Saturday of July (Pacific Grove overview). Crowds, closed streets and drivers unfamiliar with the detours all come together on those days.

Representing Lighthouse Avenue and Asilomar crash victims

The Law Offices of Jacob Emrani (Call Jacob) represents Pacific Grove residents and visitors hurt on Lighthouse Avenue, Forest Avenue, Sunset Drive, the roads near Asilomar and the 17-Mile Drive approaches. On a Pacific Grove case we request the Pacific Grove Police Department report, send preservation letters to Lighthouse Avenue businesses with cameras, and check whether the crash site falls on the SR-68 portion that the State maintains.

Because the city’s numbers point to older pedestrians, much of our work here involves pedestrian accidents and the Medicare and rehabilitation issues that come with them. Beyond that, we handle car accidents on Forest Avenue, bicycle accidents and car-door strikes on the streets near Asilomar, motorcyclists on the 17-Mile Drive approaches, Uber and Lyft riders, guests who fall at downtown inns, dog bites and wrongful death claims.

Families can sit down with a Pacific Grove car accident lawyer to go over the Lighthouse or Forest Avenue report and the rehab bills free of charge; reach us at (888) 952-2952 or through the case evaluator. On our contingency fee nothing is owed unless we win, and for clients like Ruth we visit the rehabilitation center or the house near Lovers Point rather than asking them to travel.

Pacific Grove questions about older pedestrians

Dad is 81 and was struck on Forest Avenue. Does his age lower the value?

No. A fractured pelvis heals more slowly at 81 than at 41, and the months of therapy, the help he now needs at home and the walks he can no longer take are all part of what he recovers.

Watch out: Forest Avenue is the SR-68 stretch of road, so if a curb, signal or crossing there contributed, the six-month State claim deadline is already running.

The driver was a tourist who went home to another state. Can we still pursue the claim?

Yes. Leaving California does not take the visitor’s insurer out of the picture, and any lawsuit stays in Monterey County because that is where the Pacific Grove crash occurred.

Will Medicare take part of the settlement?

Yes, to the extent Medicare covered crash-related care at the hospital, a skilled nursing stay or outpatient therapy; we confirm the final lien amount and negotiate it before the balance of the Pacific Grove settlement is paid out.

I was cycling near Asilomar and a sightseeing driver opened a door into me. Who pays?

Whoever swung the door open, through the auto liability coverage on that car. Before the sightseers drive on, photograph:

  • the plate and the open door
  • your bike and helmet
  • the spot where you went down

Ruth’s story is invented for illustration; the rest of the page summarizes Pacific Grove data and state rules as general information, never as legal advice.
