Speed on Coast Highway and the arterials

“A ticket has nothing to do with my claim.”

The citation itself is a traffic matter, but the conduct behind it is central to your injury claim. California’s basic speed law, Vehicle Code §22350, prohibits driving faster than is reasonable for the traffic, weather and road conditions (California Legislative Information). Under Evidence Code §669, a violation of a safety statute such as that one creates a presumption of negligence when it caused the kind of harm the statute was meant to prevent (California Legislative Information).

Pacific Coast Highway runs the length of the city, through West Newport, Mariners’ Mile and Corona del Mar, and Jamboree Road, MacArthur Boulevard and Newport Coast Drive carry traffic down to it from the airport area and the hills (Wikipedia). On those roads, a lane-change or rear-end collision at speed can turn a routine claim into one involving fractures and surgery. “If I was speeding too, I have no case.”

Under California’s pure comparative fault rule, being partly to blame does not end a claim. If a jury finds you 15% responsible because you were driving five miles over the limit on Jamboree, your award is reduced by 15%, not eliminated. The other side will raise your speed, and the answer is precise evidence of theirs.

Bicycles and e-bikes on the Peninsula and the bay

“E-bike riders are uninsured, so they cannot recover.”

Vehicle Code §24016 exempts electric bicycle riders from the financial responsibility, licensing and registration requirements that apply to cars (California Legislative Information). Because of that exemption, an e-bike rider struck by a car is not treated as an uninsured motorist. Compensation comes first from the driver’s liability policy. The city has responded to the growth in e-bike use. Since January 2026, Municipal Code §12.56.060 has required riders of e-bikes and other motorized devices to operate them safely, and the police department runs an E-Bike Diversion Program for first-time juvenile offenders. “My teenager was cited, so we have no claim.”

Neither a citation nor completion of the diversion program decides civil fault. An insurer will use either one to argue comparative fault, but the question in the injury claim is what each person did in the seconds before the collision. A 15-year-old cited for riding on the sidewalk can still recover from a driver who turned across the rider’s path without looking.

Alcohol, holiday crowds and the fine zones

“The restaurant that over-served the driver is responsible.”

In most cases, not under California law. Business and Professions Code §25602 and Civil Code §1714 treat the drinking of alcohol, rather than the serving of it, as the legal cause of injuries inflicted by an intoxicated adult (California Legislative Information). The narrow exception, §25602.1, applies to licensed sellers who furnish alcohol to an obviously intoxicated minor. In the usual case, that leaves the driver, and whatever auto policy the driver purchased, as the source of recovery.

Newport Beach officers arrested 399 impaired drivers in 2023, and the state counted 71 alcohol-involved victims in the city that year (OTS). A DUI arrest or conviction helps prove the driver’s fault, and in drunk-driving cases California law allows a separate claim for punitive damages under Civil Code §3294.

“A Safety Enhancement Zone means triple damages.”

Newport Beach triples municipal code fines in the Corona del Mar and West Newport Safety Enhancement Zones during the spring break, Memorial Day, Fourth of July and Labor Day periods (City of Newport Beach). Those fines are paid to the city. A civil jury does not multiply anything by three; it adds up what you have lost, such as surgical bills, wages from a restaurant job on the Peninsula and months of pain. What the zone does provide is context. A Fourth of July crash in West Newport tends to produce more police contact, more witnesses and more cameras than a crash on an ordinary weekday.

Visitors, the harbor and the deadlines

“An out-of-state driver must be sued at home.”

Newport Beach draws nearly 10 million visitors a year to its 6.2 miles of ocean beach and 2.5 miles of bay beach (Wikipedia). By driving on Coast Highway, an Arizona or Nevada resident becomes subject to California’s courts, because Vehicle Code §17451 makes the director of the DMV that driver’s agent for service of a summons (California Legislative Information). A case against a visiting driver therefore stays in Orange County and is filed with the Superior Court in Santa Ana (OC Superior Court). A rental car adds another layer of insurance to review.
