Before you sign a release or choose a Newark personal injury attorney, it is worth knowing which of those beliefs fail against California law and Newark’s own crash record. ## Newark against 92 similar cities Each year the state’s traffic safety office sorts Newark into a group of 93 cities with roughly its population and ranks every category, so that 1 means the most victims. The city’s composite position, **46th**, is almost exactly the midpoint. Newark officers also made **65 DUI arrests** that year; OTS reverses the order for arrests, so a low rank there means few arrests and says nothing about how dangerous the roads were. City engineers have taken notice. With a **$45,000** state grant, Newark built its first Local Roadway Safety Plan around collision density and resident input, and it has sought a consultant to prepare a federal Safe Streets and Roads for All action plan ([City of Newark](https://www.newarkca.gov/departments/public-works/engineering-division/local-roadway-safety-plan)). ## Six beliefs that cost injured people ### “The city will have my I-880 report” Often they will not. The I-880 boundary shared with Fremont and SR-84, which runs west onto the Dumbarton Bridge, are state highways ([Wikipedia](https://en.wikipedia.org/wiki/Newark,_California)). Two agencies divide the work: - **CHP Hayward Area**, Whipple Road, Hayward: the two highways ([CHP](https://www.chp.ca.gov/find-an-office/golden-gate-division/345-hayward/)) - **Newark Police Department**: Cedar, Stevenson and the residential grid, with its Traffic Unit taking over fatal crashes ([Hoodline](https://hoodline.com/2026/02/milpitas-rider-dies-after-traffic-island-smash-up-in-newark/)) Dumbarton Bridge commuters who assume a city report exists can lose weeks writing to the wrong records desk. ### “Hitting an island means the crash was my fault” Fault turns on every cause, not only the last thing struck. In February 2026 a Milpitas rider, 29, died after his motorcycle hit a traffic island and signal pole where Cedar meets Stevenson; news coverage said alcohol may have been involved, and it was Newark’s first road death of the year ([Hoodline](https://hoodline.com/2026/02/milpitas-rider-dies-after-traffic-island-smash-up-in-newark/)). We know only what was reported and draw no conclusion about that rider’s case. Single-vehicle crashes still deserve a look at lighting, island placement, signal phasing and whether another motorist forced a swerve. Under California’s pure comparative fault rule, a person who shares blame still collects the portion of harm that others caused ([CACI 405](https://www.justia.com/trials-litigation/docs/caci/400/405/)). **Watch out:** If a signal, island or lane design on a Newark street helped cause the crash, a written claim must go to City Hall inside **six months** ([Gov. Code §911.2](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=GOV§ionNum=911.2)). Families tend to discover that rule after the window has closed. ### “Riders should take the first motorcycle offer” Adjusters hope a rider believes it. In December 2022 a 28-year-old motorcyclist was killed on Cedar Boulevard when a car turned left out of Dupont Avenue into his path ([Patch](https://patch.com/california/newark/motorcyclist-dies-newark-crash)). A left-turning driver owes the right-of-way to oncoming traffic, motorcycles included. Cedar Boulevard is not the whole story: eight motorcyclists were injured or killed across Newark in 2023, 39th of 93 in the OTS group ([OTS](https://www.ots.ca.gov/media-and-research/crash-rankings-results/?wpv-wpcf-year=2023&wpv-wpcf-city_county=Newark)). Four bicyclists under 15 were hurt or killed in the city during 2023, a figure only eight similar-sized California cities exceeded ([OTS](https://www.ots.ca.gov/media-and-research/crash-rankings-results/?wpv-wpcf-year=2023&wpv-wpcf-city_county=Newark)). A friendly driver at the curb and a child who seems fine by dinner lead many families to let it go. The claim belongs to the child, and a judge reviews any settlement reached on a minor’s behalf so the money is held for the child. A boy or girl who hit the pavement head first should see a pediatrician even without symptoms. Not by itself. A corridor ranked by the city’s engineers shows that Newark knew a location had a crash history, which can support a dangerous-condition claim, but the cause of your collision is still decided by evidence from that day. ### My crash happened after dark near NewPark Mall. Does that change anything? Darkness shapes what each driver could see.
