National City Personal Injury Attorney
San Diego County
National City ranked first of 103 comparable California cities in 2023 for victims of alcohol-involved collisions. If you were hurt here and are talking with a National City personal injury attorney for the first time, you probably have practical questions before legal ones. The answers below take the questions families commonly ask and work through them with the city’s own crash figures.
- Why does National City rank so high?
- Impairment, punitive damages and the bar
- Officers, the Highway Patrol and Lincoln Acres
- Walking, the trolley and children
- Is riding a motorcycle here more dangerous?
- Why a case goes to West Broadway
Why does National City rank so high?
Drinking, late nights and heavy foot traffic drive most of it. Of the 103 cities in its size class, only three fared worse than National City on the state’s 2023 composite score, which placed it 4th; in 2022 it was 5th of 104 (OTS 2023).
| Category (2023) | Count | Rank |
|---|---|---|
| Alcohol-involved victims | 94 | 1 |
| Drinking driver under 21 | 15 | 1 |
| Drinking driver, 21 to 34 | 45 | 1 |
| Motorcyclists | 17 | 5 |
| Child pedestrians | 5 | 5 |
| Late-night crashes | 40 | 6 |
| Hit-and-runs | 32 | 8 |
| Pedestrians | 26 | 10 |
| All victims | 310 | 10 |
The 2023 total of 310 victims was 45 more than the year before, in a city whose 2025 population estimate is 57,807 (Census). Those state tables count only what National City’s own officers investigated, which leaves out every wreck on I-5, I-805 and State Route 54.
Impairment, punitive damages and the bar
Alcohol shapes more National City injury claims than anything else in the state’s data. Alcohol-involved victims rose from 63 in 2022, second in the group, to 94 in 2023, first (OTS 2022). The two youngest age bands of drinking drivers, under 21 and 21 through 34, both put National City at the very top of the list.
What that means for your claim:
- A DUI arrest strengthens the fault side of your case. The officer’s narrative, the breath or blood result and any later plea can all be used, though a criminal conviction is not a condition of recovering.
- Punitive damages can come into play. California courts have allowed them against a person who knowingly chose to drive drunk, in addition to medical expenses, lost earnings and pain and suffering.
- A restaurant or bar that poured drinks for an adult driver is generally shielded. State law protects most sellers of alcohol (Civ. Code §1714). Liability can reach a licensed seller only in limited situations, chiefly when the customer was a visibly drunk person under 21 (B&P §25602.1); given who is driving drunk in National City, we ask that question on every DUI case here.
An impaired driver may carry only the state minimum in liability coverage, or none at all, so the underinsured motorist coverage on your own policy may end up paying much of a serious claim. Find your declarations page now rather than later.
- The National City police case number and the arresting officer’s name
- The name of the bar, restaurant or party where the driver had been drinking, if anyone knows it
- The UM/UIM figures printed on your auto policy’s declarations page
- Bills from the ambulance company and the emergency department
After a DUI arrest, will the insurer just pay?
Rarely. The adjuster still scrutinizes the treatment records and argues over value, and an arrest does not fix the number.
Officers, the Highway Patrol and Lincoln Acres
Which agency has your report depends on the pavement.
| Where it happened | Investigating agency |
|---|---|
| Plaza, Highland, 30th Street or the Mile of Cars | City police |
| I-5, I-805 or SR-54 | Highway Patrol |
| A Lincoln Acres street | Possibly the CHP (see below) |
The Highway Patrol office handling those freeways covers 14 freeway systems and more than 300 miles, so ask the officer for the Area number along with the report number (CHP).
Lincoln Acres is the exception people miss. It is an unincorporated pocket of San Diego County surrounded by National City and sharing its 91950 ZIP code, and the CHP lists it among the communities it serves, so a collision on a Lincoln Acres street may produce a Highway Patrol report instead of a city one. The agency name printed on the officer’s card settles the question.
The car that hit me on Plaza Boulevard sped off. Who pays?
Usually your own insurer, through uninsured motorist coverage, provided the hit-and-run was reported quickly. National City police logged 32 injury hit-and-runs in 2023, eighth in the group.
I’m active-duty Navy and a civilian driver hit me near the base. Do I have a claim?
Yes. Military service does not change your right to recover from a negligent private motorist. If the vehicle belonged to the federal government, a separate federal claim process with its own deadline applies.
Walking, the trolley and children
National City was rated the most walkable city in San Diego County in 2012, with a Walk Score of 71 (Wikipedia), and walkable streets put a lot of people on foot beside traffic. The 2023 state count was 26 pedestrian victims, tenth-highest in the group. Five were younger than 15, a figure that placed National City fifth for child pedestrians (OTS 2023).
The MTS Blue Line trolley follows National City Boulevard, the former U.S. 101, through Old Town (Wikipedia). A rider hurt boarding a trolley, a family hit at a stop, or a walker injured by a signal or crosswalk the city controls may have a claim against a public agency, and California requires that written claim within six months of the injury (Gov. Code §911.2). When the driver insists the walker darted into the road, our pedestrian accident page describes how those disputes are resolved.
Our son was struck crossing to his school. Does his age extend the deadline?
Your son’s own claim generally stays open until two years after he turns 18. The six-month window for presenting a claim to National City or the school district runs from the injury, regardless of his age.
Watch out: Forty of the city’s 2023 injury crashes happened between 9 p.m. and 3 a.m., sixth in the group. After a nighttime crash on Plaza Boulevard or Highland Avenue, write down which streetlights were lit and which storefronts had cameras before those details fade.
Is riding a motorcycle here more dangerous?
The state’s data says it has been. Motorcycle injuries and deaths here numbered 29 in 2022, the second-highest count of 104 cities, and 17 in 2023, fifth-highest (OTS 2022). A familiar pattern is the left-turning car or the driver leaving a lot, and the Mile of Cars on National Avenue is lined with dealership entrances where vehicles cross the curb lane all day. Lane-splitting is legal in California, a point an adjuster sometimes glosses over; our motorcycle accident page goes into it.
Why a case goes to West Broadway
Chula Vista’s South County Regional Center, at 500 Third Avenue, is the nearer building, yet it does not accept these injury filings. Filings from National City are routed past it to the Central Division on West Broadway, downtown (San Diego Superior Court).
A negligent motorist from a National City Boulevard or Highland Avenue collision generally faces suit for up to two years afterward (CCP §335.1). If a jury decides you bear some of the blame, perhaps for crossing Highland outside a crosswalk, your award is trimmed by that share and the balance is still owed (CACI 405).
What we do for National City clients
The Law Offices of Jacob Emrani (Call Jacob) represents National City families, sailors and civilian workers commuting to the bayfront base, and people who shop at Westfield Plaza Bonita. Since impaired and late-night driving dominate the city’s numbers, we request the National City Police Department’s DUI arrest report and chemical test results early, and we trace every insurance policy that could apply, your own underinsured coverage included.
Following the city’s crash numbers, these are the National City cases we handle:
- DUI collisions and every other kind of car or auto accident
- Pedestrians struck on Plaza, Highland or National City Boulevard, children included
- Motorcycle collisions near the dealership strip
- Hit-and-runs and uninsured drivers
- Trolley and bus accident injuries on the Blue Line corridor
- Uber and Lyft injuries, unsafe-property falls, dog bites, and wrongful death claims for a family that has lost someone
On freeway collisions our first call is to the CHP San Diego Area for the report, and any lawsuit we file goes to the Central Division.
Severe injuries may mean a ride north: the state’s 2025 list shows Scripps Mercy and the UC San Diego medical center as Level I programs (EMSA), while Paradise Valley, a 301-bed hospital founded in 1902, sits within National City. A representative can visit you at any of them, or at home.
There is no charge to bring us a National City case, and you owe a fee only out of a recovery. Our number is (888) 952-2952, and the online form is there if you would rather type it out. En español: calljacob.com/es.
Treat this page as background on National City crash statistics and state law, not legal advice; your own situation needs a lawyer’s review.
