Montebello Personal Injury Attorney

Los Angeles County

Pedestrians are the clearest warning in Montebello’s crash record. The state counted 33 pedestrian victims here in 2023, and just five mid-size California cities, out of 103 compared, recorded more (OTS 2023). This page is a directory of the Montebello police, Highway Patrol, hospital, transit and court offices whose records decide an injury claim, with notes from a Montebello personal injury attorney at Call Jacob on how each record is used, for people hurt on Whittier Boulevard, Beverly Boulevard, Garfield Avenue or the Pomona Freeway.

At a glance

  • About 60,700 residents (Census 2025 estimate)
  • A city police department and a city-owned bus system, so many crashes involve a public agency
  • The Pomona and Santa Ana freeways run through town; the Long Beach and San Gabriel River freeways flank it
  • Combined OTS score for 2023 put Montebello 16th in its group of 103

Where recent serious crashes happened

DateLocationWho investigated
Aug. 11, 2024SR-60 eastbound near Garfield Ave., car and motorcycle, one killed (CBS LA)CHP
Apr. 22, 2025Beverly Blvd. near Ashiya Park, car into a tree during a possible pursuit, at least one killed (ABC7)Agency not named in the report
July 5, 2025300 block of N. Garfield Ave., person on a scooter killed in a three-vehicle crash (CBS LA)Montebello PD
Aug. 31, 2025SR-60 westbound beneath the Paramount Blvd. bridge, pedestrian killed (CBS LA)CHP
Jan. 17, 2026Beverly Blvd. at Howard Ave., pedestrian in the crosswalk struck by a responding Montebello police unit (KTLA)CHP

Two of these five involved freeway lanes, and two of the Beverly Boulevard crashes involved, or were reported to involve, police activity, so agency jurisdiction and public-entity rules come up again and again in Montebello cases.

How the city compares statewide

Montebello’s ranking reflects city streets alone. The state’s tables leave out freeway crashes handled by the CHP, which means the collisions on the 60 listed above are not part of these totals. Even so, the 2023 figures place the city near the top of its group in several categories: 53 speed-related injury crashes (12th), 37 injury crashes between 9 p.m. and 3 a.m. (14th) and 32 hit-and-run injury crashes (15th). Of the 337 victims on the city’s tally that year, 21 were on motorcycles and 18 on bicycles (OTS 2023).

When a city vehicle is involved

Police cars and pursuits

The pedestrian struck at Beverly and Howard in January 2026 was left in critical but stable condition, and the CHP, not the city’s own officers, was assigned to investigate. In a case like that, the injured person’s claim would generally run against the City of Montebello as the officer’s employer. A pursuit crash such as the one near Ashiya Park raises a harder question. Where a department has a written chase policy that satisfies the state’s requirements and its officers are trained on it, Vehicle Code §17004.7 shields the department from claims over what a fleeing motorist does (Veh. Code §17004.7). After a Beverly Boulevard pursuit, then, recovery usually starts with the driver who ran and the auto policy on that car.

The City describes Montebello Bus Lines as the third-largest municipal bus operator in Los Angeles County, with routes into Downtown Los Angeles, Boyle Heights, East Los Angeles and Whittier. If a Montebello coach brakes hard and throws a rider into a pole, sideswipes a car on Whittier Boulevard or clips someone stepping off at a stop, the party answering for it is the City.

For a police car and a city bus alike, the injured person has six months to deliver a written claim to the City of Montebello (Gov. Code §911.2). Only after the City rejects the claim, or lets it lapse, can a lawsuit be filed.

Watch out: A CHP investigation into a Montebello police crash can take longer than six months. The claim against the City has to be filed on time even if the CHP has not finished.

Questions Montebello residents ask

My brother was killed riding a scooter on Garfield Avenue. Who can bring a case?

A wrongful death action belongs first to a surviving spouse, domestic partner or children; parents and siblings qualify in narrower circumstances, such as when no closer relative survives or when they relied on the person who died for support (CCP §377.60). When three vehicles were involved, as in the July 2025 Garfield crash, each driver’s insurer is examined separately, and the family’s lawyer has to sort out which of them caused the fatal impact.

Why is the CHP handling a crash on Beverly Boulevard?

Ordinarily city officers take reports on Beverly Boulevard. In the January 2026 crash at Howard Avenue, though, a police unit was itself the vehicle that struck the pedestrian, and the CHP was assigned to investigate. Ask whoever responds which agency will write the report.

Is Halloween a dangerous night to walk in Montebello?

The Montebello Police Department says twice as many children are hurt or killed on Halloween as on any other day (Montebello PD). In a city with Montebello’s pedestrian ranking, lights, reflective costumes and an adult at each crossing are worth the trouble.

The driver who hit me on Whittier Boulevard drove away. Is there any coverage?

In most cases, yes. Your car insurance’s UM coverage follows you as a pedestrian on Whittier Boulevard just as it does behind the wheel. With 32 hit-and-run injury crashes recorded on Montebello streets in 2023, this is a common situation, and the policy’s reporting deadlines should be met promptly.

Which courthouse will hear my lawsuit?

The Los Angeles Superior Court sends personal injury lawsuits to the judicial district where the crash occurred, and we confirm the correct venue against the court’s current district assignments when the complaint is drafted.

Records to request in the first weeks

  • The report itself, once Montebello PD or the CHP releases it, along with any supplemental pages
  • The Beverly Hospital chart, from triage notes through radiology, with a line-by-line bill
  • Written preservation requests to shops and restaurants along Whittier Boulevard and Beverly Boulevard with cameras facing the street
  • Patrol car dash and body camera video after a police-involved crash, requested through the government claim or a Public Records Act request
  • Footage from the cameras inside the Montebello Bus Lines coach, plus the driver’s written account
  • A copy of your own car insurance summary page, to confirm what UM and med-pay limits you bought

Deadlines and venue

Which Los Angeles County courthouse would hear a Montebello lawsuit is not something we have confirmed for this page, so our lawyers match the crash location to the court’s district rules (LASC). A pedestrian suing a private motorist has two years from the date of the crash (CCP §335.1), and shared blame for crossing mid-block lowers the award by that person’s percentage instead of eliminating it (CACI 405).

Our Montebello injury practice

The Law Offices of Jacob Emrani (Call Jacob) represents Montebello clients from the Montebello Hills, where oil was struck in 1917, from South Montebello and from the commuter traffic on the 60; in each case our opening letters go to Montebello PD or the CHP for the report and to Whittier and Beverly Boulevard merchants for their video. When a patrol car, a Montebello Bus Lines coach or the LINK shuttle is part of the crash, we file a government claim with the City of Montebello well inside six months and then pursue the camera footage that agency holds.

With Montebello among the six worst cities in its group for injured pedestrians, our pedestrian accident page explains the issues those cases raise. The same office takes on car and auto accident claims from Garfield Avenue to the 710, motorcycle crashes on the Pomona Freeway, bus accidents, e-scooter and bicycle injuries, falls in stores and apartment complexes, dog bites, and wrongful death claims after fatal crashes. Residents of neighboring Commerce, Pico Rivera and East Los Angeles who need a Montebello car accident lawyer are served by the same team.

Reviewing your crash with us is free, and under our contingency arrangement you pay nothing unless we win. Dial (888) 952-2952, or fill in the case evaluator with what happened, where and when. For a client recovering after surgery, we are glad to drive to the house or the hospital room, and Spanish-speaking relatives can begin at calljacob.com/es.

What Our Clients Say

Google

"I am very satisfied with my experience. Hyke did a great job negotiating for my case. My case manager Ann was amazing and when I needed extra help, she happily got the supervisor involved who was also very helpful. They didn't accept the low ball offers that we got at first and even helped me get more treatment than originally planned. Thanks for helping me. Hopefully I never need it again but if I do, I'll be using them again!!!"

"By far, it was my best experience with any legal professional. Jacob took great care of me and my friend and got us what we deserved. No one is prepared when you get hit by a car, but you don’t have to be unprepared when accidents happen. Like his ad says, if you were ever in an accident, call Jacob."
