Monte Sereno Personal Injury Attorney

Santa Clara County

Monte Sereno has no commercial zoning, and about 99 percent of its homes are single-family houses (Wikipedia). Nearly every errand from the city’s 1.6 square miles therefore begins on a quiet residential street and ends somewhere else, most often by way of Saratoga–Los Gatos Road or the streets of Los Gatos, which surrounds the city on three sides. A Monte Sereno personal injury attorney has to work with that geography: many crashes that hurt residents happen a few hundred yards past the city line, and the road where you were hurt decides which records exist and which public agency answers for the pavement.

Roads where residents get hurt

Residents incorporated Monte Sereno on May 14, 1957, to protect its semi-rural character, and San Tomas Aquino Creek still marks its western edge (Wikipedia). Getting anywhere from those streets involves one of three kinds of road.

Saratoga–Los Gatos Road

Saratoga–Los Gatos Road is the state highway that links the city to both of its neighbors. Residents use it to reach Saratoga to the northwest and downtown Los Gatos to the east. If its pavement or design hurt you, the State is the defendant.

Evidence on this stretch: Doorbell and gate cameras on homes facing Highway 9, the police diagram showing lane positions, and the other driver’s phone records if distraction is suspected.

Hillside streets below El Sereno

The southern part of the city climbs the slopes of El Sereno, a 2,580-foot mountain, with the El Sereno Open Space Preserve just beyond (Wikipedia). On grades and curves like these, a driver’s speed and sight distance often decide fault.

Evidence on the hillside: Photographs of the curve taken from the driver’s direction of approach, at the same hour, before vegetation is trimmed or a mirror is installed.

Highway 9 crossings in Los Gatos

These intersections are in Los Gatos, not Monte Sereno, but they sit on routes many residents use daily. The Town of Los Gatos’s road-safety plan flags Highway 9 at Massol Avenue and Montgomery Street, and at University Avenue, for speed-related and broadside crashes (Los Gatos LRSP).

Evidence at the signals: Signal timing records from the Town, the plan’s own findings for that intersection, and statements from drivers who were stopped at the light.

One police department for two towns

The Los Gatos–Monte Sereno Police Department serves both communities (Wikipedia). For an injured resident, that has a practical benefit: whether the crash was on a Monte Sereno side street or at a Los Gatos intersection on Highway 9, the report usually comes from the same department, and the same records unit handles the request.

Freeways are different. Those belong to the CHP’s San Jose office (CHP). Note which agency responded.

Monte Sereno in brief

  • 3,566 people (Census)
  • Police services come from the Town of Los Gatos
  • State Route 9, Saratoga–Los Gatos Road, passes through the city
  • Lawsuits are heard in San Jose

What the state numbers show

State figures for 2023 follow (1st of 74 = worst).

2023 measureMonte SerenoRank of 74
People killed or injured439th
Bicyclists among them214th
Speed-related injury crashes224th
Composite ranking—35th

Source: OTS 2023. Every other category (alcohol, pedestrians, motorcyclists, night and hit-and-run) shows zero.

Four victims is too few to read much into. What stands out is that half of the city’s 2023 victims were on bicycles, a fact worth knowing for families whose children ride these streets. Speed played a part in two of them. The Los Gatos plan’s concern about speed on Highway 9 points the same way, though its findings describe Los Gatos intersections, not Monte Sereno’s own streets.

Treatment, deadlines and court

  1. Trauma care. Ambulances bring the most seriously hurt to Level I centers in San Jose and Palo Alto (EMSA).
  2. Six months if the road itself is to blame (§911.2).
  3. Two years to bring the other motorist into court (§335.1).
  4. Shared fault. If you were partly to blame, your award shrinks by that percentage (CACI 405).
  5. Court. Downtown San Jose (court site).

Questions Monte Sereno families ask

I live in Monte Sereno, but the crash was just over the line in Los Gatos. Does that matter?

Not for the police report. One department serves both towns.

It matters for any claim about the road itself, because the Town of Los Gatos, the City of Monte Sereno and the State each own different pavement, and the claim must go to the right one.

Our teenager was hit while riding a bike near home. What should we do first?

See a doctor, and keep the bike untouched. A teenager’s own case against the driver can usually be brought until about age 20, since the two-year clock does not run during childhood (CCP §352). Claims against public agencies do not get that grace, so treat six months as the real limit.

Do the low crash numbers make an insurer less likely to take my claim seriously?

No. The ranking reflects the whole city’s year, while your claim depends on what happened in your crash. What moves an adjuster is evidence:

  • The police report and diagram
  • Your medical records, start to finish
  • Video, photos and witness statements showing how the collision happened

Can someone meet with us at home?

Yes. A visit at home in Monte Sereno or at the hospital is easy to arrange.
