Montclair Personal Injury Attorney

San Bernardino County

Montclair’s 2023 alcohol-involved crash toll, 55 dead or injured, was the worst of the 93 cities in its OTS population group (OTS 2023). Anyone advising you as a Montclair personal injury attorney should be able to explain that figure from a street map. About 37,600 people live here, yet the city sits on Interstate 10, meets Los Angeles County along Mills Avenue, and pulls shoppers and train riders from across the West Valley to Montclair Place and the transit center on Richton Street. The sections below take each of those corridors in turn: what goes wrong there, and which agency or business holds the proof.

Montclair at a glance

  • 37,563 residents (2025 estimate)
  • 332 victims on local streets in 2023 put Montclair fourth among its 93 OTS peers (OTS)
  • Reports: Montclair PD, or CHP on I-10
  • Injury lawsuits from here are generally heard at the Rancho Cucamonga courthouse, 8303 Haven Avenue

Where the 2023 numbers stand

On the state’s composite measure Montclair placed 5th of 93, a ranking in which 1 is the most dangerous, and the category detail shows where that came from:

Category2023 countRank
Alcohol-involved victims551
Drinking drivers, ages 21–34282
All victims3324
Hit-and-run injury crashes296
Pedestrian victims209
Speed-related crashes3312
Crashes, 9 p.m. to 3 a.m.2313
Bicyclist victims1518

Local officers made 170 DUI arrests the same year, and because OTS ranks arrests with 1 as the fewest, Montclair’s 85th-place showing reflects active enforcement rather than a safety failure. Interstate 10 is absent from every row, because collisions on the freeway belong to the Highway Patrol and OTS leaves them out of city tallies; the real exposure for someone driving through Montclair is higher than the table shows.

Drinking drivers and hit-and-run crashes

Alcohol and flight are Montclair’s two signature problems in the state data. In 2023 the largest group of impaired drivers behind Montclair’s injuries were adults between 21 and 34, whose crashes hurt or killed 28 people and ranked the city second of 93; hit-and-run crashes with injuries added 29 incidents and a sixth-place ranking.

Prosecution of an intoxicated driver moves on its own schedule; a guilty plea or conviction strengthens your case, yet nothing requires you to wait for it before pursuing compensation. When a driver had only a bare-minimum policy, or vanished before police arrived, the underinsured and uninsured motorist coverage on your own policy carries most of the weight, so give your insurer notice early and keep the Montclair PD report number with your papers.

Tip: If officers tested the other driver for alcohol or drugs, those results sit in the Montclair PD or CHP file, and they are often the strongest single piece of evidence on fault. Ask your lawyer to request them early.

Interstate 10 across the north end

The San Bernardino Freeway cuts across Montclair’s northern neighborhoods (Wikipedia). Its collisions go to the Highway Patrol’s Rancho Cucamonga Area, headquartered on Pittsburgh Avenue, whose officers cover upward of 250 square miles of interstate and county road with Montclair inside that territory (CHP).

Evidence on the freeway

Freeway claims on this stretch tend to involve sudden braking, unsafe lane changes and chain-reaction rear-end crashes. The officer’s diagram and witness list are the foundation, and dashcam clips from other motorists often answer the question the diagram leaves open. If a tractor-trailer was involved, send the motor carrier a written demand to keep its driver logs and the truck’s electronic control module data, because both are routinely overwritten.

Mills Avenue on the Pomona line

Mills Avenue traces San Antonio Creek along Montclair’s western edge, with Pomona and Los Angeles County on the other side. On March 10, 2014, a motorist impaired by drugs hit a woman in the Mills Avenue bike lane near the I-10 overpass, killing her, and then struck a 14-year-old girl on her way to school; the girl was taken to Loma Linda University Medical Center (CBS Los Angeles). Montclair officers later arrested him on charges that included felony hit-and-run and vehicular manslaughter.

Watch out: Along this boundary, a crash a few yards west of Mills puts you in Los Angeles County. Injured people from this side of town may be taken to Pomona Valley Hospital Medical Center, a Level II trauma center and the closest on the state list (EMSA), which means the hospital chart and the police report can originate in different counties.

San Bernardino Street near Vernon Middle School

On September 6, 2018, an 11-year-old boy headed to Vernon Middle School was inside the marked crosswalk at San Bernardino Street and Vernon Avenue when a pickup making a turn hit him. He did not survive, and the Montclair Police Department announced the death through its public alert system (Montclair PD via Nixle).

What proves a crosswalk case

A turning driver scanning for a gap in oncoming cars, and missing the child already in the crosswalk, is the classic pattern near schools. What proves it:

  • Traffic-signal phase records for the Vernon Avenue approach
  • Statements from parents, crossing staff and students who saw the turn
  • Doorbell or storefront cameras facing the corner
  • Photographs taken from a driver’s seat height showing what parked cars or hedges hid

Walkers fared badly citywide in 2023: OTS recorded 20 pedestrian victims, ninth-most among comparable cities, and 4 were seniors 65 or older. A child’s own injury claim runs on a different clock than an adult’s, while a parent’s claim for medical bills follows the ordinary two-year rule.

Richton Street and the transit center

The Montclair Transit Center at 5091 Richton Street marks the boundary between Foothill Transit territory to the west and Omnitrans territory to the east (Wikipedia). Service at the center includes:

  • Metrolink’s San Bernardino Line, stopping 32 times each weekday
  • Omnitrans local routes and Foothill Transit lines, including the Silver Streak rapid bus
  • RTA express coaches, plus Greyhound since 2022
  • FlixBus, which picks up nearby at Moreno Street and Lindero Avenue

The city, Caltrans and SBCTA own the center jointly, and SBCTA had budgeted $80 million by 2024 toward bringing the LA Metro A Line here.

Buses swinging through tight driveways, riders crossing to parked cars and commuters racing for a departing train make this block a steady source of pedestrian and bus injuries. Who operated the bus decides the deadline. Omnitrans and Foothill Transit are both government transit operators. A rider or pedestrian injured by one of their buses has six months to deliver a written claim to the agency that runs it (Gov. Code §911.2), and that letter is also the place to demand the onboard camera recordings. When a transit agency is the defendant, the rules on notice and evidence shift, as our bus accident page describes.

Moreno Street and the regional mall

Montclair Place opened in 1968 and holds roughly 1.2 million square feet of stores beside the transit center (Wikipedia)). Between the mall and the station, the daily traffic far outnumbers the residents, which goes a long way toward explaining a crash count fourth-highest among similar-size cities.

Shoppers backing out of stalls, drivers cutting diagonally across rows and pedestrians stepping out between parked SUVs account for many mall-area claims. When the injury came from the property instead, such as a cracked walkway, a spill near an entrance or poor lighting in a parking structure, the claim runs against the owner or tenant under premises-liability law. Send a written request to mall management and to the store itself, preferably that day, asking both to preserve their camera recordings.

Two deadlines and the West Valley courthouse

The ordinary limitations period, two years from the date of injury, governs a Montclair lawsuit against a careless driver or a property owner (CCP §335.1). Whenever the city, Caltrans, Omnitrans or Foothill Transit shares responsibility, the six-month written claim comes first, and a lawsuit against that agency follows only after the claim is acted on or the response period lapses. A shopper hurt crossing a Moreno Street driveway who carried some of the blame is not barred; the jury assigns percentages and reduces the award by that share (CACI 405).

Montclair is one of the West Valley cities whose civil cases the Superior Court sends to the Rancho Cucamonga District at 8303 Haven Avenue, rather than to the Justice Center downtown, so a lawsuit from a crash here is generally filed there (Superior Court).

Representing people hurt on Montclair roads

Our firm represents people hurt in Montclair, whether they live off Holt Boulevard, commute through on Interstate 10, change trains at Richton Street or were shopping at Montclair Place. On a Montclair claim we start by ordering the Montclair PD or CHP Rancho Cucamonga report, gather treatment records from Pomona Valley, Loma Linda or wherever care was given, and send preservation demands to the bus operator, the mall or the motor carrier while their video still exists.

The city’s numbers lean heavily toward alcohol, hit-and-run and pedestrian injuries, so many of the cases we see from Montclair are car crashes caused by impaired drivers and people struck on foot. We also take on cyclist and motorcycle injuries, big-rig collisions on I-10, transit and rideshare claims around the station, falls at retail centers, dog attacks and wrongful death cases for families who lost someone on these streets.

A Montclair car accident lawyer from Call Jacob will meet you without charge wherever you are recovering, whether an apartment near the transit center or a room at Pomona Valley, and because our fee is contingent you pay nothing unless we win. The phone number is (888) 952-2952. Writing may be easier for some families, so the online case evaluator lets a relative enter what happened at the mall, the station or on the freeway, and Spanish speakers can start at calljacob.com/es.

What Montclair drivers and families ask

Why does Montclair rank so high when it is a small city?

The rankings set it against cities of similar population, but few of them have a regional mall, a four-operator transit hub and an interstate within their limits. A large share of the people moving through Montclair on any given day live somewhere else, and they appear in the 332 victims counted in 2023 too.

A Foothill Transit bus hit me near the transit center. Who do I claim against?

Foothill Transit, which is a public agency. Its written government claim has to be filed within six months of the injury, and a lawsuit is possible only after the agency responds or the response period runs out.

Why was I taken to a hospital in Pomona?

Paramedics took you to the closest designated trauma center, which happens to sit across the county line. Where you were treated has no bearing on where your Montclair case is filed.

The driver who hit me had been drinking and has no insurance. What are my options?

Coverage you bought for yourself, called uninsured motorist protection, steps into the drunk driver’s shoes, and that claim opens without waiting on the prosecution.

Everything above is general information about Montclair’s corridors, crash data and court rules; whether any of it applies to your collision is a question for a lawyer.
