Marina Personal Injury Attorney
Monterey County
Marina finished 9th of 103 in the state’s 2023 composite crash ranking for cities its size, which puts the Peninsula’s newest city, incorporated in 1975 (city history), among the ten worst-ranked in its group (OTS 2023). People who call a Marina personal injury attorney after a crash tend to ask the same handful of questions, and the answers here depend on this city’s own roads, agencies and numbers. Jump to the one closest to what happened to you on Imjin, Reservation or Del Monte:
- Why did Marina rank 9th of 103?
- How long after the crash can I wait?
- Which officers handle a Marina collision?
- Which Marina streets are being rebuilt for safety?
- What changes when the driver was under 21?
- Why won’t my case be heard on Del Monte Boulevard?
Why did Marina rank 9th of 103?
With 23,256 people counted in the Census Bureau’s July 2025 estimate (Census), Marina is measured against 102 other Group E cities, and a 1 in any OTS row would mean the worst of them. The 9th-place composite is not the work of one bad statistic; speed, youthful drinking and hit-and-run rows push it up together.
| 2023 row | Count | Rank |
|---|---|---|
| Victims of drinking drivers under 21 | 4 | 5 |
| Speed crashes | 25 | 11 |
| Hit-and-run crashes | 9 | 19 |
| Walkers 65 and older | 2 | 21 |
| Victims of drinking drivers 21–34 | 7 | 26 |
| Bicyclists | 7 | 28 |
| Alcohol victims | 13 | 30 |
| All victims | 84 | 36 |
Twenty-five speed-related injury crashes is the largest count in the table, and young drivers who had been drinking produce the sharpest rank. Leave Highway 1 out of this picture, because OTS city rows omit the freeway crashes that Highway Patrol officers investigate on the stretch through Marina.
Note on DUI arrests: Marina’s 87 DUI arrests in 2023 placed 79th. Read that one carefully, since OTS reverses the arrest scale and hands its 1 to whichever city booked the fewest drunk drivers, so the figure tracks how often local officers made DUI stops rather than how hazardous the roads are.
How long after the crash can I wait?
| Against | Limit | Law |
|---|---|---|
| Driver | 2 years | CCP §335.1 |
| Government | 6 months | Gov. Code §911.2 |
| Property only | 3 years |
Partial blame does not erase a claim. Hypothetical example: a cyclist on Reservation Road whom a jury holds 25% at fault for riding outside the bike lane keeps 75% of the proven damages under pure comparative negligence (CACI 405).
Students, parents and hit-and-runs
I’m a CSUMB student and was hit on a bike. Does the university have to be involved?
Only when a campus vehicle, a CSU employee on the job or a defect on university property helped cause the crash, and in that case the six-month claim rule for public entities controls the timing.
A car hit me on Reservation Road and kept going. Can I still recover?
Usually yes. The UM protection on your own auto policy steps into the shoes of the motorist who sped off down Reservation Road, up to the limits you chose when you bought it. Marina logged 9 hit-and-run injury crashes in 2023, 19th of 103, and insurers expect a prompt police report before they pay on one.
Write down anything you noticed about the car, even a partial plate or a color, and ask nearby businesses on Reservation Road whether a camera caught it.
My 70-year-old mother was struck downtown. Is her claim treated differently?
Not the right to recover. Two local pedestrian victims in 2023 were 65 or older, 21st of 103, and an older person’s injuries and recovery time are part of the damages.
The other insurer wants me on tape. Should I agree?
The other driver’s adjuster will ask, but nothing obliges you to agree, and a taped account given while you are still on pain medication tends to be quoted back later when fault is argued.
Which officers handle a Marina collision?
- City streets such as Del Monte Boulevard, Reservation Road and Imjin Parkway: the Marina Police Department (City of Marina)
- Highway 1, the coastal freeway past Marina State Beach and the dunes: Highway Patrol officers assigned to Area 730 (CHP)
Keep your hospital discharge papers with the report number. For trauma care, Natividad Medical Center in Salinas is the single county hospital the EMSA trauma roster lists, rated Level II (EMSA).
Which Marina streets are being rebuilt for safety?
Two projects say a good deal about where the city and TAMC see risk.
Imjin Parkway
Running across the former Fort Ord between the Peninsula and Salinas, Imjin Parkway carries 24,000 to 39,000 vehicles every weekday. The City of Marina and TAMC are using Measure X funds to widen it and add roundabouts between Imjin Road and Reservation Road (TAMC Imjin).
The downtown Reservation Road crossing
In downtown Marina, a protected-intersection redesign was presented to TAMC’s Bicycle and Pedestrian Committee on Nov. 6, 2024. It calls for curb bulb-outs, shorter crosswalks, leading pedestrian intervals and a new south crosswalk to the Monterey Peninsula Coastal Trail (TAMC committee minutes).
Tip: If you were hurt at an intersection that is under construction or about to be redesigned, photograph the old layout now. Once the bulb-outs and new crosswalks go in, the conditions at the time of your crash are gone.
TAMC also reports that Marina adopted a Local Road Safety Plan several years ago, one of three Monterey County cities with one (TAMC regional plan). Its regional High Injury Network concentrates 61% of Monterey County’s fatal and severe-injury crashes onto under 6% of road miles, a countywide finding rather than a Marina count.
What changes when the driver was under 21?
Four people were hurt in 2023 in Marina crashes involving a had-been-drinking driver younger than 21, the fifth-highest count among 103 peer cities. A young driver at fault raises practical questions that an older driver’s crash usually does not.
The household auto policy
Drivers this young frequently borrow a parent’s sedan or appear as a listed driver on the family’s auto policy, so the bodily injury liability claim is presented to the household’s carrier. When those limits run out before your medical bills do, the underinsured motorist (UIM) portion of your own policy is the next place to look.
Who supplied the alcohol
California generally protects social hosts from liability for a guest’s drunk driving, but the law makes an exception for an adult who knowingly furnishes alcohol at home to someone under 21 (Civ. Code §1714). In a crash after a party near the CSUMB campus, where the young driver got the drinks is worth asking early.
Arrest and court records
Each of these helps prove the young driver’s negligence, and each comes from a different office that must be asked in writing:
- the Marina police arrest report
- the breath or blood alcohol result
- the juvenile or adult court docket
Why won’t my case be heard on Del Monte Boulevard?
There really is a Superior Court building in town, the Marina Courthouse at 3180 Del Monte Boulevard, and clients reasonably expect their injury case to be heard a few blocks from home. Civil matters are routed past it: Local Rule 6.2(B) seats the civil division at 1200 Aguajito Road in Monterey, absent a different assignment (Local Rules). If your claim does not settle and a lawsuit is filed, Aguajito Road is where it goes.
Hiring Call Jacob after a Marina crash
The Law Offices of Jacob Emrani (Call Jacob) represents longtime residents, CSUMB students on the former Fort Ord, Peninsula commuters on Imjin Parkway and families who came for the dunes or Otter Fest, and each of them gets the same attention. On a Marina case we order the Marina Police Department or CHP report first, check whether the crash location falls inside the Imjin or Del Monte project areas, and look into insurance on both the young driver and the household when an under-21 driver was at fault.
The city’s numbers point us toward speed-related car accidents and alcohol-involved crashes, hit-and-runs and cyclist injuries. Beyond those, we take on pedestrian accidents at the Del Monte and Reservation crosswalks, motorcycle and big-rig crashes along the Highway 1 dunes stretch, rideshare accidents involving students who get around town by Uber or Lyft, falls inside local shops, dog bites, and wrongful death cases for families after a fatal crash.
A Marina car accident lawyer at our firm will look at the report and your injuries without charge; call (888) 952-2952 or send the details through our case evaluator. Nothing is owed under our contingency fee unless we win, and if a broken leg keeps you in your apartment, a representative comes there; Spanish-language intake begins at calljacob.com/es.
