Lompoc Personal Injury Attorney
Santa Barbara County
Seven motorcyclists were killed or injured on Lompoc streets in 2023, the 11th-highest count among 93 California cities of comparable size. Speed figured in 29 injury crashes, 14th on that list, and 15 drivers left the scene of an injury crash, 18th; in both columns 1 marks the worst city (OTS 2023). Those three rows describe a pattern a Lompoc personal injury attorney takes seriously: a rider or driver hurt by someone moving too fast, and sometimes by someone who never stopped. This page follows one such claim from the pavement to a settlement or verdict, and names the Lompoc offices and records involved at each stage.
| Lompoc, 2023 | Count | Rank of 93 |
|---|---|---|
| Motorcyclists killed or injured | 7 | 11 |
| Speed-related injury crashes | 29 | 14 |
| Hit-and-run injury crashes | 15 | 18 |
| Everyone killed or injured | 161 | 20 |
| Bicyclists | 11 | 25 |
| Drinking drivers aged 21 to 34 | 10 | 25 |
| Pedestrians | 13 | 34 |
| Composite | — | 35 |
About these numbers: the counts come from crashes city officers handled; collisions on state highways outside Lompoc’s jurisdiction, which the CHP investigates, are not in them. On the DUI-arrest row, where 1 goes to the city with the fewest arrests, Lompoc’s 46 arrests placed it 30th, which speaks to enforcement rather than danger.
Hypothetical example: A Vandenberg Space Force Base employee rides a motorcycle home along Ocean Avenue in the early evening. A driver pulling out of a parking lot turns across the lane, clips the rear wheel and drives off. The rider has a broken wrist and a torn knee ligament. The stages below follow that case. Every detail is invented for illustration; only the Lompoc offices and records are real.
The scene on Ocean Avenue
Ocean Avenue is State Route 246 as it runs through town, and a 2017 UC Berkeley SafeTREC study, drawing on 2011–2015 collision data, called it a wide, high-speed Caltrans road with gaps in its sidewalks and no bike lanes (SafeTREC). Within the city, a crash on Ocean Avenue is a Lompoc Police Department case. East of town toward Buellton, or on Highway 1 outside the city, the report belongs to the CHP Buellton Area, whose officers patrol SR-246, SR-1 and the rural two-lane roads around Lompoc, Vandenberg Village and the Santa Ynez Valley (CHP).
What to collect before leaving
For our rider, the useful facts at the scene are small and perishable:
- The plate, or even a partial plate, of the car that left, and its color and make
- The name of the business whose lot the car came out of, and whether it has cameras
- Phone numbers for drivers or neighbors who stopped to check on the rider
- Which agency took it: Lompoc police in town, or CHP Buellton out on SR-246
Watch out: A driver who flees, as in this example, is a familiar Lompoc problem. Your own auto policy’s uninsured motorist coverage is what pays when the driver is never found, and insurers look for a prompt police report and prompt notice before paying.
Two trauma centers, neither in town
Lompoc itself has no hospital on the state’s trauma-center list (EMSA). For a serious injury, an ambulance heads north to Marian Regional in Santa Maria, a Level II center, or south to Cottage Hospital in Santa Barbara, Level I for adults. A rider with a wrist fracture and a knee injury could be treated and released the same day, and then need an orthopedic surgeon weeks later. Every one of those visits becomes part of the medical record the insurer will read, so keep the discharge papers and follow every referral.
The report and the adjuster
Within days, the rider asks Lompoc police for the report. Had the driver been caught, an adjuster from that driver’s company would be the next caller, asking to tape the rider’s account. In our example the car was never found, so the rider’s own carrier takes the claim under uninsured motorist coverage and asks for the same police report.
Speed is where the argument tends to start. With Lompoc ranking 14th for speed-related injury crashes, an adjuster may suggest the motorcyclist was the one going too fast. Answering that takes evidence, not a denial: the damage pattern on both vehicles, any business video, and the scene photos.
What the SafeTREC study found
The SafeTREC study is several years old, but it shows which streets were already identified as dangerous. It named three high-injury corridors from the 2011–2015 data:
| Corridor | What the 2017 study found |
|---|---|
| Ocean Avenue (SR-246) | High speeds, sidewalk gaps, no bike lanes; many uncontrolled intersections on West Ocean between K and W streets near schools |
| North H Street (SR-1) | The main north–south artery; signalized intersections often had only one marked crosswalk |
| North O Street | A gap in the bike network between Laurel and Central avenues |
Its citywide tally for 2011 through 2015 was 56 collisions involving people on foot, four of them fatal and nine with severe injuries, plus 69 involving bicycles, one fatal and eleven severe. It attributed 64.3% of the pedestrian collisions to a driver’s violation. Residents also raised the freight line along Laurel Avenue, which runs twice a week through crossings without gates or arms, including the diagonal crossing at A Street and Cypress Street.
The history on Ocean Avenue is not only statistical. Around 2 a.m. on July 30, 2022, a 48-year-old woman walking in the 600 block was struck and killed by an alleged drunk driver (CalCoastNews).
Claims involving Caltrans
Because Ocean Avenue and H Street carry state route numbers, a rider who blames the road’s design looks to Caltrans, and the written claim has a six-month deadline (Gov. Code §911.2). A study that flagged the corridor helps show the hazard was known, though it does not on its own establish liability.
Filing in North County
Negotiations with an insurer, however long they run, do not pause California’s two-year deadline to sue a driver (CCP §335.1). Lompoc falls on the North County side of the Superior Court’s map, which sends the complaint to that region’s clerk (form SC-2069). The court then assigns the courtroom.
Suppose a jury decided the rider was a little fast and assigned 10% of the fault: the award would shrink by a tenth, not vanish, under California’s pure comparative fault rule (CACI 405).
Settlement and the release
A settlement in a case like this accounts for medical bills, any health-plan or provider liens, lost wages from the base job, and pain and suffering. Before signing a release, the rider should know whether surgery is still ahead, because a release ends the claim for good.
- Medical bills and lien notices gathered in one place
- Confirmation from the base employer of shifts the rider missed
- Photos of the injury over the weeks of recovery
- The orthopedist’s view on whether knee surgery is still coming
Lompoc questions
I ride to Vandenberg every day. Does my commute affect the claim?
A crash on the way to or from the base is handled like any other commute crash against the at-fault driver. If you were driving for your job at the time, workers’ compensation can also be involved, and the two claims are coordinated.
The Laurel Avenue crossing has no gates. Who is responsible if someone is hit there?
That depends on who owns and operates the rail line and the crossing, and on what each party knew. The SafeTREC report shows residents had raised the crossing as a concern, which is a useful starting point.
Does North County venue apply to a crash on Ocean Avenue?
Yes, generally. Lompoc is on the court’s North County side, so the filing goes to the North County clerk, and the specific courtroom is assigned by the court once the case is filed.
Why aren’t crashes on Highway 1 outside town in the city’s rankings?
The OTS city tables include crashes handled by city police. Collisions the CHP investigates outside city jurisdiction are counted separately.
Who we represent in Lompoc
From the flower fields to the Sta. Rita Hills tasting rooms, The Law Offices of Jacob Emrani (Call Jacob) represents people hurt across the Lompoc Valley: residents, Vandenberg commuters, Clean Air Express riders and wine-country visitors on SR-246. On a Lompoc case we pursue the Lompoc Police Department or CHP Buellton report first, look for business video along Ocean Avenue or H Street, and prepare the six-month Caltrans claim when a state highway’s design is in question.
Lompoc’s 2023 figures point to two kinds of case first:
- Motorcycle accidents on Ocean Avenue, H Street and SR-246
- Hit-and-run crashes like the one in the example above
We also take car and truck crashes, pedestrian accidents on Ocean Avenue and North H Street, bicycle collisions, injuries on City of Lompoc Transit and the Clean Air Express (bus accidents), dog bites, falls on business property, and wrongful death claims.
Your first meeting with us about a Lompoc Valley crash is free. Our fee comes out of a recovery, and without one you owe us nothing. Reach us at (888) 952-2952 or through the case evaluator.
