Lathrop Personal Injury Attorney

San Joaquin County

June 29, 2022 was the first day Lathrop answered calls with its own police department; until then the city paid the San Joaquin County Sheriff to patrol River Islands, Mossdale Village and Central Lathrop (City of Lathrop). For anyone looking for a Lathrop personal injury attorney, that history matters on the first day, because a crash on River Islands Parkway and a crash on Interstate 5 a mile away produce reports from two different agencies. This page follows the first 72 hours after a collision in a city of 42,783 people (Census 2025 estimate), then the weeks and months after, with the local offices involved at each step.

From the crash scene to day three

Hour zero, beside the car

Lathrop officers handle collisions on city streets, including River Islands Parkway and the roads through Mossdale Village and Stanford Crossing, from a headquarters at 940 River Islands Parkway, west of I-5 (Lathrop PD). The freeways are different. Lathrop grew up at the junction of I-5 and State Route 120 (Lathrop overview), and crashes on those freeways are worked by the Highway Patrol rather than city officers. The CHP’s Tracy Area, whose territory is the I-205, I-580 and I-5 “Tracy Triangle” with its freight and Bay Area commuter traffic (CHP Tracy Area), investigated the September 2019 crash that killed a Stockton motorcyclist on northbound I-5 near Mossdale Road (CBS Sacramento).

  • Read the patch on the officer’s sleeve: a Lathrop Police patch and a CHP patch mean different records offices.
  • If a tractor-trailer from one of the I-5 warehouses is involved, photograph the cab door lettering and the trailer’s plate.
  • Get a cell number from each witness who saw the light or the lane change.
  • After a hit-and-run, call 911 again from the spot and wait for the officer there.

Hours one to six, at San Joaquin General

For the most badly hurt, whether from an I-5 pileup or a River Islands crosswalk, the county’s single entry on the state trauma list is the Level II hospital in French Camp (EMSA). Being sent home from an emergency room that night is not the end of the medical record; book a follow-up with your own physician within 48 hours. A rear-end collision on SR-120 that seems to cause only stiffness at the scene often produces neck, back or head symptoms the next morning, and the number of days between the crash and your first medical visit is one of the first things an adjuster examines.

Phone calls, video and the police report

  1. Order the report. A crash on a Lathrop street is a Lathrop PD case, requested from the River Islands Parkway headquarters, while a freeway crash belongs to the CHP, whose Tracy Area office at 1175 E. Pescadero Ave. handled the 2019 Mossdale Road case.
  2. Ask for video in writing. Gas stations at the Lathrop Road interchange, the warehouses beside the freeway and doorbell cameras in River Islands keep footage only for a limited time.
  3. Look up your UM and UIM limits on your declarations page before the at-fault driver’s carrier calls, so you know what backup coverage your household bought.
  4. Decline the recorded statement. It is optional, and words spoken while you are still on pain medication end up in the adjuster’s notes.
  5. Keep a calendar that records each night’s pain, each therapy visit and each warehouse or delivery shift you missed.

Watch out: In October 2025, a 13-year-old girl in a crosswalk near Mossdale Elementary was struck at 7:43 a.m. by a driver who fled; Lathrop PD arrested an unlicensed, uninsured 19-year-old on a felony hit-and-run charge (Yahoo News). For a family in that situation, the uninsured motorist coverage on the parents’ own car policy is frequently what pays for a child’s treatment.

Treatment, liens and missed shifts

During the first month, three habits protect the medical side of a Lathrop claim:

  • Keep every bill and explanation of benefits in one folder, including pharmacy receipts.
  • Tell each provider the visit stems from a crash; some will accept a lien on the eventual recovery instead of billing you.
  • Follow the therapy schedule your doctor sets, because missed appointments read to an adjuster as a recovered patient.

Tip: If you were hurt while driving for work, whether for Tesla, the city’s largest employer with its warehouse and Megapack battery factory (Lathrop overview), or for another company, you may hold a workers’ compensation claim against the employer and a separate negligence claim against the other motorist.

The truck that hit me belonged to a warehouse company. Is that a different kind of claim?

Often, yes. The carrier or logistics company can be liable for its driver, its commercial policy usually carries far higher limits than a personal auto policy, and its electronic driving logs and cab cameras should be preserved by letter right away.

Short answers on reports, coverage and court

Lathrop police say my I-5 crash isn’t in their system. Is that right?

Interstate collisions, even within city limits, are the Highway Patrol’s responsibility, so the report sits with the CHP and not at River Islands Parkway; the Tracy Area office handled the 2019 I-5 case near Mossdale Road.

A driver with no license or insurance hit my child near Mossdale Elementary. Who pays?

The uninsured motorist coverage on your family’s own policy generally covers a child who is struck while walking, and the driver remains personally liable if he or she is later found to have assets.

I was hurt in Lathrop in early 2022, before the city’s department opened. Whose report is it?

The Sheriff’s. For crashes before June 29, 2022, deputies working under the city’s Sheriff contract investigated, so the San Joaquin County Sheriff’s Office holds those records.

Six-month and two-year limits

DeadlineApplies toLaw
6 monthsClaim form for a sidewalk, signal or pavement defect owned by the City of Lathrop, the County, or Caltrans on I-5 and SR-120Gov. Code §911.2
2 yearsLawsuit against the at-fault driver, a warehouse or freight company, or the owner of a dangerous propertyCCP §335.1

The six-month rule comes into play near Lathrop because some of the dangerous intersections are on county roads close to the city. San Joaquin County’s 2023 Local Roadway Safety Plan, built on 2015 to 2019 crash data from county roads, lists Cottage Avenue at Lathrop Road, east of town, among its priority intersections with a collision severity score of 85.22; the County installed a flashing beacon there in 2018 (County LRSP). Over those five years the plan recorded 12,567 collisions on county roads, 210 of them fatal and 557 with serious injuries, and named DUI as the top factor in fatal and serious crashes at 29%. If the County argues that a Lathrop commuter ran the flashing beacon at Cottage and Lathrop Road, a jury can assign a percentage of blame to each side and reduce the award by the commuter’s share (CACI 405).

When a Lathrop case cannot be resolved by negotiation, the complaint goes to the San Joaquin County Superior Court’s Civil Department on the second floor of 180 E. Weber Ave. in downtown Stockton (Superior Court).

Will I have to go to Stockton for court?

Only if the case reaches the courthouse on Weber Avenue, and even then your lawyer handles routine hearings; you would be needed in person mainly for a deposition and for trial.

Lathrop in the 2023 OTS rankings

OTS places Lathrop in a 93-city population group; a 1 in a crash row would mean the most victims among them (OTS 2023).

Category2023 countRank of 93
Pedestrians under 1544
Bicyclists under 1555
Drinking drivers aged 21 to 34158
Bicyclists, all ages168
Motorcyclists812
Alcohol-involved victims2513
Composite ranking—14
Nighttime injury crashes1815
Hit-and-run injury crashes1515
Speed-related injury crashes2417
All people killed or injured14817

Two patterns stand out. Children on foot and on bicycles were hurt here at counts among the highest of any city in the group, in a city whose growth is concentrated in new master-planned neighborhoods such as River Islands, Mossdale Village (2,375 units) and Stanford Crossing (2,167 lots) on both sides of I-5. Alcohol also appears again and again, particularly among drivers in their twenties and early thirties. The table reflects collisions on Lathrop’s own streets; crashes worked by the CHP on I-5 and SR-120 sit outside it. Enforcement tells a separate story: Lathrop police made 89 DUI arrests, and since OTS orders arrests from fewest to most, that count sits 59th.

Our Lathrop casework

The Law Offices of Jacob Emrani (Call Jacob) represents people injured in Lathrop, from River Islands families to SR-120 commuters and the drivers who work at the warehouses along I-5. On a Lathrop file we request the Lathrop PD or CHP report in the first days, send preservation letters for camera footage near the crash, and identify early whether the City, the County or Caltrans is involved so the six-month deadline is met. The 2023 state figures above shape that caseload, in roughly this order:

  • children hit on foot near schools and the new subdivisions (pedestrian accidents), and young bike riders
  • drunk-driving and hit-and-run collisions
  • car accidents at the I-5 and SR-120 ramps and truck accidents involving warehouse freight
  • motorcycle crashes, dog bites, falls on badly maintained property, and wrongful death claims for families

We will come to your Lathrop home or your bedside at San Joaquin General, or talk by phone if that is easier. Your first meeting with a Lathrop car accident attorney is free; we are paid a percentage only if the claim brings in money, and nothing otherwise. Phone (888) 952-2952, or describe what happened at the junction or on your street through our online case evaluation. Español: calljacob.com/es.
