Lancaster Personal Injury Attorney
Los Angeles County
Measured by people hurt or killed, Lancaster’s streets were the most dangerous of any mid-sized California city in 2023. Its 1,541 victims gave Lancaster the 1st-place ranking of 62 in the Office of Traffic Safety’s comparison of cities with 100,001 to 250,000 residents (OTS 2023). If you are one of those people, or you are helping a family member who is, this page follows a Lancaster personal injury attorney’s view of a claim from the night of the crash to its resolution, and names the Antelope Valley offices, hospital and courthouse involved at each point.
Collisions on the Antelope Valley Freeway are not part of that 1,541. The state reports CHP-patrolled highways apart from its city lists, so the real toll on Lancaster drivers is higher.
Lancaster at the top of the state list
The 2022 list was nearly as stark: 1,753 victims, second of 61 (OTS 2022). These 2023 categories explain much of what our firm sees in Antelope Valley cases.
| What OTS measured in 2023 | Lancaster | Rank |
|---|---|---|
| Victims killed or injured | 1,541 | 1 |
| Crashes between 9 p.m. and 2:59 a.m. | 131 | 6 |
| Alcohol-involved victims | 144 | 8 |
| Pedestrians under 15 killed or injured | 8 | 9 |
| Hit-and-run injury crashes | 108 | 11 |
| Motorcyclists killed or injured | 49 | 16 |
Late-night collisions are the clearest pattern. Lancaster placed 4th of 61 for crashes between 9 p.m. and 3 a.m. in 2022 and 6th of 62 in 2023, while alcohol-involved victims rose from 130 to 144 over those two years. Adjusters handling Antelope Valley claims know this, and after a late-night crash their first questions are about drinking and headlights.
One family’s claim from crash to courthouse
No two cases are alike, yet most claims arising here move through the same Antelope Valley institutions in the same order. One invented family shows how.
Hypothetical example: At 10:40 on a Friday night, a driver turns left at Avenue J-8 and 10th Street West and is struck by a pickup that ran the red light. Her teenage son, in the passenger seat, breaks his wrist. By Sunday the stiffness in her neck has spread into her shoulder. The pickup driver’s insurer calls her on Monday.
The report
Lancaster buys its police services from the Los Angeles County Sheriff, so deputies from the Lancaster Station at 501 West Lancaster Boulevard investigate a collision at that corner (LASD). Had the pickup hit her on the freeway, the report would come from the CHP Antelope Valley Area, whose office on West Avenue I takes collisions on SR-14, SR-138 and the county roads surrounding the city (CHP).
In our example, deputies record the red light and the pickup driver’s account. The single most useful thing the mother takes home that night is the number for the station’s traffic collision report.
Watch out: On SR-14, high desert wind changes how fault is argued. In October 2021 a dust storm closed the freeway between Avenue A and Avenue D, and NBC reported at least six people hurt in two pileups (NBC LA); CBS counted 18 dust-related crashes (CBS LA). A driver who kept going at freeway speed into blowing dust made a choice, and the storm does not excuse it.
Treatment
Paramedics take her son to Antelope Valley Medical Center, an ACS-verified Level II trauma center whose chief executive described it as the only one within a 50-mile radius (AVMC). Because seriously hurt patients from across the valley converge on that one emergency department, the son’s records, from his arrival by ambulance to his cast, are kept in one chart. The mother declines an ambulance and sees her own doctor on Monday, three days later.
Tip: Expect the insurer to raise that three-day gap. Whiplash and other soft-tissue symptoms commonly build over several days, and a medical visit within the first week is the most reliable answer to the claim that something else caused her pain.
A recorded statement request
The Monday call is friendly. The adjuster offers to cover her urgent care visit and asks whether she would mind being recorded. She is under no obligation to agree. Her own carrier needs to hear about the crash promptly regardless, because if the pickup turns out to be uninsured, the UM portion of her policy is what pays for treatment.
That coverage matters in Lancaster more than in most cities: 108 injury crashes here in 2023 were hit-and-runs, eleventh-highest among the 62.
Evidence
The corner in our example has a history. In 2020 the Sheriff’s Department reported that a red-light-running drunk driver killed a woman and her unborn child at Avenue J-8 and 10th Street West (LASD Nixle). An earlier tragedy does not prove fault in a new collision, but it tells us where to look first: signal timing, sight lines and nearby cameras.
- Whichever report number you were handed, Sheriff’s or CHP
- Every page the AVMC emergency department handed you, including X-ray results
- Photos showing what each driver saw approaching the J-8 light
- Which shops or gas stations at the corner point cameras toward the street
- Proof of your own uninsured motorist limits
- A pain and missed-shift log, written each evening
The city’s own safety work can help. Lancaster adopted a Local Road Safety Plan and a Vision Zero resolution in August 2022 that define High-Severe Injury and High-Fatality street networks, and it treats collision hot spots with road diets, four-way stops, protected left-turn signals and roundabouts (City of Lancaster). When a crash site lies on one of those networks, the city’s findings help explain why the location was dangerous.
The settlement demand
Once the son’s cast is off and his mother’s care has ended or leveled off, the demand to the insurer is assembled from:
- Emergency, orthopedic and physical therapy bills for both patients
- Any medical liens from health insurers or providers
- Her lost wages, documented by her employer
- What the broken wrist cost the son in school, sports and sleep, and what the neck injury cost his mother
Suppose the pickup driver insists the light was a stale yellow and she should have waited. California follows pure comparative fault, so a jury that assigned her 10% of the blame would reduce her award by 10% rather than deny it (CACI 405).
The courthouse
A lawsuit over a Lancaster crash stays in the Antelope Valley. The court’s 2024 general order keys venue to the crash location (LASC), and every Lancaster address falls in the North District. Our family’s case would generally be filed at the Antelope Valley Courthouse on 4th Street West (211 LA), so hearings happen in town instead of a drive to downtown Los Angeles.
Deadlines for the mother and her son
| In our example | Limit | Law |
|---|---|---|
| Mother's claim against the pickup's driver | 2 years | §335.1 |
| A claim against the City, AVTA or the County | 6 months | §911.2 |
| Her bent fender | 3 years | — |
| The son's wrist | Special rules for minors; ask early | — |
The two-year statute of limitations gets the attention, but people are most often caught by the six-month rule. It applies when a defect in a city street contributed to the crash, when a Sheriff’s patrol car was involved, or when you were hurt on or by an Antelope Valley Transit Authority bus. AVTA, which in 2022 became the first U.S. transit agency to run an all-battery-electric fleet (electrive), is a public agency, so an injury claim against it is held to that deadline.
Answers about crashes in the high desert
Why was my crash report written by a Sheriff’s deputy?
Lancaster contracts with the Sheriff for patrol, and the deputies who answer a crash call on a city street are assigned to the Lancaster Station on West Lancaster Boulevard. On SR-14 and the surrounding county roads, the CHP Antelope Valley Area writes the report.
Does Lancaster’s number one ranking help my case?
Not directly. An auto accident lawyer in Lancaster treats the OTS ranking as background, because it describes the whole city, and your claim rests on what happened in your crash. It does give context when an out-of-town adjuster underestimates how common late-night and alcohol-involved crashes are on these streets.
Who is at fault for a pileup in a dust storm on SR-14?
Any driver who went faster than the visibility allowed can be. Drivers must slow to a speed that is safe for what they can see, so a driver who caused a chain collision in blowing dust may be at fault even though the weather was severe. Witness accounts and the CHP Antelope Valley report carry these cases.
Does a Lancaster lawsuit stay in the Antelope Valley?
Generally, yes. Hearings for a Lancaster crash take place in the Antelope Valley, because the court keeps each injury lawsuit in the district where it arose.
Who pays my medical bills if the driver is never found?
Usually the UM coverage you bought for yourself. Call the Lancaster Station with the location and time, then tell your insurer within days; a late report gives the insurer a reason to question the claim.
Did the BLVD redesign actually reduce crashes?
According to the Congress for the New Urbanism, after Lancaster Boulevard downtown went from five lanes to two with a tree-lined center median, collisions fell by nearly a third and injuries by 67% within three years (CNU).
What Call Jacob does on a Lancaster case
Call Jacob, The Law Offices of Jacob Emrani, handles injury cases for Lancaster residents and for the SR-14 commuters who drive between the Antelope Valley and the rest of Los Angeles County. Given the city’s numbers, many of our Lancaster files begin as late-night car crashes, alcohol-involved collisions and hit-and-runs on the lettered avenues; our car accident page covers those claims in more depth.
We also take on big-rig cases on city arterials, and a Lancaster truck accident lawyer on our team moves on them quickly. In 2021 a wrong-way car struck a big rig head-on at Avenue G and 30th Street East, and four people died (ABC7); a case like that requires the trucking company’s logs and the driver’s records early. For riders who need a Lancaster motorcycle accident attorney, we look hard at left-turn collisions like the 2019 crash at Avenue I and 15th Street East that killed a rider (LASD Nixle).
Our Lancaster practice also includes:
- Pedestrians, among them the eight children under 15 in the 2023 OTS count
- Cyclists and AVTA bus riders
- Shoppers hurt in falls at local businesses
- Wrongful death cases arising from fatal Antelope Valley collisions
On a new Lancaster case, we request the Sheriff’s or CHP report, preserve camera footage before it is overwritten, gather the Antelope Valley Medical Center records and file any government claim inside the six-month window.
To talk through a late-night crash on the avenues with a Lancaster car accident attorney, or a crossing injury with a Lancaster pedestrian accident lawyer, call (888) 952-2952 or open our case evaluator; the free consultation costs nothing. We charge nothing unless the case is won, and we can meet you at AVMC or wherever you are recovering. Spanish-language pages for Antelope Valley readers are at calljacob.com/es.
The family above is invented, and nothing here is legal advice on a real Lancaster claim; it is general information.
