Gonzales Personal Injury Attorney

Monterey County

Four people died in two pre-dawn crashes on U.S. 101 at the Fifth Street interchange in Gonzales, one in October 2020 and one in June 2023, and both were investigated by the CHP Monterey Area. That interchange is the clearest danger point for people who live in or pass through this city of 8,313 (Census 2025), and it shapes how a Gonzales personal injury attorney thinks about who is at risk here. This page goes through those groups one at a time: drivers and passengers on the highway, children, farm and winery workers, and people on foot in town.

Drivers and passengers on Highway 101

US-101 runs along the northeast side of Gonzales with three exits; Salinas is about 17 miles north and Soledad about 8 miles south (Gonzales overview). When the county’s transportation agency drew up its 2026 Vision Zero plan, it flagged the spot where Fifth Street traffic and the freeway ramps meet, US 101 at 5th Street in Gonzales, as needing coordination between Caltrans and the city (TAMC regional plan).

The two crashes there followed a similar pattern, late at night or before dawn:

  • Oct. 25, 2020, about 3:32 a.m. A speeding BMW overturned into a field on northbound US-101 just north of the Fifth Street overcrossing. A 31-year-old and a 6-year-old died, and officers booked the BMW’s driver for DUI and gross vehicular manslaughter (Salinas Valley Tribune).
  • June 18, 2023, about 3:34 a.m. A wrong-way driver on southbound US-101, just south of Fifth Street near Gloria Road, struck a Honda head-on. Two brothers from Soledad were killed (KION).

Families after crashes like these face a money problem first. A drunk or wrong-way driver’s bodily injury liability limits are frequently a fraction of what two deaths are worth, so we look next at underinsured motorist coverage on the victim’s own car and on any policy covering the household. When a driver is booked for DUI, as the BMW driver was in 2020, the chemical test results, the CHP’s investigation and the criminal file each carry over into proving the civil case.

Watch out: A fatal wrong-way or DUI crash on 101 calls for a fuller CHP investigation than a fender-bender. Request the report early, and ask whether a separate reconstruction report will follow it.

Children riding in the car

In the 2020 crash, the 6-year-old who died was not properly restrained, and an 8-year-old was taken to Santa Clara Valley Medical Center with major injuries (Salinas Valley Tribune). That detail matters for two reasons. First, a youngster hurt by an impaired driver on the Fifth Street stretch keeps a claim against that driver, whatever the seat belt or booster situation was. Second, California pauses a minor’s two-year lawsuit clock until the eighteenth birthday, while a claim against Caltrans or the city still has to be presented within six months.

Gonzales has put effort into children’s safety on foot and on bikes as well: TAMC reports school traffic gardens installed in Gonzales under its Safe Routes to School program. When a child is hurt in a crash, parents can help the claim by keeping:

  • every pediatric and hospital record, including any transfer out of the county
  • notes from the child’s Gonzales teachers about missed weeks, nightmares or trouble concentrating after the crash
  • the car seat or booster, which insurers and experts sometimes want to inspect

Farm and winery workers

Gonzales has long been a working town. It was a Swiss dairy center, with the Meyenberg milk plant opening in 1906, and today employers include Constellation Brands, Robert Talbott, Pisoni and Mer Soleil (Gonzales overview). Many workers commute the 101 corridor between Salinas, Gonzales and Soledad at the same early hours when the interchange crashes happened.

Hypothetical example: A vineyard hand driving a company truck between Pisoni and Mer Soleil blocks when someone runs into him has two tracks open at once: workers’ compensation through the employer, and a third-party claim against the other driver that can recover pain and suffering and the full wage loss comp never pays. If he was simply driving in from Soledad before his shift, it is an ordinary auto claim.

Walkers on Gonzales streets

1 victim on Gonzales streets in all of 2023, a pedestrian, for a 61st-of-74 OTS placement (OTS 2023)

One victim is too few to describe a trend, and the OTS city figures leave out US-101 crashes handled by the CHP, which is where the serious harm here has happened.

Gonzales keeps its own police department (City of Gonzales), so a pedestrian or fender-bender case on Fifth Street in town is a city report, not a Highway Patrol one. If you were struck on foot near the Fifth Street interchange, note whether the driver had just left the freeway, because that affects both the report and the question of whether road design played a part.

When to act and where cases go

Filing deadlines

Adults hurt on the Gonzales stretch of 101 have two years to sue the responsible driver (CCP §335.1), but a claim that the Fifth Street ramps or a city street were dangerously designed must reach Caltrans or City Hall in six months (Gov. Code §911.2). Some fault on your part, such as a missed seat belt, trims an award by that share under pure comparative fault and does not cancel it (CACI 405).

Hospital and courthouse

Seventeen miles up the freeway, Natividad Medical Center in Salinas is the Level II trauma center and the one county hospital with that EMSA designation (EMSA), although the 2020 crash shows that some patients are taken farther, to Santa Clara Valley Medical Center. No courtroom in the south valley takes these lawsuits; a Gonzales family whose claim must be litigated files in Monterey, where Local Rule 6.2(B) keeps the civil division on Aguajito Road (Local Rules).

What Gonzales families have asked us

My brother was killed by a wrong-way driver on 101. Who can bring the claim?

California gives the first right to his wife and children; if he left neither, his parents and others who would inherit from him take their place. The claim can run against:

  • the wrong-way driver’s auto insurer
  • the driver’s estate, if the driver also died
  • an owner who lent the car to that driver

The driver was charged with DUI. Do we wait for the verdict?

No. The district attorney’s prosecution and your family’s damages claim are separate cases; a guilty plea would be powerful proof, but the insurance claim and even a civil lawsuit can move forward while the criminal case is pending.

I was hurt driving to work at a winery. Is it workers’ comp or an injury claim?

Driving in for your shift is ordinarily a regular auto claim against whoever hit you; driving between vineyard blocks for the employer can open a comp claim and a driver claim together.

Tell us who owned the vehicle you were in and whether your employer arranged the ride, because those two facts usually decide which track applies.

Will I have to go to Monterey?

Rarely, if ever. We gather the CHP file, deal with the insurers and meet you at home in Gonzales; the Peninsula comes into it only if a lawsuit reaches a hearing date.

Our Gonzales clients and their cases

The Law Offices of Jacob Emrani (Call Jacob) represents residents hurt on city streets, vineyard workers on their way to the fields, and families from Gonzales, Soledad and Salinas who lost someone at the Fifth Street interchange, all on the same contingency terms. On a Gonzales case we request the CHP Monterey Area report and any reconstruction, obtain the DUI case records when an arrest was made, and check every available policy, including underinsured motorist coverage in the household.

Because the serious crashes here involve highway speed, the core of our Gonzales work is:

  1. car accidents involving impaired or wrong-way drivers on 101 near the Fifth Street interchange
  2. wrongful death claims like those that followed the 2020 and 2023 interchange crashes
  3. injuries to children riding in the back seat

We also take on truck and motorcycle collisions on 101, pedestrians and cyclists hit on city streets, workers hurt on the job, slip-and-fall injuries at local businesses and dog bites. Families can reach a Gonzales car accident lawyer at (888) 952-2952 or through the case evaluator for a free first review, with nothing owed unless we win; we will come to your kitchen table in Gonzales, and our Spanish pages start at calljacob.com/es.
