Goleta Personal Injury Attorney

Santa Barbara County

Nineteen people riding bicycles were killed or injured in Goleta crashes in 2023, the sixth-highest count among 93 California cities of similar population, and four of them were children under 15 (OTS 2023). Bicycles are where this city stands apart. If you or your child was hurt on a bike, on foot or in a car here, the questions below are the ones a Goleta personal injury attorney would want answered first, and each answer draws on Goleta’s own roads, agencies and records.

Why are bicycle injuries Goleta’s standout number?

Geography explains a good deal of it. The city borders UC Santa Barbara and the student town of Isla Vista (Wikipedia), and riders traveling between the campus, the student neighborhoods and jobs in the city share Goleta’s roads with drivers. Goleta’s own Bicycle and Pedestrian Master Plan names Calle Real from Fairview Avenue to Hollister Avenue as a top-priority segment, calls it unsafe for walking and biking, and recommends a separated Class 1 path there (City of Goleta).

Reading the table: none of the 101’s freeway crashes are in these rows, because OTS builds its city tables from collisions handled locally. Several rows hold single-digit counts, where one crash more or fewer reorders the ranking.

When a rider and a driver meet, the insurance company’s first move is often to blame the rider: wrong lane, wrong direction, no light. Even if part of that sticks, a rider assigned a quarter of the fault keeps three-quarters of what the injuries are worth (CACI 405), since California apportions blame rather than barring recovery. For the right-of-way and car-door arguments that come up most, see our bicycle accident page.

Does a crash in Isla Vista count as Goleta?

No. Goleta became a city in 2002, after many years as the county’s largest community without its own government, and the new boundaries left Isla Vista out (Wikipedia). The campus is outside them too. That line decides who investigates, which public agency would receive a road claim, and whose statistics the crash ends up in.

Tip: If you can, drop a pin on your phone’s map at the spot where you were hurt. Near the city line, that pin settles which agency and which public body are involved.

How dangerous is Hollister Avenue in Old Town?

By the City’s own account, Old Town has had four times the state-average collision rate since 2017 and three times the average rate of pedestrians and cyclists injured, figures the Santa Barbara Independent relayed when it covered a Sept. 23, 2024, rear-end crash on Hollister near Rutherford Street (Santa Barbara Independent).

Evidence on Hollister

Old Town’s storefronts, driveways and crosswalks put the proof within a block of most crashes:

  • Write down which Hollister cross street was closest and which way each vehicle or rider was headed
  • Ask the Old Town restaurants and shops facing the crash to save that hour’s video
  • Photograph the Hollister crosswalk paint and signals before any repaint or repair

Which officers respond on city streets and the 101?

For the September 2024 Old Town collision, the details came from a Santa Barbara County Sheriff’s Office spokesperson (Santa Barbara Independent). Deputies may well respond to your crash too, but do not assume; the agency named on the card you were handed is the one to ask.

The 101 is another matter. The Highway Patrol’s Santa Barbara Area is headquartered inside Goleta on Calle Real, and its officers cover US-101 between the Ventura County line and Gaviota State Beach, plus SR-154, SR-150 and the county areas outside city limits (CHP). Expect a CHP report, as a rule, for a collision on the 101 through town or on State Route 217 toward the university and the airport.

Cottage Hospital and pediatric trauma care

For serious injuries, the closest state-listed trauma center is east in Santa Barbara: Cottage Hospital, rated Level I for adults and Level II for children (EMSA). For the parents of a young cyclist, the pediatric rating is worth knowing. Ask for the emergency department notes and any concussion screening, since a child’s head injury can be missed in the first visit.

How much time does a Goleta family have?

ClaimDeadlineLaw
Suit against the driver who hit you, a landlord or a business2 yearsCCP §335.1
Written notice to a public owner, such as the City of Goleta, the County or Caltrans, when a road defect contributed6 monthsGov. Code §911.2
A bike repair or replacement claim with no injury3 yearsCCP §338

Children get more time to sue a private driver, yet a road claim on a child’s behalf against the City or Caltrans is still bound by the short public-entity window. If the layout of Calle Real or Hollister Avenue contributed to a crash, we prepare that claim well before the six months run out.

Our work for Goleta cyclists, walkers and drivers

The Law Offices of Jacob Emrani (Call Jacob) represents cyclists, walkers and drivers hurt in Goleta, from Old Town and Calle Real to Ellwood Mesa, along with students injured just over the line in Isla Vista. On a Goleta file, we handle the early records ourselves: the Sheriff’s Office or CHP Santa Barbara Area report, footage from Hollister Avenue businesses, and the Cottage Hospital chart.

Goleta’s bicycle figures shape this practice, and we pursue claims for riders hurt on Calle Real, Hollister Avenue and the routes to campus, children among them. We also take car accidents on Hollister and the 101, pedestrian accidents involving older walkers, truck and motorcycle collisions, Uber and Lyft rides to campus, e-scooter injuries, falls on business property, and wrongful death claims.

We charge nothing for the first consultation, and our attorney’s fee comes only from money recovered for you. Phone (888) 952-2952 or describe the Hollister or Calle Real collision in our case evaluator. If getting to an office is hard, we can come to you in Goleta instead.

Why would the case go to Anacapa Street?

Goleta falls on the South County side of the Superior Court’s local rules, so a lawsuit arising here is generally filed in South County, at the courthouse at 1100 Anacapa Street in Santa Barbara (form SC-2069). The court’s cover-sheet addendum asks the person filing to state why South County is proper, and where the injury happened is the usual answer.

Four more questions from parents and riders

Our son is 12 and was hit on his bike. Can we bring a claim for him?

Yes. A parent or guardian acts for him, and because he is a minor, a court has to approve the settlement terms.

Goleta made 95 DUI arrests in 2023. Is that a bad sign?

Not by itself. OTS ranks arrests so that the city with the fewest gets first place, and Goleta came in 70th of 93, which points to active enforcement. Alcohol-involved crash victims, a better measure of harm, put the city 38th.

The 101 runs through Goleta. Why did a CHP officer take my report?

Freeway collisions belong to the Highway Patrol even inside city limits, and its Santa Barbara Area office on Calle Real keeps those reports.

The student who hit me carries only the minimum insurance. Is that the end of it?

Often not. The underinsured motorist part of your own auto policy can cover what the student’s policy does not, provided you give your carrier timely notice.

Nothing here is legal advice: the Goleta crash figures, agency roles and filing rules above are offered to inform, and your own crash deserves an individual review.
