Gilroy Personal Injury Attorney
Santa Clara County
Gilroy placed ninth of 103 comparable California cities for motorcyclist casualties in 2023 and 35th for traffic casualties of every kind, a heavy toll for a city of 60,764 residents (OTS 2023; Census). Ask a Gilroy personal injury attorney why, and the first answer is geography. US-101 runs the length of town, SR-152 climbs east over Pacheco Pass and west over Hecker Pass, and SR-25 heads off toward Hollister, so traffic bound for the Central Valley, Monterey Bay and San Benito County all funnels through here. What follows is a working directory: each office, hospital, highway and transit system you may deal with after a Gilroy crash, and why each one matters to your claim.
Gilroy at a glance
- Crash reports: Gilroy Police for city streets, CHP Hollister-Gilroy on Renz Lane for highways outside town
- Level I: Valley Medical in San Jose
- Trains and buses: Caltrain, VTA and Monterey-Salinas Transit, all public agencies
- Lawsuits: the Superior Court, San Jose
Riders, cyclists and people on foot
State figures for 2023 show which road users bear the most risk in Gilroy:
- 12 riders on motorcycles, ninth of 103
- 19 bicyclists, 18th
- 19 crashes where the driver fled, 28th
- 17 pedestrians, 41st
- 24 victims of alcohol-involved crashes, 39th, down from 30 in 2022

Riders top that list. Visitors add to the traffic as well: Gilroy Gardens, the Garlic Festival and the 20-plus wineries of the Santa Clara Valley Wine Trail all draw out-of-town drivers onto the same roads.
School crossings are another concern. In January 2026, after morning drop-off at Las Animas Elementary, a teenage driver in a large pickup hit two parents in the stop-sign crosswalk at Charles Lux Drive and Lopez Way. Both parents died, leaving 7-year-old twins. The driver remained at the scene, and relatives afterward petitioned for a safer crossing (KTVU). For children who lose both parents this way, California’s wrongful death statute is the path to compensation for what that loss takes from them.
The highways around Gilroy
| Road | Known hazard | What it means for a claim |
|---|---|---|
| SR-152 east of US-101 | Undivided, narrow shoulders, 55 mph, head-on prone | Center-line disputes |
| Pacheco Pass | Steep grade, repeatedly realigned | Heavy truck volume |
| Hecker Pass | Winding; trailers over 45 ft restricted | Possible truck violation |
| SR-25 | Rural two-lane | Night head-ons |
| US-101 | Main freeway | CHP jurisdiction |
Source: SR-152.
East of US-101, SR-152 narrows to a single lane in each direction with no divider, head-on collisions are a known problem there, and daytime headlights are required. It is also one of the main bottlenecks between the Bay Area and the Central Valley. Pacheco Pass beyond it was realigned and widened in stages between 1934 and 1992, and the old stop-sign junction with SR-156 was replaced by a flyover in 2008.
West of town, Hecker Pass is a winding two-lane road on which tractor-trailers longer than 45 feet are restricted and routed instead toward Carlton Road and SR-129. A long rig that ignored that restriction and caused a crash will have trouble explaining why it was there at all.
SR-25 to Hollister shows how quickly a rural highway can turn deadly. At about 12:30 a.m. on October 28, 2024, a head-on collision near Bloomfield Avenue killed both drivers, among them a 35-year-old Santa Clara County 911 dispatcher (ABC7). When both drivers die, each family may have a claim against the other driver’s estate and insurer, and the CHP’s reconstruction becomes the central piece of evidence.
Watch out: After a head-on on SR-152 or SR-25, each insurer usually says the other car drifted over the line. Resting positions, the debris field and gouges in the pavement settle that question, and tow trucks and street sweepers can erase all three within hours. Photograph them if you can, or ask someone to.
The city’s own figures reflect this traffic. Gilroy streets produced 218 victims in 2022, 17th of 104 peer cities, and 214 the following year (OTS 2022). Freeway collisions worked by the CHP are not even part of those totals.
Report offices
| Location of the crash | Office |
|---|---|
| City streets | Gilroy Police |
| Beyond city limits | CHP |
| Truck inspections | CHP, San Martin facility |
The Highway Patrol’s Hollister-Gilroy Area works from 740 Renz Lane, inside Gilroy, and its public number is (408) 848-2324 (CHP). Collisions on downtown streets, Monterey Road and residential blocks are Gilroy Police Department reports instead. The two agencies keep separate files, so when you leave the scene, make sure you know which one wrote yours.
A commercial-vehicle inspection facility run by the CHP sits on US-101 at 12000 South Valley Freeway in San Martin. When a tractor-trailer is involved in a Gilroy collision, inspection history for that rig or its carrier is one of the first things we ask about, because worn brakes, bad tires or logbook violations recorded before the crash change the case.
Hospitals
| Hospital | Where | Trauma level |
|---|---|---|
| Saint Louise Regional | Gilroy | Not designated |
| Valley Medical | San Jose | Level I |
Saint Louise Regional Hospital is the hospital in town and ranks among Gilroy’s five biggest employers. It does not appear on the state’s trauma-center list. For adults, the closest Level I trauma facility is Valley Medical Center in San Jose, which the state rates one step lower, Level II, for pediatric patients.
Patients are sometimes seen at Saint Louise first and transferred north later. If that happened to you, ask both hospitals for their records; an adjuster reviewing the claim will want the whole sequence, starting with the ambulance run sheet.
Buses and trains
| Operator | Service |
|---|---|
| Caltrain | Southern terminus, rush-hour trains to San Jose |
| VTA | Local and express buses north |
| Monterey-Salinas Transit | Line 55 from Gilroy station |
Source: Gilroy.
Each of those three operators is a public agency. That puts a six-month limit on any claim arising from a VTA bus, a Caltrain train or an MST coach: the written claim has to be presented to the operator within six months of the injury, well before the ordinary two-year limit for suing a private driver (Gov. Code §911.2). Our bus accident page describes the claim form that transit operators use and the response deadlines that follow.
Filing limits and venue
- Two years to file suit over your injuries against the motorist at fault on US-101, SR-152 or a city street (CCP §335.1)
- Six months when the party responsible is the City of Gilroy, the County, Caltrans, VTA, Caltrain or MST
- Venue: a complaint over a crash in Gilroy or on the county highways around it generally goes to San Jose’s Downtown Superior Court (Superior Court)
If a jury decides a rider coming down Pacheco Pass was 25% responsible, the award is reduced by that quarter, and the remaining 75% is still recoverable under California’s comparative fault rule.
Gilroy questions
How is fault decided in a head-on on SR-152?
Through the physical evidence and the vehicles’ own data. Where each car stopped, the spread of debris, skid and gouge marks, and the event data recorder in modern cars reconstruct which vehicle left its lane. Officers out of the Renz Lane office handle that reconstruction for SR-152.
What if a long truck hit me on Hecker Pass?
Find out the truck’s length and the carrier’s name. A trailer over the 45-foot limit was not supposed to be on that road, and a violation of a safety restriction weighs heavily against the trucking company.
I was treated in San Jose but live in Gilroy. Does that matter?
If the crash happened in Gilroy, your claim belongs to Santa Clara County either way. Treatment in San Jose only means your records come from Valley Medical Center as well as from any Gilroy doctors who treated you afterward.
The driver says he never saw my motorcycle. Is that a defense?
No. A driver turning or changing lanes is required to look, and saying a motorcycle went unseen usually confirms that the driver did not look carefully enough.
