Gardena Personal Injury Attorney
Los Angeles County
In 2021, the last year for which Gardena’s collision reports appear to have reached the state database in full, the city ranked 5th of 105 similar-size California cities for hit-and-run injury crashes and 7th for injury crashes between 9 p.m. and 3 a.m. (OTS 2021). A late-night collision in which the other driver leaves is a common Gardena case, and it puts unusual weight on the first three days. This guide follows those days in order, names the Gardena offices involved at each point, and explains what a Gardena personal injury attorney does with the records you collect.
| When | Your task | Gardena office or party |
|---|---|---|
| Hour zero | 911 call, report number, plate details | Gardena Police or CHP South Los Angeles |
| Overnight | Imaging and an emergency workup | Harbor-UCLA or Gardena Memorial Hospital |
| Day one | Written requests to save camera footage | Storefronts and cardrooms near the impact |
| Day two | Notice to your own carrier | UM and med-pay coverage on your policy |
| Day three | Polite refusal to be taped | Adjuster for the Rosecrans or Vermont driver |
| Month six | Written notice to a public owner | GTrans, J Line or Caltrans |
What the 2021 state figures show
Here is how Gardena placed in 2021 among 105 cities of 50,000 to 100,000 people, counting from the top of each list (OTS):
| 2021 measure | Gardena count | Rank of 105 |
|---|---|---|
| People killed or injured | 446 | 10 |
| Hit-and-run injury crashes | 49 | 5 |
| Victims of alcohol-involved crashes | 61 | 7 |
| Injury crashes, 9 p.m. to 3 a.m. | 50 | 7 |
| Speed-related injury crashes | 65 | 12 |
| Pedestrians 65 and older hurt | 8 | 4 |
The state’s tables for 2022 and 2023 list only a handful of injured people for Gardena, and the 2023 table shows no injured pedestrians, cyclists or motorcyclists at all. For a city of 58,460 residents (Census 2025 estimate) bordered by three freeways, those totals point to police collision reports that never reached the statewide database, not to safer streets, and we do not rely on them. Drunk-driving arrests, which the state receives through a separate channel, still appear in full for those years: 134 in 2022 and 115 in 2023 (OTS 2023).
Recent news reports fit the 2021 pattern. In August 2024 a 45-year-old woman was killed by an eastbound hit-and-run driver on the 1600 block of Rosecrans Avenue at about 11:55 p.m. (KFI). Six months earlier, a southbound driver on Vermont Avenue struck and killed a woman near El Segundo Boulevard shortly before 4 a.m. (KFI).
At the scene
City streets
Gardena keeps its own police force of 89 sworn officers, headquartered at 1718 W. 162nd Street (Gardena PD). A collision on Western, Vermont, Rosecrans, Artesia or Redondo Beach Boulevard will be written up by a Gardena officer, and that department’s report number is the first thing every insurer and lawyer will ask you for.
Freeways
The 405, the 110 and the 91 are patrolled by the Highway Patrol. Gardena appears by name on the service list of the CHP’s South Los Angeles Area (CHP), so a copy of any 405, 110 or 91 report is ordered from that Torrance office rather than from the police station on 162nd Street.
When the driver leaves
A fleeing driver changes the order of everything. Give the 911 dispatcher the direction of travel, any part of the plate and the make or color of the car. California’s uninsured motorist statute ties hit-and-run coverage to a police or CHP report within 24 hours and a written claim to your carrier within 30 days (Ins. Code §11580.2). A call from the hospital the next morning still meets that rule; a report made a week later can cost you the coverage.
The first night
Harbor-UCLA Medical Center is the Los Angeles County Level I trauma center for the South Bay (Harbor-UCLA Trauma), and Gardena Memorial Hospital, one of the city’s two largest employers, sits inside the city limits. Which one you reach is the ambulance crew’s medical call.
Tip: Leave the emergency department with copies of the discharge sheet and the CT or X-ray disc. A headache or stiff neck that starts two days after a Rosecrans rear-end collision is common, and a follow-up visit that week ties the symptom to the crash.
Day one and the video near the crash
Gardena’s arterials are lined with storefronts, restaurants and the city’s card casinos. Hustler Casino and the Lucky Lady ranked among Gardena’s largest employers in 2020 (Wikipedia), and businesses of that kind tend to record their parking lots and sidewalks all night, then write over the footage on a short loop.
- Return to the intersection and note each camera aimed at the roadway.
- Hand each manager a dated letter naming the time window to preserve.
- Take wide photographs showing the signal heads, lane paint and sight lines.
- Ask riders on a passing GTrans bus or at the J Line stop for their phone numbers.
- Hold off on repairs to your car until both sides have photographed it.
A collision at one of the Union Pacific rail crossings raises a separate question. The City says Union Pacific owns and maintains the signals, signs and pavement at its Gardena crossings (City of Gardena), which points responsibility for a crossing defect toward the railroad.
Day two and your own insurance
Notify your own carrier now, whatever happened. After a hit-and-run on Rosecrans or Vermont, your uninsured motorist policy pays what the missing driver’s liability coverage would have paid, and medical payments coverage can reach early emergency bills before fault is settled.
Watch out: In an uninsured motorist claim your own company sits on the other side of the table. Give it the date, the location and the report number, and let your lawyer answer any request for a recorded or sworn statement.
Day three and the adjuster’s call
When the other driver was identified, that driver’s insurer will be calling soon. Questions such as “you were walking outside the crosswalk, weren’t you?” are meant to set up a shared-fault argument. If a jury decides a Vermont Avenue pedestrian bears 20% of the responsibility, the verdict shrinks by that fifth and the remaining four-fifths is still owed (CACI 405). Nothing in California law obliges you to record a statement for another driver’s insurance company.
Questions Gardena residents ask
Why do the newest state rankings make Gardena look so safe?
Because the 2022 and 2023 tables show far fewer injured people than a city of Gardena’s size produces, which points to collision reports missing from the statewide database. The 2021 figures remain the most reliable picture of Gardena’s streets.
The driver who hit me fled on Rosecrans. Who pays my medical bills?
At first, your own policy pays, through two coverages:
- med-pay, which reimburses the Harbor-UCLA or Gardena Memorial emergency bill up to your policy limit
- uninsured motorist coverage, for injuries, lost wages and pain, provided the 24-hour report and 30-day claim requirements are met
If the Gardena Police investigation later identifies the driver, that person’s liability insurer becomes responsible as well.
Can I bring a claim if a GTrans bus hit my car?
Yes. GTrans buses belong to the City of Gardena, and City Hall must receive a written claim describing the crash and your injuries within six months before a lawsuit is allowed.
Will my case be heard in Torrance or downtown Los Angeles?
Generally Torrance. The county places Gardena inside the Torrance Courthouse’s territory, and injury cases now follow the district where the collision happened instead of defaulting to Stanley Mosk.
My father is 70 and was hit in a crosswalk. Does his age change the claim?
His rights are the same at 70 as at 30. Age tends to make hip and wrist fractures worse and recovery slower, which belongs in the damages, and any Medicare payments for his care are repaid out of the recovery. Gardena’s 2021 ranking for injured pedestrians in his age bracket, 4th worst of 105, shows how often this happens here.
Deadlines after the first week
Once the first week has passed, the deadlines that matter run in months and years. A lawsuit against the Gardena motorist who hurt you is due within two years (CCP §335.1), a claim limited to your damaged car has three, and a claim against a public owner such as the City or Metro has only six months (Gov. Code §911.2). The six-month rule matters more in Gardena than in most cities its size. GTrans has been the City’s own bus line since 1940 and carries about 8,300 weekday riders (GTrans), and Metro runs the J Line busway to the Rosecrans station beside the 110. A collision with either agency’s bus, with a Gardena police car or on a hazardous city street falls under that shorter deadline, and minors’ claims follow their own rules.
The county’s locator lists Gardena within the jurisdiction of the Torrance Courthouse, 825 Maple Avenue (LA County), and the Superior Court’s 2024 general order sends injury cases to the district where the incident occurred (LASC), so cases arising in Gardena are generally filed there.
Working with Call Jacob after a Gardena crash
The Law Offices of Jacob Emrani (Call Jacob) represents people hurt in Gardena, from Moneta to the blocks along the Harbor Gateway line, and we order the Gardena Police or CHP South Los Angeles report in the opening days of each case. After a hit-and-run on Rosecrans or Vermont, we pursue the uninsured motorist claim against your own carrier while canvassing the cardrooms and storefronts nearby for footage of the fleeing car. When a GTrans coach or a Gardena patrol car is part of the crash, our claim to City Hall goes out long before month six.
Car and auto accident claims lead the list, in line with the state figures above. We also represent pedestrians struck crossing Western and Vermont, riders hurt in motorcycle crashes like the fatal July 2025 collision on Marine Avenue near the 110, cyclists, passengers injured on a bus, shoppers hurt in a slip and fall at a local business, and families bringing wrongful death claims. Neighbors in Alondra Park and Athens who need a Gardena car accident lawyer or an injury lawyer nearby are welcome too.
Bring to the first meeting: the Gardena Police or CHP report number, the hospital discharge papers, photographs, and the names of any businesses you asked to keep video.
Hit-and-run or not, we look at a Gardena case free of charge, and you pay nothing unless we win. Our line is (888) 952-2952, and the online case evaluator accepts a written account of the crash. We can come to Harbor-UCLA or to your home in Gardena, and Spanish speakers have calljacob.com/es.
