# Fullerton Personal Injury Attorney

Orange County

Fullerton’s overall crash record sits near the middle of the state’s rankings, but its record for people on foot does not: **58 pedestrians** were killed or injured on its streets in 2023. That total put Fullerton **12th-highest of 62** California cities with 100,001 to 250,000 residents, the same place it held a year earlier, by the Office of Traffic Safety’s count ([OTS 2023](https://www.ots.ca.gov/media-and-research/crash-rankings-results/?wpv-wpcf-year=2023&wpv-wpcf-city_county=Fullerton)). As a Fullerton personal injury attorney, our firm hears the same handful of mistaken beliefs from people hurt on Orangethorpe, Harbor and Commonwealth, and this page sets each one against California law and the city’s own records.

**Fullerton in the 2023 OTS data**

- Total victims, walkers and drivers combined: **736**, a middling 25th
- Walkers aged 65 and up: **9**, triple the 2022 figure and 13th of 62
- Bicycle riders: **39**, up from **20** the year before ([OTS 2022](https://www.ots.ca.gov/media-and-research/crash-rankings-results/?wpv-wpcf-year=2022&wpv-wpcf-city_county=Fullerton))
- Left out of these totals: collisions on SR-91 and SR-57, which belong to the CHP

## Six beliefs that cost injured people

Each belief below is one an injury lawyer in Fullerton hears in consultations. The short version comes first.

What people assume

What actually applies

Crossing mid-block ends the claim

Fault is shared by percentage

The Berkeley Avenue courthouse hears the case

Larger lawsuits go to Santa Ana

One statute of limitations fits all

Six months for the city or OCTA

A hit-and-run leaves nobody to pay

The victim’s own UM policy

The DUI prosecution covers the bills

A civil claim is separate

Cyclists lose these cases

Riders have the same rights

### “I was crossing mid-block, so I have no case”

A partly careless pedestrian is not shut out under California law. Jurors split responsibility by percentage, so someone they find 30% to blame for stepping out between signals is still owed 70% of the proven losses ([CACI 405](https://www.justia.com/trials-litigation/docs/caci/400/405/)). Drivers on Fullerton’s arterials have to watch for people in the roadway whether or not there is a painted crosswalk.

Long blocks separate the signals on Orangethorpe Avenue, and that is where this belief does the most damage. According to Fullerton Police Department releases reprinted by the Fullerton Observer, a pedestrian was killed mid-block in the 400 block of West Orangethorpe in July 2025 ([Fullerton Observer](https://fullertonobserver.com/2025/11/17/fatal-traffic-collision-involving-pedestrian-in-fullerton-2/)). Where a person crossed shifts the percentages; it does not end the family’s claim, and it is often the first point a Fullerton pedestrian accident lawyer has to answer.

### “My case goes to the North Justice Center”

The courthouse at 1275 N. Berkeley Ave. is in Fullerton, but it is the wrong door for most serious claims; those generally belong at the **Central Justice Center** in Santa Ana ([OC Superior Court](https://www.occourts.org/location/central-justice-center)). If your case reaches trial, expect to make that drive.

### “I have two years no matter who is responsible”

Two years applies when the at-fault party is a private motorist, store or landlord ([CCP §335.1](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=CCP&sectionNum=335.1)). Public agencies get a much shorter window, and Government Code section 911.2 sets it at **six months** from the injury for the written claim ([Gov. Code §911.2](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=GOV&sectionNum=911.2)). In Fullerton, that short deadline covers the city itself when a signal, a dark crossing or a broken curb contributed, and OCTA when one of its buses was involved.

The city’s own paperwork can support those claims. Its Local Road Safety Plan picked out the Orangethorpe and Harbor intersections in the table further down for federally funded signal and lighting upgrades ([Fullerton Observer](https://fullertonobserver.com/2025/04/14/city-of-fullerton-secures-funding-for-key-safety-improvements-along-major-intersections/)). Listing an intersection for repairs is not an admission of negligence, though it does show city engineers already knew about the location.

**Watch out:** Healing takes longer than six months for many pedestrians struck on Orangethorpe or Harbor. If the city’s design or lighting may have played a part, the claim against Fullerton has to be filed before you know how your recovery will end.

### “If the driver fled, nobody pays”

Hit-and-runs made up **47** of the city’s 2023 injury crashes ([OTS 2023](https://www.ots.ca.gov/media-and-research/crash-rankings-results/?wpv-wpcf-year=2023&wpv-wpcf-city_county=Fullerton)), and the Fullerton Observer reported one of the hardest recent cases: a pedestrian struck at Gilbert Street and Carol Drive on December 20, 2025, died on Christmas Day, and the driver never stopped ([Fullerton Observer](https://fullertonobserver.com/2026/01/03/pedestrian-dies-following-hit-and-run-in-fullerton)). For families in that position, uninsured motorist coverage on the victim’s own auto policy, or a relative’s in the same household, is often the main source of payment, along with a wrongful death claim if the driver is later found.

- Call Fullerton police that day, even if you feel fine
- Tell your auto insurer within days, and ask for the UM claim number
- Ask businesses facing Gilbert, Orangethorpe or Harbor to preserve video
- Keep any car part or paint fragment left at the scene

### “A DUI conviction covers my medical costs”

Criminal court decides whether a driver is punished. It does not pay for a hip replacement or months of lost wages. In February 2019 a suspected drug-impaired driver drove onto a crowded downtown sidewalk at bar closing time, striking nine pedestrians and sending ten people to hospitals ([ABC7](https://abc7.com/fullerton-crash-10-hospitalized-after-driver-plows-into-pedestrians/5130864/)). Every person hurt that night had a civil claim of their own against the driver’s insurer, the kind an auto accident attorney in Fullerton pursues separately from the prosecution, and the two-year limit kept running whatever pace the criminal case moved at.

### “Cyclists always get the blame”

A rider on Commonwealth or Nutwood Avenue is owed the same care from drivers as anyone in a car, and the comparative fault rule treats riders the same way. Bicycle casualties in the city nearly doubled from 2022 to 2023. Near campus, where Cal State Fullerton enrolled **45,863** students in fall 2025 ([CSUF](https://www.fullerton.edu/data/data-of-the-month/csuf-facts-dec-2025.php)), the city’s new safety plan places its single costliest project, priced at **$12,457,192** ([Daily Titan](https://dailytitan.com/news/city-council-approves-three-stage-traffic-safety-initiative-across-fullerton/article_1e55d080-121c-4207-9b5f-0fff60a211c1.html)). A Fullerton bicycle accident attorney will also ask whether the driver turned across the rider’s path. A student whose permanent address is in Riverside or San Diego can bring a claim over a Fullerton crash just as a resident would.

## Intersections the city has funded for safety work

A **$3,218,400** Highway Safety Improvement Program award in February 2025, with **$357,600** of local Measure M2 money added, pays for protected left turns and brighter pedestrian lighting at intersections the road safety plan singled out ([Fullerton Observer](https://fullertonobserver.com/2025/04/14/city-of-fullerton-secures-funding-for-key-safety-improvements-along-major-intersections/)).

Location

City safety work

Why it matters to a claim

Orangethorpe at Harbor, Euclid, Brookhurst and Magnolia

Signal and lighting upgrades

The city’s own plan flagged these crossings

Harbor at Commonwealth and at Chapman

Signal and lighting upgrades

Signal timing records become evidence

Harbor at La Entrada

New signal aimed at broadside crashes

Suggests a known broadside pattern

Harbor, Bastanchury to Berkeley

Proposed cut from six lanes to four, plus bike lanes ([CEQAnet](https://ceqanet.lci.ca.gov/2025101440))

Bears on speed and lane-change disputes

Commonwealth Avenue

Stage 2 corridor in the 2026 plan

A man in a wheelchair died crossing at Library Lane in March 2025 ([Fullerton Observer](https://fullertonobserver.com/2025/03/14/fatal-traffic-collision-in-fullerton-claims-life-of-pedestrian-in-wheelchair/))

**The 2026 safety plan:** Fullerton’s council approved its Safe Streets and Roads for All plan on June 2, 2026. It aims for no traffic deaths or serious injuries by 2040 through **390 countermeasures** costing an estimated **$36.4 million**, and 93% of residents surveyed wanted high-visibility crosswalks ([Daily Titan](https://dailytitan.com/news/city-council-approves-three-stage-traffic-safety-initiative-across-fullerton/article_1e55d080-121c-4207-9b5f-0fff60a211c1.html)).

## Representing Fullerton pedestrians, riders and drivers

The Law Offices of Jacob Emrani (Call Jacob) takes on every kind of injury claim that Fullerton’s streets, sidewalks and businesses produce, for walkers, riders and drivers alike. The OTS figures single out people on foot, so a large share of our Fullerton files open with a [pedestrian accident](https://www.calljacob.com/personal-injury/pedestrian-accidents/) on Orangethorpe, Harbor or Gilbert, including crashes that injure older residents and people using wheelchairs.

When a Fullerton crash happened at one of the HSIP or safety-plan intersections, we handle the city side of the case, requesting the signal timing and lighting records and preparing the six-month government claim. Our caseload here also includes:

- [Bicycle accident](https://www.calljacob.com/personal-injury/bicycle-accidents/) claims near Cal State Fullerton
- Car and motorcycle collisions on Euclid Street and State College Boulevard
- Rideshare crashes outside the Fullerton Transportation Center, which the city calls the busiest stop on Metrolink’s Orange County route ([City of Fullerton](https://cityoffullerton.com/about-us/downtown-fullerton/transportation-center))
- OCTA bus injuries and falls at downtown businesses
- [Wrongful death](https://www.calljacob.com/personal-injury/wrongful-death-attorney/) claims arising from deaths like those at Library Lane and Gilbert and Carol

People searching for a Fullerton car accident lawyer, or an Orange County personal injury attorney who knows the Harbor Boulevard corridor, can reach us at **(888) 952-2952** or through the [case evaluator](https://www.calljacob.com/case-evaluator/). We offer a free consultation and take our fee only from a recovery, and if you are still hospitalized at UCI we can meet you at your bedside or later at home. ## Questions from Fullerton families and students

### Which agency writes the report for a crash on Harbor Boulevard?

Fullerton has its own police force, and its traffic officers write the police collision report for crashes on Harbor Boulevard and the city’s other surface streets. Collisions on SR-91 and SR-57 are freeway cases for the CHP, whose Santa Ana Area covers north and central Orange County ([CHP](https://www.chp.ca.gov/find-an-office/border-division/675-santa-ana/)).

### Is Providence St. Jude a trauma center?

No. Orange County classifies the Fullerton hospital as an emergency receiving center rather than a trauma center ([OCHCA](https://ochealthinfo.com/sites/healthcare/files/2025-06/Attachment%20%235-FAC%20Designations%20Summary%20Report.St%20Jude.pdf)). For the gravest injuries, ambulances from Fullerton usually head to the Level I center at UCI in the city of Orange ([EMSA](https://emsa.ca.gov/wp-content/uploads/sites/71/2025/08/California-Designated-ACS-Verified-Trauma-Centers-8.22.25.pdf)).

### My mother is 72 and was struck in a crosswalk. Does her age change anything?

Her rights are the same at 72 as at 32. What changes is the medical record, since a fracture or head injury can mean a longer and more complicated recovery, and the claim has to account for all of it. Older walkers are a real concern in this city: nine people 65 or older were hurt or killed on foot in 2023.

### I was hit near the downtown bars after closing. Will the insurer blame me for drinking?

It may try. A drink earlier in the evening does not give a driver license to hit someone on a Harbor Boulevard sidewalk, and comparative fault looks at what each person actually did.

### I commute through on Metrolink and live in another county. Can I still file?

Yes. What counts is where the crash happened, so Metrolink and Amtrak riders, OCTA passengers and CSUF students from other counties can pursue a Fullerton claim.
