Fremont Personal Injury Attorney
Alameda County
Fremont earned the most favorable composite crash score of 62 comparable California cities in the Office of Traffic Safety’s 2023 rankings (OTS 2023). That composite blends every category together, and it conceals two groups whose numbers look nothing like the average: people on bicycles and people on motorcycles. If you were hurt riding, walking or driving here, this page sets out what the record shows for each kind of road user and how a Fremont personal injury attorney puts that record to work in a claim.
At a glance — Fremont
- Population of 226,442 as of July 2025 (Census)
- 518 victims on surface streets in 2023, 61st of 62, close to the safest end of the list
- 55 cyclists (20th) and 38 motorcycle riders (18th), both inside the worst third
- Washington Hospital opened as a trauma center for the Tri-City area on July 1, 2024
How the state ranks each road user
Each year the OTS sorts Fremont alongside 61 other mid-sized cities, and in every category the city with the most victims for its size receives rank 1. Its tallies come from local police reports on surface streets, so a collision on I-880, SR-84 or SR-262 that the Highway Patrol investigated never enters them.
| Who was hurt on Fremont streets | 2023 count | Place among the 62 |
|---|---|---|
| Bicyclists | 55 | 20 |
| Bicyclists under 15 | 7 | 20 |
| Motorcyclists | 38 | 18 |
| Pedestrians | 36 | 54 |
| Pedestrians 65 and older | 6 | 45 |
| Pedestrians under 15 | 4 | 52 |
| All victims | 518 | 61 |
In the state table, pedestrians and the overall total sit near the bottom, while both groups of two-wheel riders landed roughly forty places higher, well inside the worst third.
Bicyclists
Fifty-five riders on bicycles were killed or injured on Fremont streets in 2023, seven of them younger than 15, and both counts placed 20th, some forty spots worse than the citywide total.
City engineers have mapped where serious harm concentrates. In a May 2019 presentation to the Alameda County Transportation Commission, Fremont reported that between 2013 and 2015 one street in ten produced 90% of traffic deaths and 67% of severe injuries (Alameda CTC). Those slides also recount the Vision Zero Action Plan the council adopted in March 2016 and report that major crashes on Fremont streets fell by more than half afterward.
That mapping gives a Fremont bicycle accident lawyer something concrete. When a rider goes down on a corridor the city has already flagged, we look at lane width, signal phasing and any redesign the city scheduled but had not yet built, in addition to what the driver did. Our bicycle accident page covers how insurers try to shift blame onto riders and how that is answered.
For the seven injured cyclists who were children, a parent or guardian pursues a minor’s claim, a judge must approve any settlement, and different filing deadlines apply to young people, although a claim tied to a city-owned street still carries the six-month notice rule discussed further down.
Motorcyclists
Thirty-eight people riding motorcycles were hurt or killed on Fremont streets that year, placing the city 18th, and riders accounted for roughly one in every fourteen local traffic victims.
A rider’s case usually comes down to sight lines: what the turning driver on Mowry Avenue or Fremont Boulevard could see, and when. Storefront cameras along those boulevards record over themselves on short cycles, and the scrape marks and crush pattern on the bike vanish once a salvage yard hauls it away. Riders injured on the Dumbarton Bridge approach or on I-880 will find their report with the Highway Patrol instead, and their crash is absent from the city tally above.
Watch out: Keep the insurer’s appraiser from taking your motorcycle until you and your lawyer have photographed and inspected it. Where the bike was struck usually tells the story of the crash better than anyone’s memory.
Before talking with a Fremont motorcycle accident attorney, riders can read how lane-position arguments are handled on our motorcycle accident claims page.
People on foot
Pedestrian victims placed 54th in 2023, a comparatively good showing that the fatal crashes of 2025 complicate.
| Date | Where | What happened |
|---|---|---|
| April 15, 2025 | Mission Boulevard at Mohave Drive | A pedestrian was struck and killed, the city's third traffic death of the year (Yahoo News) |
| August 12, 2025 | Paseo Padre Parkway at Capitol Avenue | A 76-year-old pedestrian died in the fifth fatal collision of 2025 (CBS News Bay Area) |
| December 13, 2025 | A city sidewalk | A motorist running from a police stop lost control and killed a person walking, the sixth fatal collision that year (Hoodline) |
Council member Suzanne Lee Chan has said most collisions occur on about a tenth of Fremont’s streets, and the city responded with a public pedestrian-safety campaign (ABC7). On its traffic-safety data page, the city reports that deaths climbed after 2020 and associates the rise with reckless driving and with collisions involving unhoused residents (City of Fremont).
When a person walking is killed, surviving spouses, children and certain other relatives hold the right to pursue a wrongful death claim, and California statute defines who qualifies.
Drivers and commuters
Set the cyclists, riders and pedestrians aside and about 389 of the 518 people hurt on Fremont streets in 2023 remain, most of them in cars and trucks. Fremont lies on the daily commute between the East Bay and Silicon Valley, and residents have ranked regional cut-through traffic among their leading concerns (Think Silicon Valley).
Surface streets
Fremont Boulevard, the longest street in the city, is the subject of the Safe & Smart Corridor project, which combines physical safety redesign with connected signal technology (Meeting of the Minds). Paseo Padre Parkway at Mowry Avenue was the scene of a deadly three-vehicle crash, separate from the 2025 pedestrian death at Capitol Avenue (CBS News Bay Area). In October 2024, a Tesla left the road on Old Warm Springs Boulevard and struck an apartment building that then caught fire, killing the driver (KTVU).
State figures also show 76 speed-related injury crashes, 44 injury crashes during the late-night window from 9 p.m. to 3 a.m., and 37 hit-and-run injury crashes on Fremont streets in 2023, and each of those placed between 53rd and 62nd, meaning fewer than most peer cities.
Freeways and the bridge approach
Which agency investigates turns on where the cars collided. Fremont Police officers take reports for crashes on city streets such as Mission Boulevard and Stevenson Boulevard, while I-880, SR-84 toward the Dumbarton Bridge and SR-262 appear on the patrol list of the CHP Hayward Area office at 2434 Whipple Road (CHP). An auto accident attorney in Fremont starts with that report, so confirm at the scene which agency’s number you were given.
Transit riders and rideshare passengers
Riders board BART at the Fremont and Warm Springs/South Fremont stations, catch ACE or Capitol Corridor trains at Fremont-Centerville, and ride AC Transit buses across town (BART). Because BART and AC Transit are public districts, a fall on a platform or an injury aboard a bus begins with a written government claim rather than a call to an insurance adjuster.
A rideshare trip that ends in a crash, say after a pickup at the Warm Springs station, is paid from layers of Uber or Lyft coverage that turn on whether the driver had accepted the ride, had you aboard or was only logged into the app. Our rideshare accident page explains the app-on, ride-accepted and passenger-aboard stages and which insurer answers for each.
Questions from riders and their families
The rankings say Fremont is safe. Does that weaken my claim?
No. A citywide ranking says nothing about the motorist who hit you on Mowry or Stevenson, and the same OTS tables show riders on two wheels faring far worse than the composite suggests.
My daughter was hit on her bike near school. Who makes the claim?
You do, on her behalf, as her parent or guardian, and a judge reviews whatever settlement is reached; seven Fremont children under 15 were hurt on bicycles in 2023, so this is a familiar situation here.
I was hurt on SR-84 near the Dumbarton Bridge. Where is the report?
With the Highway Patrol rather than Fremont Police, because the Hayward Area office on Whipple Road lists SR-84, SR-262 and I-880 among its routes.
Will my case end up in a Hayward courtroom?
Most Fremont claims settle with the insurer well before trial, and when suit is filed it will generally go to the Hall of Justice on Amador Street in Hayward, where we handle every filing and appearance.
I fell getting off a BART train at Warm Springs. Is that a different kind of claim?
Yes, because BART is a public transit district, and California requires a written claim to reach it within six months of the fall before any lawsuit can follow.
Deadlines that apply in Fremont
| Situation | Time limit | Rule |
|---|---|---|
| Injury involving a BART train, an AC Transit bus, a Caltrans ramp on I-880 or a City of Fremont street | Six months from the injury | Gov. Code §911.2 |
| Bodily-injury lawsuit against the motorist who hit you on Mission or Fremont Boulevard | Two years from the crash | CCP §335.1 |
| Property loss, from a bent bicycle frame to a totaled sedan | Three years | CCP §338 |
Responsibility is shared out by percentage in this state. A cyclist judged 20% responsible for a collision on Paseo Padre Parkway would still recover 80% of proven medical bills, lost wages and pain and suffering (CACI 405).
A lawsuit, if one becomes necessary, belongs in Alameda County Superior Court. The Fremont courthouse closed its civil clerk’s office in September 2011 and moved that work permanently to the Hayward Hall of Justice at 24405 Amador Street, where cases arising here are generally filed (court notice).
Where Fremont trauma patients go
On July 1, 2024, Washington Hospital began operating as a provisional adult Level II trauma center, the first in the Tri-City area and the fourth in Alameda County (Washington Health). Ambulances also carry seriously hurt patients from the south county to Eden Medical Center in Castro Valley, another adult Level II center (County EMS memo).
Tip: Before discharge from Washington or Eden, request the complete chart, including triage notes, CT and X-ray reads and follow-up orders, because the adjuster will study those pages before anything else.
Records worth gathering now
- Incident number from the Fremont Police officer, or from the Hayward Area trooper if the crash was on I-880 or SR-84
- Photographs of the bicycle, motorcycle or car before any shop or salvage yard touches it
- The names of storefronts on the crash block whose cameras faced the street
- Discharge paperwork and imaging reports from Washington Hospital or Eden
- Your auto insurance declarations page, which lists the uninsured motorist limits that matter after a hit-and-run, and Fremont had 37 hit-and-run injury crashes in 2023
- The six-month date on your calendar if BART, AC Transit, Caltrans or the city is involved
Call Jacob’s work for injured Fremont residents
The Law Offices of Jacob Emrani (Call Jacob) represents residents, East Bay commuters and visitors hurt on Fremont Boulevard, Mission Boulevard, Paseo Padre Parkway and the I-880 and SR-84 approaches. Because cyclists and motorcyclists stand out in the city’s 2023 numbers, we build those cases around the evidence that disappears first: storefront video, the condition of the bike and the scene measurements taken by Fremont Police.
The rest of our Fremont work follows the city’s own geography: a fall on a BART platform, an injury aboard an AC Transit bus, a car or truck collision on I-880, a pedestrian struck on Fremont Boulevard, an Uber or Lyft crash, a fall at a shopping center, a dog bite, and the wrongful death of a family member. When a city street design or a Caltrans ramp contributed to the crash, we prepare and present the government claim inside the six-month window. Anyone looking for a Fremont car accident lawyer, or an injury lawyer near Centerville, Irvington, Niles or Warm Springs, can arrange to meet with us at home or in a hospital room.
Whether the crash happened in Niles or at the Warm Springs station, the first conversation is free, and under our contingency fee you owe nothing unless we recover money for you. Call (888) 952-2952 to set a time, or tell us what happened on Fremont Boulevard, Mission or the Dumbarton approach through our free case evaluation form.
