What the General Plan crash study found

The city’s 2019 General Plan existing-conditions report reviewed SWITRS data for 2015 through 2017. It found between 256 and 296 vehicle collisions a year, about 27 of them involving a pedestrian or cyclist in an average year (General Plan report). Right-of-way violations were the cited cause in 36% of those collisions, unsafe speed in 26%, and failure to obey a signal or sign in 12%.

The report also noted that many residential neighborhoods lack crosswalks and traffic calming, and that drivers cutting through those streets may be speeding or distracted. State figures for 2023 point to the same speed problem. The 44 speed-related injury crashes OTS recorded ranked 20th-worst in Fountain Valley’s group of 103, even though its 229 total victims put it at a middling 48th (OTS). Five cyclists younger than 15 were also hurt that year, which ranked the city 11th of 103 for child cyclist injuries.

Agencies, hospitals and courts that hold your records

Records from the Talbert or Euclid emergency rooms carry the same weight as trauma-center records. What matters is that the records exist and that your follow-up care continues without interruption. Brookhurst Street accounted for four of the ten locations.

Brookhurst is a six-lane divided arterial that crosses the 405, and the 2019 report rated the Ellis Avenue segment between Bushard and Brookhurst at level of service F, its most congested grade. Stop-and-go traffic on a wide arterial often produces rear-end and left-turn crashes, in which fault depends on signal timing and following distance.

Tip: Businesses at Brookhurst and Warner or Harbor and Edinger keep surveillance video for only a limited time. Request the footage of your crash in writing as soon as you or someone on your behalf can go in.

The 405 after the widening

OCTA’s $2.16 billion I-405 Improvement Project added a general-purpose lane in each direction from Euclid Street to the 605, along with the 405 Express Lanes, which opened on Dec. 1, 2023 (OCTA). Years of construction changed the ramps, merges and lane lines through the city.

A crash on the 405 leaves a different trail of evidence than one on Brookhurst. The CHP report includes a diagram and statements, and the express lanes add toll-system data. The 2019 report observed that visitors park along the perimeter beside sidewalks and moving traffic, which places children, joggers and people unloading their cars close to passing vehicles. A pedestrian struck while stepping out from between parked cars may face an argument of comparative fault, but California law reduces the recovery only by the pedestrian’s own share (CACI 405).
