Fillmore Personal Injury Attorney

Fillmore has fewer than 17,000 residents (16,937 in the Census Bureau’s 2025 estimate) and one highway running through the center of town (Census). That highway, SR-126, accounts for most of the town’s serious crash concerns. A small town raises its own questions after an injury: which agency responded, why the ambulance went to Ventura, and whether a claim is worth pursuing at all. At a glance: In 2023, Fillmore’s streets and highway produced 69 traffic victims, a total exceeded by only 14 of the 103 cities in its OTS size group (OTS 2023). For a town of this size, that is a high ranking.

Is Highway 126 as dangerous as people say?

Its reputation is earned. The stretch of SR-126 between Santa Paula and the Los Angeles County line was once called “Blood Alley” because of head-on crashes on its older two-lane sections, and 34 deaths were recorded there from 1990 to 1994 (Wikipedia). Those figures are three decades old, and the road has since changed. Head-on collisions still happen, however. On December 24, 2024, a crash on Highway 126 near Fairview Canyon Road killed two people and injured at least three others; the CHP investigated (CBS Los Angeles).

Within town, SR-126 becomes Ventura Street, the only east-west route toward Piru, and it carries commuter and freight traffic between Ventura and Los Angeles counties directly through downtown. A county freight study describes it as dangerous for pedestrians and cyclists. UC Berkeley’s SafeTREC, working with residents, mapped where pedestrian crashes occurred from 2017 through 2021 (SafeTREC FY22 report):

Over that period, the town recorded 17 pedestrian crashes that injured 18 people, including 1 fatal crash and 3 severe-injury crashes. In more than half, a driver failed to yield to a person on foot.

The same freight study proposes an SR-126 project to reduce congestion and improve safety. Even before anything is built, that proposal confirms that planners regard the corridor as a problem.

A highway crash raises two issues that a crash on a town street usually does not. Freight trucks bring commercial insurance and carrier records into the case, and because SR-126 is a state highway, Caltrans, not the city, is responsible if the road’s design is at issue. For a dispute over how Caltrans built or maintains SR-126 through Fillmore, the notice is filed with the state’s Government Claims Program, not with City Hall, and it is due within six months (Gov. Code §911.2).

Did sheriff’s deputies or the Highway Patrol respond?

That depends on where the crash happened. The Fillmore Police Department is a contract service: the Ventura County Sheriff’s Office has policed the city since 1987 from the Fillmore Police Center at 524 Sespe Avenue (VCSO). Deputies investigate collisions on town streets.

On the highways, the CHP’s Moorpark Area patrols SR-23 and SR-126 from SR-23 in Fillmore east to the Los Angeles County line, as well as Piru (CHP Moorpark). Its territory combines towns with large agricultural areas, so farm equipment and produce trucks share the road with cars. If you are not sure which agency took your report, the card or incident slip you were given will say. If you received nothing, call the Sespe Avenue office first.

Does a trauma center in Ventura affect my claim?

It does not weaken your claim, but it does affect the records. Fillmore itself has no trauma hospital. The closest program on the state’s 2025 list is the county’s Level II center at Ventura County Medical Center, a drive down SR-126 in Ventura (EMSA trauma list, 2025).

A longer transport produces more records: the ambulance report, any air-transport record, the emergency department chart and imaging. Each should be requested. If you went home instead and saw a doctor later, the adjuster will notice that gap first. Write down why you waited, whether you had no ride to Ventura or your symptoms grew worse over several days, because soft-tissue and head injuries often appear late.

We don’t own a car. Can we still recover?

Yes. SafeTREC found that in 2021, 14% of Fillmore households had no vehicle and 38% included someone with a disability. Many residents therefore walk, bicycle or take the VCTC Intercity bus, whose terminal is near A Street and Santa Clara Street. The insurer for the driver who struck you is the first place to look for compensation.

If the driver had no insurance or too little, an auto policy held by a relative in your household may provide uninsured motorist coverage to you as a pedestrian or cyclist. Ask everyone who lives with you.

Cyclists face a particular pattern in Fillmore. The same report counted 10 bicycle crashes from 2017 through 2021, 2 of them with severe injuries, and 3 on Sespe Avenue, two of those at Sespe and Central. Workshop participants identified speeding there as a concern, and 40% of the bicycle crashes happened between 3 and 6 p.m. Caltrans has planned a painted bike lane on SR-126 between Santa Paula and Fillmore. An under-21 driver had been drinking. Who pays?

This happens more often here than the town’s size would suggest. Among 103 cities of similar size, only six had more victims of drinking drivers under 21 in 2023 (Fillmore had 3), and only eight had more victims of drinking drivers aged 21 to 34. For alcohol-involved victims overall, Fillmore ranked 14th.

Teenage drivers are often listed on a parent’s policy, and the owner of the family car may also be responsible. California also allows a separate claim against a licensed business that sold alcohol to an obviously intoxicated minor (Bus. & Prof. Code §25602.1). My mother was hit near Central Avenue. Is that common?

The concern is documented. At the SafeTREC workshop, residents spoke about older adults who walk near Santa Clara Street and Central Avenue and around the Parkview Court senior apartments at Central and Main Street. The 2023 state rankings bear this out: with 2 victims each, Fillmore placed 14th of 103 for walkers aged 65 and up and 6th for children under 15. The counts are small, but the rankings are high for a town of this size.

Older pedestrians often suffer fractures and head injuries that heal slowly, and a fall onto pavement can end a person’s ability to live independently. A claim should account for future care, help at home and the cost of moving to assisted living if that becomes necessary, not only the emergency room bill. What should we photograph on Ventura Street?

Crash scenes on the highway are cleared quickly because traffic has no other route. If you are able, or if a family member can go that day, photograph:

• Skid marks, gouges and debris, with a street sign or storefront in the frame
• Lane striping and any worn or missing crosswalk paint near A Street, B Street or Central Avenue
• Company names and truck numbers on any produce or freight vehicle involved
• The number of any VCTC bus that was nearby, since its cameras may have recorded the crash
• Bruising and swelling, photographed again every few days

Keep the original image files. Their time stamps and location data help establish when and where each photo was taken.

Time limits, the Hall of Justice and our fees

Section 335.1 of the Code of Civil Procedure generally allows two years to sue a private driver over a crash on Highway 126 or a town street (CCP §335.1). A public defendant such as Caltrans or Ventura County cannot be sued until it has received formal notice, and that notice has a six-month deadline. An insurer that blames you for crossing outside a crosswalk on A Street can reduce what you receive only by your share of fault (CACI 405).

If a lawsuit becomes necessary, it is filed at the Hall of Justice in Ventura (Ventura Courts), although most cases settle well before trial.
