Escalon Personal Injury Attorney
San Joaquin County
Escalon’s town center sits where State Route 120 crosses the BNSF main line, and that one crossing shapes a great deal of local driving (town overview). Escalon has 7,394 residents, yet 28 people were hurt or killed in its 2023 crashes, a count that ranked 9th of the 74 cities in its OTS population group (OTS 2023; Census 2025 estimate). Whether you are calling an Escalon personal injury attorney or just trying to find the police report, hospital chart or claim form your insurer keeps asking for, the sections below map each one to the road, office or deadline it belongs to.
Roads that produce Escalon’s serious crashes
SR-120 through and around town. SR-120 carries traffic between the Bay Area and Oakdale, where it meets SR-108. On May 7, 2025, at about 4 p.m., a westbound SUV crossed into the eastbound lane near Sexton Road and struck farm equipment head-on; the SUV’s driver was killed, and two juveniles and the equipment operator were seriously injured, according to the CHP (CBS Sacramento). The machine involved was a hay squeeze, and Escalon is home to one of the world’s largest walnut processors, so slow agricultural equipment on the highway is part of ordinary traffic here (town overview).
SR-120 at Brennan Avenue. In 2020, $446,066 was approved for improvements at this intersection, without a signal, with work slated for 2026 (town overview). The Escalon Times reported that an off-duty Stockton police officer who lived in Escalon was killed riding his motorcycle on SR-120 at Brennan Road, citing the CHP’s report (Escalon Times).
The BNSF crossing. The two-track main line divides the town, and meeting trains often hold SR-120 traffic for 20 to 30 minutes. Long backups at a crossing invite rear-end collisions and impatient passing.
Planned work on two other roads near the center of town:
- McHenry Avenue. The road south toward Modesto is planned for widening between Narcissus Way and Jones Road, with a new signal at McHenry and Ullrey Avenue. Escalon currently has only four stoplights, all within a quarter mile of one another.
- Escalon-Bellota Road. A widening from two to four lanes is planned from the city limits to Mariposa Road. On county roads near the city, San Joaquin County’s 2023 Local Roadway Safety Plan lists Escalon-Bellota Road at Copperopolis Road, Dodds Road and Flood Road among its priority rural intersections, ranked by collision severity using 2015 to 2019 data (County LRSP).
Watch out: If you were rear-ended while stopped for a train on SR-120, photograph the crossing arms, the line of stopped cars and the time on your phone. Backups at the crossing are well known, which makes a following driver’s failure to stop hard to excuse.
A car hit me from behind while I was waiting for a train. Is the other driver automatically at fault?
Not automatically, but a driver who plows into a line of cars stopped for a BNSF train at a crossing everyone in town knows backs up has very little to argue with.
When the road itself is part of the claim
A crash tied to a road condition, whether on a city street, Escalon-Bellota Road or SR-120 at Brennan Avenue, can point to the City of Escalon, San Joaquin County or Caltrans, and each of them must receive a written claim within six months (Gov. Code §911.2). Planned improvements, such as the Brennan Avenue project, do not by themselves prove that a road was dangerous, but they are worth noting for a lawyer reviewing that question.
The driver of the SUV, the grower whose hay squeeze was on the road, or a hauler from the walnut plant would instead face a lawsuit filed within two years (CCP §335.1). If an insurer argues that you pulled onto SR-120 at Brennan too soon, a jury can split the blame by percentage, and your award shrinks by your share instead of disappearing (CACI 405).
Before a road-condition claim is filed, gather what the agency will ask about:
- Photos of the pavement, shoulder, signs or sight lines at the exact spot
- The date and time, and whether a train, a tractor or a stopped line of cars was involved
- Names of anyone who has complained to the City or County about the same location
The County’s plan gives a sense of scale for those rural roads: 12,567 crashes over five years, and impaired driving behind 29% of the ones that killed or seriously injured someone (County LRSP).
I hit farm equipment on SR-120. Who is responsible?
It depends on the facts: the equipment’s lighting and position, the speeds involved and who crossed into whose lane. The equipment’s owner and the operator’s employer may both carry insurance that applies.
Escalon’s place in the 2023 OTS table
Each OTS row compares the town with 73 other small cities, and the closer a rank sits to 1, the worse the town fared. Beyond the 9th-place victim total, two hit-and-run injury crashes put Escalon 8th on that line, a reminder that drivers who flee are a real problem on a highway that leads quickly out of town. Three speed-related injury crashes ranked 29th; one bicyclist and one pedestrian were hurt, ranking 24th and 29th; and 2 alcohol-involved victims ranked 27th. The composite put it 40th of 74.
The city’s small department also booked 29 drivers for DUI that year; because the arrest column runs from fewest to most, 48th of 74 shows more enforcement than most towns its size.
An attorney for the SR-120 corridor
The Law Offices of Jacob Emrani (Call Jacob) represents people injured in Escalon, on SR-120, McHenry Avenue, Escalon-Bellota Road and the county roads around town. On an Escalon case we request the Escalon Police Department or CHP report, document the crossing or intersection where the crash happened, and file any claim against the City, the County or the State within six months. Head-on crashes with farm machinery, rear-end car accidents at the train crossing and motorcycle accidents such as the Brennan Road death reflect the local record; we also take truck crashes, hit-and-run cases, injuries to pedestrians and cyclists, dog bites, falls on unsafe property and wrongful death claims.
We will see you at your Escalon home, at your bedside in French Camp or on a phone call, and there is no charge for that first meeting with an Escalon car accident attorney; our fee is contingent, taken only from a recovery. Ring (888) 952-2952, or use the evaluation page to write out what happened on SR-120 or in town. Español: calljacob.com/es.
Escalon police, the CHP and the County
| Office | What it holds | Why you need it |
|---|---|---|
| Escalon Police Department | Reports for crashes on city streets | A small department of 12 full-time employees, with reserves, cadets and volunteers; its report is the starting record for a city crash |
| California Highway Patrol | SR-120 collisions beyond the city line, such as the farm-equipment crash near Sexton Road | Request that report from the CHP rather than from city hall |
| San Joaquin General | Emergency-room and trauma charts | The single Level II center on the state’s list for the county |
| San Joaquin County | Claims over county road conditions | A written claim about Escalon-Bellota Road or another rural road outside town goes here |
| Superior Court Civil Department | Complaints filed over local crashes | 180 East Weber Avenue, Stockton |
Table information comes from the town overview, CBS Sacramento, the EMSA trauma list and the court’s civil page.
The line between city police and the CHP matters because many SR-120 crashes near Escalon happen outside the city limits. The case number on the slip handed to you at the scene tells you which of the two agencies to ask; an Escalon PD number will not pull up a CHP file.
Hit-and-runs and the courthouse
A pickup clipped me in town and kept going toward Oakdale. Now what?
Call city police or the CHP from the spot, then give your own carrier written notice; your uninsured motorist coverage is what usually pays for a hit-and-run on SR-120 when the driver is never found.
Is there a courtroom in town for my lawsuit?
No. The county’s civil injury cases go to the Civil Department on Weber Avenue in Stockton, and most of the work before trial happens without you in the courtroom.
Train crossings, farm traffic and county road claims are described here as general information for residents, not as legal advice about a particular crash.
