Desert Hot Springs Personal Injury Attorney
Riverside County
Speed sets Desert Hot Springs apart. Police recorded 31 such crashes in 2023, a total exceeded by only nine of the 93 cities in the city’s OTS population group, and those were only the crashes with injuries or deaths (OTS 2023). With roughly 34,000 residents, the city still logged 160 casualties that year, 21st in the group. If you were hurt here and are speaking with a Desert Hot Springs personal injury attorney for the first time, you have probably already heard advice from friends, neighbors or an insurance adjuster. Some of it is wrong in ways that cost people money.
Deaths and injuries since 2016
| Year | Deaths | Injuries | Source |
|---|---|---|---|
| 2016 | 7 | — | Police chief |
| 2017 | 8 | — | Police chief |
| 2022 | 8 | 147 | City figures |
| 2023 | 4 | 155 | City figures |
| 2024 (Jan.–June) | 0 | 82 | City figures |
The 2016 and 2017 counts come from the police chief’s 2018 interview, when the city had the second-most crashes of the valley’s nine cities despite roughly 25,000 residents (CV Independent). The later figures were supplied by the city to KESQ in 2024 (KESQ).
Single crashes can be devastating. On September 2, 2019, a six-vehicle collision on Palm Drive south of 20th Avenue killed two people and injured nine, closing the road for 11 hours (Z107.7).
Seven assumptions worth correcting
“A speeding ticket is all the other driver faces”
Fact: Proven speed usually anchors the civil claim.
A citation is only the criminal side. In a civil claim, evidence that a driver was going well over the limit is often the strongest proof of negligence there is. Desert Hot Springs police have described commuters doing 70 mph on Palm Drive, the city’s main link to Interstate 10 (CV Independent). Three kinds of evidence can establish that speed after the fact:
- The airbag control module’s download
- Tire marks on Palm Drive
- How deeply each vehicle was crushed
Speed also changes the size of a claim. The same misjudged left turn produces a sore neck at 30 mph and a spinal fracture at 60.
“Every valley city uses the Sheriff”
Fact: This city polices itself.
Not this one. Unlike Coachella and La Quinta, which contract with the Riverside County Sheriff, Desert Hot Springs runs its own police department, funded in part by voter-approved utility users and public safety taxes (city overview). A crash on Palm Drive, Pierson Boulevard or a residential street is a DHS Police report.
Highway 62 and Interstate 10 are different. Those two highways belong to CHP Area 630, headquartered on Varner Road in Indio, whose territory includes Desert Hot Springs by name (CHP Area 630).
“Crossing mid-block ends a walker’s claim”
Fact: Mid-block walkers keep their claims.
In 2018 a 17-year-old girl was killed crossing Palm Drive. Pedestrians there were crossing five lanes of 45-mph traffic, and the nearest crosswalk was a quarter-mile away. After her death the city created a doubled-fine speed-safety zone on Palm Drive between Pierson Boulevard and Camino Aventura, at the family’s suggestion, and a grant project added a signal at Camino Aventura, narrower lanes, bike lanes, sidewalks and 23 LED streetlights (CV Independent).
California does not bar a pedestrian’s claim because the person crossed mid-block. A jury instead splits the blame in percentages (CACI 405), and the walker’s recovery shrinks only by whatever portion is assigned to her. A driver going 70 in a 45 zone may carry most of that share.
The city’s own figures show why the question matters. The city told KESQ that 5 pedestrians died on its streets in 2022 and 16 more were hurt (KESQ). OTS counted 12 in 2023 (OTS 2023).
“Bad intersections are nobody’s fault”
Fact: Road owners can be liable.
Often someone is. A public entity can be liable for a dangerous condition of its property, including a road whose design or signals create a substantial risk. The intersection of Palm Drive and Dillon Road was where “No Matas” (“Don’t kill”) signs appeared in 2018, demanding a signal and a crosswalk. In 2025 the KESQ I-Team ranked it the third most dangerous intersection in the Coachella Valley, with at least 15 collisions between January and August, one of them fatal (KESQ I-Team).
Years of crashes and protest signs at one corner do not win a case by themselves; what they can do is show that whoever owns the road had notice. Whether Palm Drive and Dillon belongs to the city or the county at a particular corner is a question to settle early, because the claim goes to whichever agency owns it.
Watch out: A Palm Drive or Dillon Road defect claim must reach the city or county in writing within six months (Government Code §911.2).
“Riders lose these cases”
Fact: Evidence decides rider cases.
Riders do hear that argument. Fourteen were killed or hurt here in 2023. That was 15th of 93 (OTS 2023). The argument is answered with evidence, not assumptions: sight lines, the other driver’s speed, helmet-camera footage and the physical damage.
Wind deserves a mention. The windmill farms on the city’s west side and in the San Gorgonio Pass are there for a reason (city overview). A gust is not a defense for a driver who drifts into a rider; drivers are expected to slow down for conditions they can see and feel.
“My lawsuit belongs in Indio”
Fact: Larger cases go to Palm Springs.
Unlimited civil filings from the city’s two ZIP codes, 92240 and 92241, belong there under the rule the court adopted for cases filed from August 1, 2026 (filing order).
“Deadlines can wait”
Fact: Some deadlines arrive in months.
There is more hurry than most people think. Even a claim against an ordinary motorist expires: two years is the general limit for filing suit over your injuries (CCP §335.1), and the video along Palm Drive usually disappears long before that. The six-month rule for public entities comes sooner still.
Asked by neighbors on the hill
Highway 62 is a state route. Does DHS Police still handle it?
Usually not. Highway 62 is on the Highway Patrol’s list of routes, so the CHP’s Indio office normally writes that report.
My mother was hit on Palm Drive at night. The driver says she came out of nowhere. What helps?
Streetlight placement, the driver’s speed, and video from businesses nearby. The grant project in the speed-safety zone added 23 LED streetlights, which bears on what a driver could see.
Can I still claim if I wasn’t wearing a helmet?
Yes. Riding without one lets the insurer argue that part of a head injury was avoidable, and damages for that injury may be trimmed; the rest of the claim stands.
I spend half the year out of state. Can my case go on while I’m away?
Yes. Most of a case can be handled by phone, email and video.
Getting care from the hill
Desert Hot Springs sits above the valley floor, and the nearest designated trauma centers are below it. From there, the city is served by Desert Regional Medical Center in Palm Springs, the region’s top-rated (Level I) trauma hospital, and by Eisenhower Medical Center in Rancho Mirage, rated Level IV (EMSA). Ask for your full chart, including imaging and the ambulance crew’s report, before you speak with any insurer about your injuries.
