Del Rey Oaks Personal Injury Attorney

Monterey County

Nine traffic victims in a year would pass without notice in most cities, but Del Rey Oaks has only about 1,536 residents (Census). That 2023 total put it fourth from the top among the 32 smallest cities the Office of Traffic Safety compares (OTS 2023). For a Del Rey Oaks personal injury attorney, that figure points first to the town’s main road, a state highway, and to the traffic that passes through on it.

The state’s tables do not say where in the city those crashes happened. What can be said is that the city covers just 1.1 square miles between Seaside and Monterey, and that its main road is a state highway carrying drivers between Highway 1 and Highway 68 (Wikipedia). This page follows that road from one end to the other.

Year 2023CountPlace out of 32

Nighttime injury crashes, 9 p.m. to 3 a.m.14
Alcohol-involved victims15
Pedestrians, cyclists, motorcyclists0 each24, 27, 29

Reading the table: with numbers this small, one late-night crash is enough to put a city near the top of a column, so these places describe a single year. The arrest figure runs the other way: officers made 7 DUI arrests, and on that row first place belongs to the city with the fewest arrests.

Canyon Del Rey Boulevard in town

Canyon Del Rey Boulevard, the city’s main street, is also State Route 218, running from Highway 1 near Monterey State Beach, through Del Rey Oaks, to Highway 68, the Monterey–Salinas Highway. The Transportation Agency for Monterey County is studying the corridor together with Del Rey Oaks, Seaside and Caltrans, with the stated aim of making it safer for people driving, walking, biking and riding transit (TAMC). The improvements under discussion include sidewalks, lighting, safer crossings and transit service, and a segment of the planned FORTAG trail follows the same canyon.

A study of that kind tells you what public agencies have already recognized about a road. If missing lighting or an unsafe crossing on SR-218 contributed to your crash, the State of California, through Caltrans, owns the highway, and the study’s public record can help show the condition was known. Knowledge of a problem does not by itself prove the State is liable, but it is the kind of fact a dangerous-condition claim is built on.

Evidence along the boulevard

  1. Write down the agency. On a state highway that runs through a small city, it is not always obvious which department took the report. The officer’s card answers that.
  2. Photograph the shoulder and the lighting. If the corridor is later rebuilt, your photos may be the only record of how it looked the day you were hurt.
  3. Look for cameras at businesses facing the road and ask that the footage be kept.
  4. Note the direction of travel for each vehicle, since much of the boulevard’s traffic is heading for Highway 1 or Highway 68 rather than stopping in town.

The Highway 68 junction

The boulevard ends at Highway 68 a short distance beyond the city line (Wikipedia). Once you cross that line, a highway collision belongs to the CHP Monterey Area, whose officers patrol the coastal and valley highways from Salinas (CHP).

The ambulance route

For a serious injury, the ambulance would typically head 15 miles east on that same highway to Natividad Medical Center in Salinas, a Level II trauma center (EMSA).

Tip: A pickup or delivery driver hurrying between Highway 1 and Salinas may be working at the time. Ask whose vehicle it is and photograph any company name on the door, because an employer’s insurance can be part of the claim.

Our work on Canyon Del Rey Boulevard cases

We represent residents of Del Rey Oaks and the commuters who use Canyon Del Rey Boulevard between Highway 1 and Highway 68. When we take a case from the corridor, we pursue the collision report, preserve video from businesses along SR-218, and check the TAMC corridor study for anything it says about the place you were hurt. If the State’s highway itself played a part, we prepare the six-month claim to Caltrans.

Given the traffic on SR-218, car accidents are the cases we expect most often from this city. Beyond those, we take truck and work-vehicle collisions, motorcycle crashes, pedestrian accidents at the boulevard’s crossings, bicycle accidents, Uber and Lyft rides, dog bites, and wrongful death claims for families.

Del Rey Oaks residents can talk the crash over with us at no charge, and no attorney fee is owed unless we recover money. Reach the office at (888) 952-2952, or fill in the case evaluator; when getting out of the house is hard, a representative will visit you at home.

When a claim against Caltrans is due

If the highway’s design or upkeep is part of the case, Caltrans and the State have to receive a written claim no later than six months after the injury (Gov. Code §911.2). Suing the other motorist is a separate track, with two years to file under California’s general injury statute (CCP §335.1). Either kind of case would go to the Superior Court’s civil division at the Monterey Courthouse, 1200 Aguajito Road, a short drive from the city (Superior Court).

What people along SR-218 ask

Nine victims seems high for a town this size. Why?

The state does not say where the nine 2023 victims were hurt. The likely reason is the highway: Canyon Del Rey Boulevard carries drivers between Highway 1 and Highway 68, many of them only passing through.

Is Canyon Del Rey Boulevard a city street or a state highway?

It is State Route 218. That matters if the road’s condition was a factor, because the claim then goes to the State and the six-month deadline applies.

I was hit where the boulevard meets Highway 68. Who has the report?

The junction sits just beyond the city line, so the report is most likely held by the Highway Patrol’s Monterey Area office in Salinas.

Will the corridor study help my case?

It can show that agencies already saw a need for sidewalks, lighting or better crossings. Fault for your collision still turns on what witnesses, photos and the report show about that particular moment on SR-218.

Everything above about SR-218, the Highway 68 junction and the filing limits is general information; it is not legal advice, and a lawyer reviewing your own facts may see them differently.
