Dana Point Personal Injury Attorney

Orange County

Sixteen bicyclists were killed or injured on Dana Point streets in 2023, placing the harbor town 11th worst of 93 comparably sized California cities for riders (OTS 2023). Road cyclists on Pacific Coast Highway pass harbor entrances, beach lots and restaurant driveways where drivers turn across the bike lane. As a Dana Point personal injury attorney, Call Jacob has built this page around the three days after a coast-highway crash, when choices about photos, doctors and insurers count most, and then the deadlines that come later.

At a glance: Dana Point

  • 32,232 residents (2025), with nearly one in four past 65 (Census)
  • Crash calls go to Sheriff’s deputies at the Golden Lantern office
  • Catalina Express boats leave the harbor for Avalon
  • Serious trauma goes inland to Mission Viejo

A fatal crash at Harbor Drive

Around noon on November 7, 2025, a 71-year-old man walking near Pacific Coast Highway and Dana Point Harbor Drive was struck and killed. The driver left the scene and was later arrested on hit-and-run and suspected DUI charges, and the Sheriff’s Major Accident Investigation Team took over the case (OC Sheriff).

Three rows of the table meet in that one collision: a pedestrian, a fleeing driver and alcohol. It also shows who investigates. Dana Point Police Services is a Sheriff’s operation at 33282 Golden Lantern, Suite 140 (OC Sheriff), and when a crash is serious, the Sheriff’s own reconstruction specialists step in.

Watch out: A runaway driver on PCH leaves many victims with one realistic payer, the uninsured motorist portion of their own auto policy. Carriers expect a law enforcement report, so phone the Golden Lantern deputies within a day, even after a quick emergency room release.

Cyclists, speed and late drinking in 2023

Measured across every category together, the harbor town landed 36th of 93, unremarkable on its own. The categories below sit well above that middle, and each one ties back to the coast highway, the harbor or the beach.

Category, 2023Dana PointPosition (1 = worst)
Bicyclists hurt or killed1611 of 93
Speed-related injury crashes1925 of 93
Hit-and-run injury crashes1225 of 93
Victims of alcohol-involved crashes1827 of 93
Motorcyclists hurt or killed1030 of 93
All victims11739 of 93
Pedestrians hurt or killed849 of 93

Wrecks on I-5 east of town belong to the Highway Patrol’s figures and are absent here. With counts this small, one bad summer weekend at Doheny moves a category several places, so read the table as a description of the town’s streets rather than proof about your crash.

From the curb to day three

On the pavement by the harbor

Get clear of moving traffic, then dial 911. Critically hurt riders leave the coast by ambulance for Providence Mission, a hospital up the I-5 corridor that state regulators have designated for both adult and pediatric trauma at Level II (California EMSA). If you are able to before the ambulance leaves:

  • Shoot the bike, helmet and cleats exactly where they landed
  • Note whether you were nearer Del Prado, Golden Lantern or the harbor entrance
  • Hand your phone to a valet, barista or harbor worker who saw it

That night

A rider who slid across asphalt commonly discovers a cracked wrist or a concussion only once the adrenaline wears off around dinnertime. If you waved off the paramedics at the scene, get to an emergency department before bed. Insurers treat that first chart entry as the baseline and question anything that appears later.

The second-day phone call

Expect the motorist’s carrier to reach out on the second day. Confirm who you are, then tell the caller you will discuss the crash after your doctors finish their workup.

Tip: If the driver had come from a harbor bar or a festival beer garden, jot down the venue and the hour; that detail can open a second avenue of recovery.

Collecting video in the Lantern District

By the third day, storefront cameras on Del Prado and PCH, harbor restaurant systems and the Doheny State Beach lots are already overwriting older footage.

Tip: Ask in person, and follow up in writing.

Your folder by then should hold:

  • Golden Lantern report number
  • Every page the emergency room handed you
  • Bruise and road-rash photos, dated
  • A bike shop estimate for frame, wheels and components
  • Missed shifts

What riders and visitors ask us

A parked driver on PCH opened a door into my bike. Who is responsible?

In a typical dooring case, the person who opened the door into the bike lane is at fault, and that driver’s auto policy covers your medical bills and lost income.

The car that hit me on PCH never stopped. Is there any coverage?

Yes, in many cases. Two paths exist:

  • Deputies trace the car, sometimes through harbor or storefront cameras, and its insurer pays.
  • The driver is never found, and the uninsured motorist benefits under your own policy step in, provided the crash was reported.

I slipped on the Catalina Express dock. Is that a car accident claim?

No. A fall on a dock, gangway or harbor ramp is a premises liability matter against whoever controls that surface, and if a public agency controls it, a written government claim is due within six months.

My mother is 78 and was hit in a crosswalk near the harbor. Does her age change the claim?

Her age does not reduce her rights. It often lengthens recovery, and the cost of rehabilitation, in-home help and follow-up care belongs in what the at-fault driver owes.

We were on vacation when it happened. Do we need to come back to California?

For most of the case, no. If a lawsuit is filed, it goes to the Orange County Superior Court, and a deposition or trial date could bring you back; many claims settle well before either.

Visitors, ferry passengers and festival crowds

On a summer Saturday the town holds far more people than live in it. The harbor’s shops, restaurants and Ocean Institute, the Catalina Express dock, Doheny State Beach and the surf breaks all pull visitors in (Wikipedia).

Out-of-state guests who were hurt here keep a California claim. Treatment can continue with your own doctors back home. When we represent a visitor hurt in Dana Point, we order the Golden Lantern report and the harbor-area video ourselves, so the case moves forward after you fly home.

Residents skew older as well. According to the 2020 census figures, 24.5% of Dana Point residents had reached 65 (Wikipedia), and a hip fracture or head injury at 70 means months of rehabilitation that belong in the damages calculation.

From six months to three years

Once the first week passes, recovery is your job and the clock is ours to watch:

DeadlineWhat it covers
Six monthsWhen a city truck, County pavement or harbor dock owned by government contributed (Gov. Code §911.2)
Two yearsMost suits against a private motorist, restaurant or landlord (CCP §335.1)
Three yearsFrame, wheels or bumper, if only property was harmed

Shared blame does not end a case in California. If a jury decides that a rider without a rear light at dusk on Dana Point Harbor Drive was 20% responsible, the award drops by that 20% and no more (CACI 405).

Representing cyclists, visitors and residents

Call Jacob represents road cyclists, beachgoers, harbor workers and visiting families hurt on Pacific Coast Highway, Del Prado, Golden Lantern and the streets around the marina. On a Dana Point case we request the deputies’ report from Golden Lantern or, after a serious crash, the Sheriff’s reconstruction findings; we canvass the Lantern District and harbor for video; and we negotiate with insurers, including your own carrier after a hit-and-run on PCH.

Our work here covers:

  • Bicycle accidents on PCH and Dana Point Harbor Drive
  • Pedestrian accidents in Lantern District crosswalks
  • Car and motorcycle collisions on the coast highway
  • Drunk-driving crashes after harbor and festival events
  • Rideshare and bus injuries
  • Dock and walkway falls under premises liability law
  • Dog bites on beach trails
  • Wrongful death claims after a fatal crash on PCH

Anyone searching for a Dana Point car accident lawyer can talk with us without charge, at a house, a hotel or a hospital room, and our fee is owed only if we win. For a coast-highway crash, the quickest route is a call to (888) 952-2952; the case evaluator takes written details if you prefer. En español: calljacob.com/es.
