Cotati Personal Injury Attorney
Sonoma County
Highway 101 still runs straight through Cotati, the smallest city in Sonoma County, and this guide is organized around five roads that define how people move through town. Below, each road gets a section covering its crash history, the agency with jurisdiction and the records worth requesting, written from the view of a Cotati personal injury attorney. The state’s 2023 rankings placed Cotati 7th of 74 small cities overall, with 1 the worst, and that ranking rests on a few dozen injuries (OTS).
- The counts behind the ranking
- The Cotati Grade
- Old Redwood Highway and the hexagon
- Gravenstein Highway from the east
- East Cotati Avenue toward the university
The counts behind the ranking
A 7th-place finish sounds alarming, and the category ranks are high for a city of about 7,300 people (Census). The counts are modest, so read each rank next to its number.
| Measure | Number | Place |
|---|---|---|
| Composite ranking | — | 7 |
| Hit-and-run crashes | 3 | 6 |
| Alcohol-involved victims | 7 | 8 |
| Bicyclists | 5 | 8 |
| Drinking drivers aged 21–34 | 3 | 9 |
| Speed-related crashes | 8 | 9 |
| Motorcyclists | 4 | 11 |
| Pedestrians | 3 | 12 |
| Nighttime crashes | 3 | 12 |
| All victims | 33 | 13 |
Source: OTS 2023. In each of these rows, a smaller place number is worse. The 64 DUI arrests Cotati officers made that year sit outside this logic: OTS sorts arrest totals from fewest to most, so 66th describes how actively local police enforced DUI laws, not how many crashes impaired drivers caused.
Hit-and-run is the category where Cotati’s ranking was worst, 6th, on the strength of three crashes.
Cotati is one of seven Sonoma County cities with a Local Road Safety Plan developed or under way, according to the county’s 2022 Vision Zero plan, which lists no Cotati segments on its high-injury network (Vision Zero plan).
The Cotati Grade
North of town, US-101 and State Route 116 share a multi-lane freeway alignment that Caltrans calls the Cotati Grade, with exits at Railroad Avenue and West Sierra Avenue (city history). The freeway splits the town in two.
On the Grade itself, the investigating officers come from the CHP’s Santa Rosa Area, based at 6100 LaBath Avenue (CHP). KRON4 described one of the worst: a wrong-way driver striking oncoming traffic on southbound 101 near Gravenstein Highway at about 1:53 a.m., a four-vehicle collision in which one car caught fire (KRON4). KRON4’s report carries no clear date, so we cite it only as an example of what the Grade can produce at night.
Freeway evidence
| Record | Who holds it |
|---|---|
| Report | CHP |
| Photos and video | You and witnesses |
| Vehicles | Tow yard |
| Dashcam video | Other drivers |
None of those freeway collisions are counted in the OTS table above, which covers only Cotati Police Department cases.
I was hit on the 101 near the West Sierra exit. Will the Cotati Police Department have the report?
Probably not. The West Sierra and Railroad Avenue ramps are part of the Grade, which the CHP patrols, so ask its LaBath Avenue office for the report.
Old Redwood Highway and the hexagon
Before 1955, US-101 ran through Cotati’s downtown plaza on what is now Old Redwood Highway (city history). The plaza, laid out in the 1890s by Newton Smyth, is one of only two hexagonal town plans in the United States and is California Historical Landmark No. 879. For a pedestrian or driver hurt around La Plaza Park, the layout itself becomes part of the evidence: sight lines, crosswalk markings and who had the right-of-way at each corner.
The 2021 motorcycle crash
Old Redwood Highway carries fast traffic once it leaves the plaza. On August 11, 2021, a northbound motorcyclist lost control on a curve near Highland Avenue, south of Cotati, struck a guardrail and died, according to the CHP (CBS News). For a rider hurt on a curve like that one, the questions a Cotati motorcycle accident attorney asks are whether the guardrail, signage and pavement met standards, and whether another vehicle forced the rider wide (motorcycle accident claims).
Watch out: Guardrail and pavement evidence changes quickly after a crash, because crews repair damage. Photograph the curve, the rail and any skid marks within a day or two.
Gravenstein Highway from the east
State Route 116 also enters Cotati from the east as the two-lane Gravenstein Highway (city history). The two-lane eastern stretch is still Route 116, a Caltrans highway; if its shoulders, striping or sight lines played a part in a crash, the public entity responsible is the State, and the city has no role.
East Cotati Avenue toward the university
Sonoma State University sits about a mile east of the city limits, and East Cotati Avenue is the link between campus and town (city history). The SMART commuter rail station, open since August 2017, is in the same area, and Golden Gate Transit routes 72, 75 and 80 and Sonoma County Transit buses also serve Cotati.
Students on bikes, rail commuters walking to the platform and drivers share this corridor. Cyclists made up five of the city’s 33 casualties in 2023, which ranked 8th in the group (OTS). For a cyclist hit near the station, a Cotati bicycle accident lawyer will want witness statements from the platform, photos of the bike-lane striping and the driver’s phone records.
I was hurt at the SMART station. Who is responsible?
That depends on what happened. If a train, a platform hazard or SMART staff were involved, the claim goes to SMART as a public agency within six months. We handle SMART and Golden Gate Transit claims for Cotati riders and prepare that notice for the agency.
Deadlines and the county court
For a crash with another motorist on Old Redwood Highway or the Grade, California allows two years to file a lawsuit (CCP §335.1). Public bodies get a shorter clock: if the claim is against the City of Cotati, against Caltrans over Route 116, or against SMART or Golden Gate Transit over a train or bus, the written claim is due within six months (Gov. Code §911.2).
Tip: A government claim has to state the date, place and circumstances of the injury. A vague claim invites a rejection letter, and that letter starts another short deadline to sue.
Insurers often argue that someone circling the plaza shares the blame. That argument, even when it partly succeeds, only lowers the recovery by the percentage assigned (CACI 405). Should a lawsuit become necessary, it is filed in Sonoma County’s Superior Court, and any trial would be in front of a local jury (court locations).
Hospital records are part of the same early work; Providence runs the region’s Level II trauma program at Santa Rosa Memorial (Providence).
How Call Jacob handles Cotati cases
The Law Offices of Jacob Emrani (Call Jacob) represents people hurt on the Grade, around the hexagon and along East Cotati Avenue, including residents, Sonoma State students and SMART commuters looking for an injury lawyer near Cotati. Our first call on a new Cotati matter is to whichever records unit holds the report, the Cotati Police Department for city streets and the CHP office on LaBath Avenue for the freeway, since freeway video and tow-yard evidence do not wait. The injuries we see from Cotati follow the state’s numbers:
- Drunk-driving and hit-and-run crashes
- Cyclists and motorcyclists
- Pedestrians in the plaza
- SMART and bus passengers
- Rideshare passengers
- Wrongful death claims
Reviewing a Grade or plaza collision with us is free, and a case that recovers nothing costs you nothing. A member of our team can come to your apartment near campus or your room at Santa Rosa Memorial. Students and commuters reach a Cotati car accident lawyer on (888) 952-2952, and the case evaluator lets you start from a phone between SMART trains.
Questions from Cotati drivers, riders and students
Someone hit my car near La Plaza Park and drove away. Is there anything I can do?
Yes. Three things help most:
- A same-day police report
- Footage from shop cameras facing the hexagon
- Any plate digits you caught
Check whether your policy carries uninsured motorist coverage; it is the part that responds when a hit-and-run driver vanishes.
I’m a Sonoma State student from out of the area. Does that change my claim?
No. A collision in Cotati is governed by California law, and an auto accident attorney in Cotati can pursue the claim here even if your permanent address is elsewhere.
Does the 7th-place ranking prove my street is dangerous?
No. It is a statewide comparison built on small counts. It can provide context, but your claim depends on the evidence from your own collision.
Written as general information on the Cotati Grade, the hexagon, Old Redwood Highway and the six-month and two-year deadlines; none of it is legal advice.
