Chino Hills Personal Injury Attorney

San Bernardino County

In 2023 the state counted 121 traffic casualties on Chino Hills streets, a lower total than all but five of the 103 California cities in its population group (OTS 2023). The serious crashes that do happen here tend to cluster on a few roads, above all Carbon Canyon Road and the 71. People hurt on those roads tend to bring a Chino Hills personal injury attorney the same seven questions, and the sections below take them one at a time.

Jump to a question:

Why does Carbon Canyon Road come up so often?

Carbon Canyon Road carries the State Route 142 designation from Brea, over the hills, down to SR-71 at Chino Hills. It is the only direct road from Chino Hills to Orange County, which has made it a popular shortcut between the two counties, and its tight curves, landslide-prone slopes and hazardous-fire-area signs make it unforgiving (SR-142).

A city-commissioned corridor study of the stretch from Chino Hills Parkway to Feldspar Drive listed four main problems: trucks moving through the S-curves, drivers perceived to be speeding, poor sight lines from side streets, and the safety of people walking and riding bicycles (Champion Newspapers). The same newspaper reported a fiery head-on collision near Chino Hills Parkway at 5:48 a.m. that killed a 29-year-old Whittier man; a 20-year-old driver was arrested on suspicion of gross vehicular manslaughter while intoxicated.

What changed when trucks were banned

In June 2024, Chino Hills began enforcing a ban on trucks with more than four axles along the 8.5-mile route. Violators face a $238 fine and a point on their DMV record, and local deliveries are exempt. The city had paid for traffic studies in 2017, 2018 and 2021, and its police chief said the road was “really not designed” for those trucks. Chino Hills Police enforce the ban on the San Bernardino County side and Brea Police on the Orange County side (CBS Los Angeles).

That ban matters if a large truck was involved in your crash. A carrier that sent a five-axle rig through the canyon in violation of the restriction has a hard time arguing that its driver acted reasonably. Cyclists have described close calls with trucks on the same curves. Our bicycle accident and truck accident pages go further into each.

Watch out: Caltrans has proposed widening the Carbon Canyon switchbacks, and residents have organized against it (California Globe). If roadwork is under way when you are hurt, photograph the signs and lane closures that day.

Is Chino Hills a dangerous place to drive?

Not by most measures. The city’s 2023 figures sit near the bottom of its peer group in almost every category the Office of Traffic Safety tracks:

2023 categoryChino HillsRank of 103
All victims12198
Pedestrians699
Bicyclists888
Speed-related crashes2874
Motorcyclists962
Young drinking drivers (21–34)1060

A rank of 1 belongs to the city with the most victims or crashes, so a high number here is good news. Only one line on that list sits near the middle of the pack: victims of drinking drivers aged 21 to 34. Crashes where speed was a factor went the wrong way between the two most recent years, climbing from 23 to 28 (OTS 2022).

Low averages offer little comfort to someone who was hurt, and they say nothing about an individual crash. What matters in a Chino Hills claim is the specific road, the evidence from that morning or night, and the injuries that followed.

Who investigates a crash here?

Since 1991, the deputies patrolling Chino Hills have been San Bernardino County Sheriff’s personnel working under a contract with the city. They work out of the Chino Hills station at 14077 Peyton Drive and operate as Chino Hills Police (Sheriff). They take reports for crashes on Chino Hills Parkway, Peyton Drive and the city’s other streets.

A crash on the 71 or the 60, or on county land outside city limits, is a Highway Patrol case instead, handled from its Pittsburgh Avenue office in Rancho Cucamonga; that office’s coverage list names Chino Hills (CHP Area 855).

Before leaving, write the report number on your phone along with the officer’s agency, because a Sheriff’s deputy and a Highway Patrol officer file their reports in different places. If a Sheriff’s vehicle was involved in your crash, the claim runs against San Bernardino County, which has its own six-month deadline.

What should I know about crashes on the 71?

The Chino Valley Freeway, SR-71, ties the city to SR-60 in one direction and SR-91 in the other. On March 19, 2023, a wrong-way driver traveling north in the southbound carpool lane near Chino Hills Parkway struck another car head-on. The wrong-way car caught fire, and four people died (ABC7).

Head-on freeway crashes produce catastrophic injuries and, when someone dies, wrongful death claims by the family. If the at-fault driver carried little or no insurance, your own uninsured and underinsured motorist coverage can become the main source of recovery, so find your policy declarations page early.

Not every deadly Chino Hills crash happens on the 71. CBS Los Angeles reported that a 44-year-old Chino Hills motorcyclist riding north on Chino Hills Parkway was killed when a vehicle pulled out of a shopping center near Pipeline Avenue (CBS Los Angeles).

Which hospital will I go to?

Chino Hills itself has no designated trauma hospital. The closest one, Pomona Valley Hospital, sits across the county line and is designated Level II (EMSA). For burns and the most critical trauma, patients are sent to Colton, where Arrowhead Regional serves as San Bernardino County’s Level I center and the burn unit for four counties (ARMC).

If you were treated in Pomona, your records sit in a Los Angeles County hospital even though the crash happened in San Bernardino County. That is not a problem, but the records request must go to the right place.

How long do I have to make a claim?

  • Six months: the window to present a written claim to Caltrans over Carbon Canyon Road or SR-71, to the City of Chino Hills over a city street, or to San Bernardino County when a Sheriff’s vehicle caused the crash (Gov. Code §911.2).
  • Two years: a lawsuit against the at-fault motorist, or against the carrier whose rig ignored the axle ban (CCP §335.1).

Suppose a jury decides a motorcyclist took a Carbon Canyon curve too fast and puts 20% of the blame on him. California’s rule is pure comparative fault, which means the 20% is subtracted from his award instead of cancelling it.

Why is my case in Rancho Cucamonga?

Chino Hills appears in the Rancho Cucamonga District on the San Bernardino Superior Court’s filing guide, which is why an injury lawsuit from here is filed at 8303 Haven Avenue rather than in San Bernardino (Superior Court). Few injury claims ever reach a courtroom, but if yours does, Haven Avenue is where hearings and trial would take place.

What we do on a Chino Hills case

The Law Offices of Jacob Emrani represents people hurt in Chino Hills, from residents who use Carbon Canyon Road every day to commuters on the 71 and riders on Chino Hills Parkway. On a Chino Hills case we investigate the crash ourselves: we obtain the Sheriff’s or CHP Rancho Cucamonga report, check whether a truck was violating the Carbon Canyon axle ban, collect the Pomona Valley or Arrowhead Regional records, and prepare any claim to Caltrans, the City or the County within six months.

Beyond car accident claims, our Chino Hills work includes wrong-way freeway crashes on the 71, big-rig collisions in the canyon, motorcyclists hit on Chino Hills Parkway, cyclists and walkers struck on Carbon Canyon Road, slip-and-fall injuries at local businesses, dog bites and wrongful death claims. Home and bedside visits at Pomona Valley or Arrowhead Regional are available when travel is not.

Call (888) 952-2952 to reach a Chino Hills car accident attorney, or lay out the Carbon Canyon, Parkway or freeway crash in our case evaluator. You will not be charged for the consultation. Once we accept a case, our compensation is tied to the result, so a case that recovers nothing costs you nothing.

A few more questions

The other driver’s insurer wants a recorded statement about my Carbon Canyon crash. Should I give one?

Not before you speak with a lawyer. Questions about your speed on the curves or where you were looking are often aimed at shifting fault toward you.

Which police department handles the Orange County end of Carbon Canyon Road?

Brea Police enforce the truck ban on the Orange County side, while Chino Hills Police cover the San Bernardino County side. The exact spot on the road decides whose report you will need, so ask the officer at the scene which side of the county line you were on.

A large truck was in the canyon even though big rigs are banned. Does that help my case?

It can. A violation of a safety restriction is strong evidence that the trucking company or driver was careless.

My teenager was hurt in a crash with a driver who had been drinking. What can our family do?

Bring a claim against the driver’s insurance and, depending on the facts, against others who share responsibility. Your teenager’s own injury claim gets extra time, because the two-year period to sue generally does not begin until age 18. A claim against a public agency still has to be presented within six months, though late-claim relief is sometimes available for minors.

These answers are a general starting point for Chino Hills families, not legal advice about any particular collision.
