Carmel-by-the-Sea Personal Injury Attorney
Monterey County
Carmel-by-the-Sea has no traffic signals, no streetlights and, on its residential blocks, no sidewalks, so people on foot share the lanes with cars (Wikipedia). In 2023 that showed up in the state’s figures: of five people recorded as killed or hurt in village crashes, two were walking, and one of those two was 65 or older (OTS 2023). If a car struck you here, the decisions made in the first three days shape the claim. What follows is the order a Carmel-by-the-Sea personal injury attorney would take them in, from the street corner to the end of the first week.
Where the village stood in 2023
- 7th on pedestrian victims in a 74-city peer group, where 1 is worst
- 3rd of 74 for pedestrians aged 65 and up
- 5 total victims, a middling 38th
- The Office of Traffic Safety files the city under the name “Carmel”
On a village street without addresses
For most of its history the village also had no street addresses. In July 2024 the council voted to create them, and in October 2025 it approved assigning building numbers, citing navigation tools that cannot work without one (Wikipedia). That history explains the first instruction below.
- Describe the spot by its corners. A dispatcher can find “Ocean Avenue at San Carlos Street” even when a cottage number is new or missing from a map.
- Step out of the lane. Without a curb or sidewalk, the road edge is the only refuge, and the next driver around the bend will not expect a person standing there.
- Photograph the lighting. At night, what a driver could see on an unlit block is part of the liability question, so take some pictures from the driver’s side of the car.
- Ask each witness where they are staying. Many people on Ocean Avenue are guests at inns who will drive home within days.
Hours one through twelve
Which officers come
Village streets are the Carmel-by-the-Sea Police Department’s responsibility after a collision (City of Carmel-by-the-Sea). Highway 1 skirts the eastern side of town and belongs to the CHP, whose Monterey Area officers work out of Salinas (CHP).
Where an ambulance heads
An ambulance carrying a badly hurt pedestrian from the village will usually cross the hill to Natividad Medical Center in Salinas, a Level II site (EMSA). It is the county’s sole entry on that state roster. Family members following the ambulance should bring the patient’s insurance cards and a list of medications.
Day one at home
A hip, wrist or head injury from striking pavement can take a day to declare itself, and the state’s 2023 count included a pedestrian 65 or older hurt in the village. If pain, dizziness or confusion appears once you are home, go back to a doctor and say plainly that a car hit you, so the chart connects the two.
Order the report once the department has finished it. Read the location line twice: a corner that had no address on the day of the crash is easy to misdescribe, and an insurer that cannot match the report to its own driver will stall.
Tip: That evening, jot down the hour, the light, which side of the lane you were on and what you heard before the impact. Those notes are for your lawyer, never for the other side’s adjuster.
Day two during an event week
Every August, Car Week fills the village with collectors, crowds and unfamiliar drivers. The city’s 2026 announcement listed closures of Ocean Avenue between Junipero and Lincoln for events including Concours Carmel, and between Monte Verde and San Carlos for a separate exhibition (City of Carmel-by-the-Sea). In past years, closures for Concours on the Avenue sent through traffic onto Carpenter Street and Rio Road (City of Carmel-by-the-Sea). The county’s transportation agency names Carmel-by-the-Sea among destinations where seasonal surges and drivers new to the roads cause safety problems (TAMC).
A crash during one of those weeks leaves a paper trail worth collecting on day two: the closure notice and detour routing for that date, the event’s own staff and security contacts, and video from galleries and shops along Ocean Avenue before their systems record over it.
Day three and the taped statement
Within a few days, an adjuster for the driver’s insurer will ask to tape your version of events. Saying “not yet” costs nothing, and waiting until a doctor has seen the whole injury protects you.
Expect to hear that you were walking in the roadway. On village blocks with no sidewalks, the roadway is where everyone walks, and a driver’s care is measured against those conditions. Even a verdict that put, say, a fifth of the fault on a walker in the lane would cut that walker’s damages by a fifth, not to zero, under California’s pure comparative fault rule (CACI 405).
If the driver was a visitor in a rental, the rental contract names the policy behind the car, and when that coverage is thin, the uninsured and underinsured motorist part of your own policy is the next place to look.
What the 2023 table does and does not say
| 2023 row | Number | Place (of 74) |
|---|---|---|
| Pedestrians | 2 | 7 |
| Pedestrians 65 and older | 1 | 3 |
| Everyone killed or injured | 5 | 38 |
| Speed-related | 1 | 37 |
| Composite | — | 39 |
Five victims is a small number, and one crash more or less would reshuffle these places, so the table is a snapshot of a single year. The village’s 19 DUI arrests in 2023 sit on a row where a low place means few arrests, so Carmel’s 62nd speaks to how actively the village polices impaired driving, not to how risky its streets are (OTS 2023).
What Carmel visitors and residents ask
I was on vacation in Carmel when I was hurt. Can I pursue a claim from home?
Yes. The crash happened on California roads, so California rules apply, and the Aguajito Road courthouse in Monterey is the venue. Neither the two-year limit nor the six-month City deadline pauses because you have flown home.
Does the village’s choice to skip streetlights make the City liable?
Not by itself. Public agencies have defenses for deliberate design decisions, and a claim must show a dangerous condition of public property. If you think the street played a part, raise it within weeks, not months, because of the six-month window.
The driver was here for Car Week in a borrowed collector car. Whose insurance pays?
Often the owner’s policy follows the car, and the driver’s own policy may sit behind it. The owner’s name and insurer should be on the registration, which is one more reason to photograph it at the scene.
Our block had no address when the crash happened. Will the report be wrong?
Officers normally record cross streets. Compare the report’s description with your photographs and ask the department to correct a mistake before an insurer builds on it.
By the end of week one
- The officer’s card, showing whether the village department or the Highway Patrol responded
- Natividad or emergency-room discharge instructions
- Night or day photographs that match the crash’s lighting
- Phone numbers and home towns for visiting witnesses
- The rental contract if the other car came from an agency
Driver and City deadlines
Suits against a private driver, or against an innkeeper or shopkeeper after a fall, carry a two-year filing limit in California (CCP §335.1). The lanes and walkways are City property, and a pedestrian who blames their condition has just six months to file a written claim with the City (Gov. Code §911.2).
Where a lawsuit is heard
Monterey County’s civil division sits at 1200 Aguajito Road in Monterey, and that is where a Carmel lawsuit would be heard (Local Rule 6.2(B)).
Call Jacob’s Carmel-by-the-Sea pedestrian and crash work
Call Jacob represents Carmel-by-the-Sea residents and the visitors who walk Ocean Avenue, Junipero and the unlit residential blocks. On a village case, we handle the first requests ourselves: the Carmel-by-the-Sea Police Department report, the exact cross streets, and preservation letters to Ocean Avenue galleries and inns whose cameras faced the scene. For an August crash, we also pursue the City’s Car Week closure records for that date.
People on foot account for an unusual share of the harm in this village, which is why pedestrian accidents lead our Carmel work. The Law Offices of Jacob Emrani also handles car accident claims from Highway 1 and the village streets, cyclists and motorcyclists on the coast road, Uber and Lyft rides that end in a collision, falls at shops and inns under premises liability law, dog bites, and wrongful death claims.
There is no charge to sit down with us about a Carmel crash, and you pay nothing unless we win. Call (888) 952-2952 whether you are recovering on the peninsula or have already flown home, or send the details through the case evaluator.
If travel is hard while you heal: a representative can come to you instead.
This is a general explanation of Carmel-by-the-Sea’s 2023 crash figures, its unlit streets and California filing limits, offered for information; your own facts deserve individual legal advice.
