Is Buena Park a low-crash city?

The myth: “Buena Park is a low-crash city, so insurers will treat my claim as minor.” The first part is largely true. The state Office of Traffic Safety compares Buena Park with 102 other cities in population Group C, and for 2023 the city placed near the safer end in most categories (OTS). A rank of 1 is the worst.

Set beside a population of 81,741 (Census Bureau), 227 victims in a year is a comparatively low toll.

Why the myth is wrong

The second part of the belief does not hold. An insurer values a claim by the medical treatment, the lost income and the effect on your daily life, not by where the city falls on a state chart. Two rows also stand apart: young drinking drivers and DUI arrests both rank in the top 40, consistent with the police department’s long attention to Beach Boulevard. A 2016 city notice said a sobriety checkpoint at Beach and Stanton was placed there because of collision data, and it reported one death and 47 injuries in DUI collisions over the prior three years (City of Buena Park).

Myths about Beach Boulevard, trucks and parking

“Beach Boulevard is just a city street”

Beach Boulevard is also State Route 39, one of three state highways that cross a city of only 10.56 square miles; the others are I-5 and SR-91 (Wikipedia). The distinction matters when the condition of the road contributed to a crash. If the claim goes to the city when Caltrans owns that stretch of SR-39, or the reverse, the six-month clock under Gov. Code §911.2 keeps running. Before we file, we confirm whether Caltrans or the city maintains the block where you were hurt.

CHP Westminster and the freeways

On I-5 and the 91, the investigating agency changes. The Highway Patrol’s Westminster Area office, at 13200 Goldenwest Street, lists I-5 and SR-91 near Knott’s Berry Farm among its patrol routes, so a crash on either freeway produces a CHP report rather than a city police report (CHP).

“A truck crash is just a bigger car crash”

The city publishes a designated truck-route map and a second map showing the share of traffic on each street that is commercial trucks (City of Buena Park). Those maps can show whether a tractor-trailer belonged on your street at all. Truck cases also involve parties an ordinary car crash does not: the carrier, a broker, the shipper who loaded the trailer and sometimes a maintenance contractor. Each has its own insurance and its own records, including electronic logging data that carriers must keep only for a limited time. Under Vehicle Code §17451, anyone who drives on California roads is treated as having appointed the DMV director to accept legal papers in a lawsuit arising from that driving (leginfo). A rental car adds a second policy to examine. The practical difficulty is that a family visiting Knott’s may be back across the state line within days, so collect the driver’s license, plate and insurance details before they leave the scene.

“A teenager’s family is not responsible”

That is the one figure on the city’s chart that runs well ahead of its size. Four people were hurt in 2023 crashes involving a driver under 21 who had been drinking, which placed the city 30th, far worse than its overall standing. If the at-fault driver is under 18, Vehicle Code §17707 makes the adult who signed the license application responsible for the minor’s negligence, up to dollar limits set by §17709 (leginfo). The family’s auto policy usually matters more than the statute, because it typically covers every driver in the household.

“A Metrolink or OCTA crash is like any other”

The Buena Park Metrolink station has operated since September 2007, and OCTA buses and LA Metro Route 460 also serve the city (Wikipedia). Each operator is a public agency. An injured passenger or driver must present a written government claim to that agency within six months; the two-year lawsuit period in CCP §335.1 governs only the private parties. Records to gather in the first month

1. Days 1–3. Identify the investigating agency: Buena Park Police for surface streets, CHP Westminster for I-5 or SR-91. Save the officer’s name, badge number and the incident number in your phone before the tow truck arrives.
2. Week 1. Ask businesses along Beach Boulevard, and the attraction’s security office if you were hurt near Knott’s, to preserve their video. Many of those systems keep only a few days of video before writing over it.
3. Week 1. If the signal phase is in dispute, request the city’s signal timing records. The city operates more than 80 signalized intersections and coordinates timing with neighboring cities (City of Buena Park).
